SINGAPORE - A man met a Secondary 3 girl half his age at a Japanese-inspired Harajuku group event, where they developed feelings for each other.
He then taught her how to perform sexual acts and they met multiple times at his home to have sex.
Their relationship came to light when an anonymous person informed the girl's family who, in turn, confronted the victim before they contacted the police.
On Friday (May 27), the man, who cannot be named due to a gag order to protect the victim's identity, was jailed for two years and four months after earlier pleading guilty to three charges of having sex with a minor.
Another four charges were taken into consideration during sentencing.
The court heard that the man, now 34, has a mild intellectual disability but that it had no causal link to his offences.
He was unemployed and had a girlfriend at the time of the offence.

The pair were part of a society for Harajuku enthusiasts of the fashion and culture made famous by the trendy Japanese district.
The group met regularly and would dress up in Harajuku-inspired clothes.
The man would attend lunches organised by the group, and it was at one of these events that he got to know the girl, then 14.

In May 2018, she texted the man that she felt insecure about her new haircut. He suggested they go to his home, where he could help cut her hair.
She agreed and had her hair cut in his living room, before heading into the man’s room when his father came home. She studied on the floor while the man played with his phone on his bed.
She then lay next to him at his request and the man guided her to perform a sexual act, before having sex with her.

They did so on several occasions over the next few months.
The man was aware that he was unlawfully having sex with a minor, stated court documents.
Eventually, the girl’s step-sister received an anonymous message on Instagram telling her the victim had been sleeping with someone and told the girl’s mother.
When she was confronted by her mother, the victim confessed that she had sex with the accused.
The prosecution said: "(The mother) and the victim's step-sister then confronted the accused. The accused then retorted that it was the victim who asked him for sex."
Enraged, the mother reported the matter to the police in November that year.
Seeking at least 30 months’ jail for the man, Deputy Public Prosecutor Colin Ng said that the girl was sexually exploited and morally corrupted by the man who taught her how to perform sexual acts.
Any consent given by the victim is not a valid mitigating factor, he added.
Consequently, the girl developed trust issues and panic attacks, said the DPP, adding that the man showed no remorse as he blamed the victim when the family confronted him.
In mitigation, the defence said no force was used in committing the rape and argued that the man, who hopes to get married after his sentence, had an intellectual disability.
DPP Ng said that the man’s condition did not contribute to his offence and that he could still tell what is right and wrong at the time.
The offender will start his sentence next month. Those guilty of having sex with a minor under 16 can be jailed for up to 10 years and fined.

SINGAPORE - A 20-year-old youth who raped a drunk 16-year-old girl he met at a birthday gathering was sentenced to eight years' jail and six strokes of the cane on Monday (Aug 15).
Rajama Samuel Doctorian Purba, an Indonesian who was then taking a diploma course at a private school here, pleaded to a charge of raping the victim at his rented apartment in November 2020.
Two other charges, one for molesting the victim and one for possession of obscene films, were taken into consideration.
The High Court heard that Rajama shared the condominium unit with another Indonesian, Mr Anthony Aditya Tedjawisastra, 19, who was also studying at a private school here.
On the afternoon of Nov 6, 2020, the victim was invited by her friend to a gathering at the apartment to celebrate his birthday.
The friend was a course mate of Mr Anthony, who organised the gathering.
She was initially hesitant to attend the gathering as she did not know anyone but eventually decided to go as it was to celebrate her friend's birthday.

At the apartment that night, after some introductions, the victim, her friend, Rajama and Mr Anthony sat in the living room, playing card games and having alcoholic drinks.
After a few rounds of games, the victim became dizzy and wanted to vomit.
Rajama supported her and led her to the toilet in his bedroom, while the other two people remained in the living room.

Once in his room, Rajama locked the door and took the girl to the toilet.
After she was done vomiting, he cleaned up after her and realised that she was unconscious.
Rajama then placed her on his bed, lifted her shirt and bra and groped her. When she did not react, he raped her.
The victim felt the accused raping her but could not resist or move her body as she was intoxicated.
After Rajama stopped, he dressed the victim up, helped her to the toilet, where she vomited again, and left her there.

Later, when Mr Anthony entered the room, he told Rajama off for leaving her on the toilet floor.
Rajama then confessed that he had sex with the victim.
The victim left the unit at about 4am, supported by her friend. She later told him what Rajama had done to her.
She made a police report that night.

SINGAPORE - A man spotted a sex worker in deep sleep on a chair in Geylang and molested the unresponsive woman before carrying her off to a nearby area in the wee hours of March 1 last year.
Bangladeshi factory worker Patian Sohag then had sex with the woman, who managed to stagger back to the chair before dozing off.
She made a police report only after she woke up later that morning, and officers arrested Patian three days later.
The 40-year-old man, who was initially charged with rape, was on Friday sentenced to 3½ years' jail with three strokes of the cane after he admitted to a reduced charge of abducting the woman for sex.
Court documents did not disclose the reasons behind the reduction.
Patian also pleaded guilty to one count of molesting her.
After the incident, a blood sample taken from the victim revealed traces of cough suppressant dextromethorphan and sedative nitrazepam.

The detected levels of these two substances were about three to five times the upper ends of their therapeutic ranges.
The court heard on Friday that dextromethorphan can cause sedation while nitrazepam's side-effects include disorientation, confusion and amnesia.
The prosecution said: "The victim would very likely and very probably experience the... side-effects (of the substances)."

Deputy Public Prosecutors Delicia Tan and Phoebe Tan stated in court documents that Patian had earlier gone to Geylang with a male friend to look for sex workers.
However, Patian was unable to find a suitable one as he felt that the prices quoted were too high.
After his friend left, Patian spotted the victim, who was then sleeping in a chair at around 3.20am. He tried to wake her by calling out to her but she did not respond.

He also noticed that she was in deep sleep and did not make any movement.
Patian then molested the woman and asked her if she wanted to have sex with him, but she did not respond.
The prosecutors said: "The accused knew that he had not obtained the victim's consent for sex and decided to compel her to go to a connected lane nearby where there were potted plants so that he could have sex with her there.
"The accused lifted the victim up from the chair by placing both his hands underneath her armpits... he stretched out his hands around her back... and carried her to the potted plants area."
After that, Patian placed the woman on the ground and had sex with her before leaving the scene.
The victim made her way back to the chair at around 3.30am and fell asleep before alerting the police about five hours later.
On Friday, the prosecution asked for Patian to be given up to four years and three months' jail with three strokes of the cane.
The prosecution told the court: "He took advantage of the vulnerable state that the victim was in by molesting her and abducting her for sex, despite being fully aware that she was unable to (give her) consent."
Defence lawyer Ashwin Ganapathy from IRB Law had represented the offender pro bono.
He pleaded for Patian to be given three years' jail with three strokes of the cane, stressing that the offender was deeply sorry for his actions.

SINGAPORE - Despite being told she had yet to turn 18, a man had sex with a girl he met on Sugarbook and paid her $1,000 for her services.
Aloi Gregory Marshall, 47, was sentenced to 12 weeks’ jail on Wednesday after pleading guilty to obtaining the sexual services of an individual under 18 years of age.
The victim cannot be named due to a gag order to protect her identity.
The court heard that Marshall browsed the Sugarbook website to look for companionship sometime in early 2021.
Sugarbook is a matchmaking website that pairs women with men willing to pay for their time.
Marshall saw the victim’s profile on the website where she represented that she was 18 years old. They communicated on Sugarbook and subsequently continued chatting on messaging app Telegram.
On Telegram, Marshall asked the girl if she was 18, to which she replied she was “turning 18 this December”.

In response, he asked the victim if she was interested to provide him with sexual services. He said he would pay her $1,000 for a two-hour session, during which they would “have sex twice”.
She agreed and they met in April 2021 at his residence, where they had sex.
Marshall subsequently left $1,000 by the victim’s bag as consideration for her sexual services, and she took it before leaving his residence.
That same month, Marshall reached out to the victim on Telegram to ask if she wanted to meet again. The pair tried to arrange a meet-up but were unable to find an available date.
In May, Marshall contacted the victim twice to ask if she was free to meet, but she did not respond.

Seeking a sentence of 12 to 14 weeks’ jail, Deputy Public Prosecutor Tin Shu Min said the degree of inquiry performed by the accused in ascertaining the victim’s age ought to be taken into consideration during sentencing.
DPP Tin also noted: “Even though the accused and the victim met only once, the accused continued to communicate with the victim thereafter in an attempt to arrange for another session of commercial sex.
“While this was not a case in which the accused deliberately sought out a minor to begin with, he proceeded despite being finding out she was a minor.”
Marshall’s request to defer his sentence to give him time to settle some matters was approved. He will begin his jail term on Nov 16.
An offender who obtains the sexual services of an individual under 18 can be jailed for up to seven years, fined, or both.

SINGAPORE - Using a fake online profile, a hotel room attendant who had less than $23 in his bank account offered a woman $2,500 to have sex with him, and told her that she could change her mind after they meet up.
But after duping her into agreeing to meet him, Li Jiajie strangled and punched the woman, then raped her. He told her that she cannot leave his flat until he was done.
On Friday, the 32-year-old Chinese national was sentenced to 12 years’ jail and 12 strokes of the cane after he pleaded guilty in the High Court to a charge of aggravated rape committed against the woman, then 28, on June 9, 2018.
The court heard that Li got to know the woman on a dating app in May 2018.
He identified himself with a fake name and used the picture of another man he found online as his profile picture.
Li told the woman that he worked as an engineer and repeatedly offered to give her $2,000 if she would have sex with him.
The woman initially rejected him, but continued chatting online with him.

Li told her that he liked her and would be good to her, and increased his offer to $2,500.
On the afternoon of June 8, 2018, the woman asked Li whether he would respect her decision if she changed her mind after meeting up, and he said he would.
When they met that night at Kallang MRT station, the woman told Li that he looked very different from his profile picture, but he said he looked no different.

After they went to his place, she asked if he was living alone, and he replied that he did not have financial means to rent the whole flat.
She then asked him for the money, and when he did not respond, she booked a Grab ride to go home, but he refused to let her leave.
When she said she would call the police, Li replied that he would tell the police that she was a prostitute.
He then pinned her down on the bed, strangled and punched her, and demanded that she take off her clothes.

The woman tried to push him away but was overpowered.
She tried to talk Li into letting her go, but he told her that she cannot leave until he finished.
After the rape, the woman left the flat in a daze and flagged a taxi. On her way home, she decided to make a police report. Meanwhile, Li repeatedly asked her to share her location with him.
Li was later arrested at his workplace.
On Friday, Li told the court he would like to apologise to the victim and her family for causing hurt to her, and asked for leniency so that he could return to China early to take care of his mother.
Justice Hoo Sheau Peng noted his remorse, but said personal family circumstances are generally not a mitigating factor.
In sentencing, the judge said the nature of the violence and hurt inflicted was a sentencing factor, and noted that Li had forcefully strangled and punched the victim.

24 years’ jail for man who repeatedly raped maid while his wife, kids were not at home​

SINGAPORE – Over a two-month period, a 34-year-old unemployed man repeatedly raped the family’s domestic worker while his wife and three children were not at home.
The Indonesian woman, who was then 24, initially endured the abuse but eventually ran out of the flat in tears and called her agent, who assured her that lodging a police report would not prevent her from working in Singapore.
However, the abuse left her distrustful of men and unable to focus on her work, which resulted in two subsequent employers dismissing her. Her boyfriend and family also blamed her for what happened.
On Wednesday, the man was sentenced to 24 years’ jail and 24 strokes of the cane, after he pleaded guilty to two charges of rape and a charge of sexual assault by penetration, committed between September and October 2020.
These charges carry enhanced punishment under the law, which allows employers who commit offences against their domestic workers to be given up to twice the maximum punishment.
Nine other charges for various sexual offences, including rape, sexual assault by penetration and outrage of modesty, were taken into consideration.
In sentencing, High Court judge Dedar Singh Gill said: “This case brings into sharp focus the plight of a foreign domestic worker who becomes a victim of rape in the household where she works.”

Justice Gill noted that the woman’s rejection by two subsequent employers meant she could not earn the money she came here to earn.
The woman eventually found a housekeeping job in May 2022.
Deputy Public Prosecutor Kevin Yong earlier told the court that the maid started working for the family in January 2020.

“The accused claimed that he felt frustrated because his wife was no longer satisfying his sexual urges,” said the prosecutor.
The man waited for his wife to leave the flat before molesting, sexually assaulting and raping the victim on four different occasions from September 2020 to Oct 15, 2020.
On one occasion in September 2020, the maid was in the flat alone with the man after his wife left with two of their children to pick up their oldest child from school.

While the maid was in the kitchen, the man started hugging and kissing her. She pushed him away, told him to stop and ran into her bedroom.
He followed her into her room, continued hugging and kissing her despite her objections, and took off her clothes.
He left the room to get a condom. When he returned, the maid had dressed herself, but he removed her clothes again and then raped her.
On another occasion that month, he carried her to the room against her will and sexually assaulted her.
After this incident, the woman asked him not to do it again because she was in a relationship, and he was married with three children. But the man did not stop and raped her again, when they were alone at home.
After the last assault on Oct 15, 2020, the woman called her agent in desperation. The agent picked her up and they proceeded to lodge a police report.
The DPP sought 23 to 28 years’ jail and 24 strokes of the cane, while defence counsel Ashwin Ganapathy asked for 22 to 23 years’ jail.
The man also read out a letter in court asking for leniency. He sobbed as he admitted he was “a poor husband and a poor employer”, said he was deprived of fatherly love as a child, and asked the court to pity his now former wife and his children.

SINGAPORE - Four of the seven men involved in an unprecedented case where husbands with wife-sharing fantasies conspired with other men to have their own partners sedated and raped were sentenced to between 13½ years and 22 years in prison on Wednesday.
They were each also ordered to be given 20 strokes of the cane, except for one man who was above the age of 50 and cannot be caned.
“This is one of the most astonishing and atrocious cases of sexual assault to come before the court,” said Justice Pang Khang Chau before sentencing the four men.
Three of the men – Husband K, 45; Husband L, 53; and Husband M, 45 – had helped another man gain access to their respective partners and then watched as the accomplice raped, or tried to rape, the unconscious women.
These three men, as well as a fourth, Bachelor N, 37, each also conspired with another accomplice, Husband J, 41, to rape J’s wife.
K’s wife was raped by J on three occasions between 2012 and 2013, while M’s former wife was raped by J in 2018.
K and M recorded the assaults and shared the photos and videos with other men.


L’s wife regained consciousness before P, her husband’s colleague, could rape her in 2017.
J’s wife was raped and sexually assaulted by five men between 2010 and 2018. His case is still pending in court.
Some of the men met one another on the SammyBoy online forum and other platforms for people looking to exchange sexual partners and share their wives, and also introduced the other men to each other.

In both private and group chats, they discussed wife-sharing fantasies where the husband would watch another man have sex with his wife.
They also exchanged details of their sex lives and shared explicit images or videos of their wives or partners with one another.
Aside from conspiring to rape each other’s wives, J and K each also secretly live-streamed themselves having sex with their wives to others.
The crimes came to light after J’s wife discovered explicit images of herself on his mobile phone on Jan 1, 2020, and found out that her husband and K had been “exchanging wives”.
The men cannot be named owing to a gag order to protect the identities of the four victims.
On Wednesday, K was sentenced to 22 years’ jail and 20 strokes of the cane.
The man, who worked in business development, drugged his wife with sleeping pills on three occasions between 2012 and 2013, and when she fell unconscious each time, J raped her on the couple’s matrimonial bed.
In turn, with J’s help, K raped J’s unconscious wife in 2014 at J’s flat.

After raping each other’s wives, K and J continued to chat about what they had done.
K said it would be nice if J could “manage to knock her up”. They also spoke of plans to get their wives raped and impregnated by other men.
In victim impact statements submitted to the court, J’s and K’s wives described how they felt after finding out they had been drugged and then raped on their own matrimonial beds.
J’s wife said she “felt so hurt, angry, disappointed and overwhelmed by the sense of betrayal” and thought she “would be better off dead”.
As time went by, she said, she “began to feel numbed about the whole case and... chose not to feel anything about it”.
K’s wife said she “felt like dying” when she first found out what had happened to her, but has “tried to manage (her emotions) by not thinking about the incident at all”.
L, a business development manager, was sentenced to 13½ years’ jail.
He raped and sexually assaulted J’s unconscious wife in 2013. In 2017, L drugged his wife and invited his colleague P to rape her, but P ultimately did not succeed.
P was jailed for three years in January.
M, a company director, was sentenced to 20 years’ jail and 20 strokes of the cane.
He raped and sexually assaulted J’s unconscious wife in 2010, and molested her in 2011.
In 2018, M asked his former wife to go with him to J’s flat, where J offered her a spiked drink and then raped her while M took photos.
N, a food delivery worker, was sentenced to 18 years’ jail and 20 strokes of the cane.
He raped J’s wife on two occasions between 2017 and 2018, while J took photos.
The last accomplice, O, is contesting the charge against him for the rape of J’s wife.

One afternoon, when he was alone at home with his daughter, the man told her to play a game with him, before he sexually assaulted and raped her.
The sexual abuse continued for three years, and only came to light after the man’s wife happened to see him lifting the victim’s shirt at a staircase landing outside their flat.
On Thursday, the 58-year-old man was sentenced to 23 years’ jail after he pleaded guilty in the High Court to two charges of rape and one charge of sexual assault by penetration.
Four other charges were taken into consideration in sentencing.
The man cannot be named owing to a gag order to protect the identity of his daughter – the oldest of his three children – who is now 34 years old.
In sentencing, Justice Pang Khang Chau agreed with prosecutors, who argued that the man lacked remorse as he sought to justify his offences by blaming his wife for withholding sexual intimacy.

Deputy Public Prosecutor Jordon Li told the court that following the birth of their third child, the frequency of sex between the accused and his wife decreased. By 2000, the couple had stopped having any sexual intimacy.
The man had a Malaysian girlfriend, with whom he had sex until their relationship ended in 2016.
On the afternoon of the first assault in 2017, he forced the victim to perform oral sex on him and raped her, despite her reluctance and objection. After the rape, he told the victim not to tell her mother about what had happened.

In 2019, as she was coming out of the bathroom, the man told the victim, “let’s have fun”, before he raped her.
On July 8, 2020, the man’s wife felt concerned when she realised that the victim was still not home at 11.45pm, and decided to wait for her at the corridor.
As she was walking along the corridor to wait, she noticed that the victim was at the staircase landing with a man, who was lifting up her shirt.

The woman ran towards the staircase landing and discovered that the man was her husband.
On seeing his wife, the man immediately let go of the victim’s shirt, apologised and asked for his wife’s forgiveness.
About 45 minutes later, the wife told her younger daughter what she had seen at the staircase landing. The younger daughter then asked her sister about the incident.
The victim revealed she had run into their father along the corridor, and that he had held on to his mobile phone with one hand and lifted her shirt with the other.
The younger daughter then took their father’s phone from his bedroom when he was asleep and found, among other things, a video of the victim undressing herself in the deleted folder of the phone.
On further probing, the victim revealed to her sister that her father had recorded the video after he entered the bathroom while she was inside, and then told her to remove her clothes.
After some discussion, the wife and the younger daughter decided to go to the police, and took the victim to lodge a report on July 10, 2020.
The man was arrested on the same day.
During investigations, the victim revealed that her father had raped her, but she did not tell anyone as she was afraid that no one would believe her and because she did not want to cause disharmony in the family.
A report from the Institute of Mental Health said the victim was not able to give informed consent to sex, and was not capable of rejecting the accused’s sexual advances due to her limited understanding of the nature and complications of sexual intercourse, immature social judgment, and poor communication skills.
On Thursday, defence counsel Riko Isaac said the family had forgiven the man and wished to be reunited with him eventually.

The man had a Malaysian girlfriend, with whom he had sex until their relationship ended in 2016.
On the afternoon of the first assault in 2017, he forced the victim to perform oral sex on him and raped her, despite her reluctance and objection. After the rape, he told the victim not to tell her mother about what had happened.

In 2019, as she was coming out of the bathroom, the man told the victim, “let’s have fun”, before he raped her.
On July 8, 2020, the man’s wife felt concerned when she realised that the victim was still not home at 11.45pm, and decided to wait for her at the corridor.
As she was walking along the corridor to wait, she noticed that the victim was at the staircase landing with a man, who was lifting up her shirt.

The woman ran towards the staircase landing and discovered that the man was her husband.
On seeing his wife, the man immediately let go of the victim’s shirt, apologised and asked for his wife’s forgiveness.
About 45 minutes later, the wife told her younger daughter what she had seen at the staircase landing. The younger daughter then asked her sister about the incident.
The victim revealed she had run into their father along the corridor, and that he had held on to his mobile phone with one hand and lifted her shirt with the other.
The younger daughter then took their father’s phone from his bedroom when he was asleep and found, among other things, a video of the victim undressing herself in the deleted folder of the phone.
On further probing, the victim revealed to her sister that her father had recorded the video after he entered the bathroom while she was inside, and then told her to remove her clothes.
After some discussion, the wife and the younger daughter decided to go to the police, and took the victim to lodge a report on July 10, 2020.
The man was arrested on the same day.
During investigations, the victim revealed that her father had raped her, but she did not tell anyone as she was afraid that no one would believe her and because she did not want to cause disharmony in the family.
A report from the Institute of Mental Health said the victim was not able to give informed consent to sex, and was not capable of rejecting the accused’s sexual advances due to her limited understanding of the nature and complications of sexual intercourse, immature social judgment, and poor communication skills.
On Thursday, defence counsel Riko Isaac said the family had forgiven the man and wished to be reunited with him eventually.

SINGAPORE - A 34-year-old technician who tricked 15 girls into sending him sexually explicit photos and videos of themselves, and manipulated five of these victims into having sex with him, was sentenced to 31 years’ jail and 24 strokes of the cane on Monday.
Chinese national Lin Rongxin, who is married with a son, had also threatened some of his victims into secretly filming five other girls and women while they were changing clothes or showering.
In sentencing Lin on Monday, High Court judge Hoo Sheau Peng called him a depraved sexual predator who harmed and affected the lives of not just his 20 victims, but their families as well.
Justice Hoo said the case was a stark reminder of the increasing prevalence of the use of technology in crimes, and that the sentence was a signal to potential offenders that the law has no tolerance for those who abuse technology to prey on the vulnerable.
“It is my hope that the victims will find some measure of closure with the conclusion of this case,” she said.
“I also hope that the plights of the victims serve to warn young people to exercise the utmost caution in their online interactions.”
Lin’s wife, who was present in the court on Monday, was allowed to speak to him after he was sentenced. He will be in his 50s when he is released, if given the usual one-third remission for good behaviour.

He had pleaded guilty on Nov 28 to three counts of rape committed against three victims, three counts of criminal intimidation for threatening to circulate naked photos or videos of three victims, and one count of voyeurism for instigating a victim to secretly film her flatmates in the shower.
Another 57 charges were taken into consideration for sentencing.
Using multiple false personas, Lin ran an elaborate “sextortion” scheme from 2018 until his arrest in June 2019. Posing as 19-year-old Lin Zhi Xuan, he “catfished” girls, aged 14 to 19, to trick them into sending him revealing and obscene photos and videos of themselves.


Catfishing is the practice of using a fake online profile to lure another person.
He then threatened to distribute the sexually explicit videos and photos unless his victims gave him money or performed various sexual acts for him.
At least five victims were forced into performing sexual acts on video for him, but seven others refused and eventually blocked him from contacting them.
He also demanded that the victims have sex with another man, “Huang Yi”, who was actually himself.
After having sex with the victims, he fooled them into thinking he would help them resolve the threats by their blackmailer.
Three of the unsuspecting girls ended up having a relationship with him, and had sex with him on further occasions.
In the case of one rape victim, V1, who was then 14, he told her under his guise as Huang Yi that he had spent 260,000 yuan (S$50,400) trying to purchase from her blackmailer the images that showed her naked. She felt indebted to him and developed feelings for him.
He made another rape victim, V2, then 15 to 16 years old, perform particularly degrading acts. Despite raping her twice, he continued to threaten to send explicit videos of her to her relatives, friends and parents.
As for the third rape victim, V4, then 19, he used his Lin Zhi Xuan persona to concoct a story about how he was poor and owed $8,000 to his creditor, Huang Yi. V4 took pity on him and agreed to have sex with Huang Yi to help him.
When he realised that V4 had feelings for his online persona, he told her Lin Zhi Xuan was gay, so that she would fall in love with his physical self instead.

SINGAPORE - A man who was accused of raping his former girlfriend while trying to strangle her claimed that they had consensual sex and that the bruises on her neck were “love bites”.
The 45-year-old man was initially cleared by the High Court in June 2020 following an 11-day trial.
In September 2022, his acquittal was reversed by the Court of Appeal after the prosecution appealed, and he was sentenced to 13 years’ jail and 12 strokes of the cane.
On Wednesday, the three-judge apex court issued written grounds setting out its reasons for convicting the man and for the sentence imposed.
“It was clear to us that the judge’s decision to acquit was wholly against the total weight of the objective evidence and the testimony of the prosecution’s witnesses,” wrote Justice Tay Yong Kwang.
One of the issues that weighed against the accused was that the use of violence was evident from the extent of the tear in the woman’s T-shirt and the damage to the fasteners of her brassiere, as well as the bruises on her neck.
The court, which also comprised Justices Judith Prakash and Woo Bih Li, said the bruises did not appear to be love bites.

In any case, the accused was not able to explain a line between the two bruises, which indicated that some injury was inflicted, said the court.
The damage to the brassiere fasteners also corroborated the woman’s account that the man used violence to subdue her, said the court.
Another issue that weighed against the accused was that the romantic relationship between him and the woman had clearly ended before the rape on Aug 6, 2017, said the court.

The man and the woman, who is now 34, are Malaysians who got into a relationship in 2012 while working in Singapore. In 2015, they rented a flat together.
In February 2017, the man lost his job and could not remain in Singapore for long periods of time. By May 2017, she asked him to move out because she wanted to end the relationship.
The court pointed out that the woman had not communicated with the man since July 21, 2017, until he turned up at the flat unannounced on Aug 2, 2017. This was despite the fact that he had sent her more than 100 messages during this period.
The woman’s response to his return, including staying with her aunt for two days, showed that she was totally uninterested in interacting with him, said the court.
The man’s behaviour after the alleged rape also betrayed his guilt, said the court.
After the assault, he took her to a nearby clinic, where she told the doctor that the man had sexually assaulted her. The doctor told his assistant to call the police, and the accused left before the police arrived.
He then sent the victim more than 60 messages apologising to her and begging her not to make a police report. He also sent voice messages to his family members, saying he was afraid that she would accuse him of “attempted rape”.
“If he held the genuine belief that he and (the victim) had consensual sex, there would have been absolutely no reason for him to assume that the police was at the clinic because of him,” said the court.
Finally, the Court of Appeal disagreed with the trial judge that the woman’s credibility was affected by inconsistencies in her evidence.
The apex court agreed that the woman was inconsistent when she told the clinic doctor she last had sex with the man in November 2016 and, later in court, admitted that the last time was in March 2017.
However, this did not affect the pivotal point of the evidence that their relationship had ended before August 2017, said the court.

SINGAPORE – A man who raped a 52-year-old woman in a toilet after hitting her head against the wall and a wash basin was sentenced to 12 years’ jail and 16 strokes of the cane on Wednesday.
Chew Kee Hock, who was 28 years old at the time and 30 now, was also ordered by the High Court to pay about $140 in medical fees to the victim, after the prosecution sought a compensation order against him.
He had pleaded guilty in February to one charge each of aggravated rape and attempted aggravated rape.
Three other charges, including one for criminal trespass, were taken into consideration.
Chew worked at a healthcare products company in Toa Payoh.
On the night of Aug 17, 2021, he heard someone showering in the women’s toilet in the office building and later saw the victim coming out of the toilet.
He found her “very sexy” and made small talk with her.

Two days later, he took medical leave but went to his workplace in the evening with the specific intention of raping the victim.
He found the toilet door locked, but discovered that the key for his bedroom could unlock the door.
Shortly after 8.30pm, the victim entered the toilet to take a shower. Chew unlocked the door, barged into the toilet and slammed the door shut behind him.


The two of them wrestled on the wet toilet floor. He pulled her hair and repeatedly hit her head against the wall and wash basin, while she struggled and shouted for help.
Chew pulled the victim’s towel over her mouth to muffle her shouts. She stopped screaming after he threatened to suffocate her.
He then asked her to perform a sex act on him, but she refused. She got up and tried to lock herself in a cubicle, but Chew pulled her out and forced himself on her.
After the rape, the victim ran out of the toilet, screaming for help.

He caught up with her and dragged her back into the toilet. He then flung her onto the floor and tried to gag her with the towel.
When she bit his forearm, he pushed her head back, causing her head to hit the wall. Chew again demanded that she perform a sex act on him, but this attempt was unsuccessful.
After he left for home, the woman put on her clothes and went downstairs to seek help.
Through her description of her assailant and closed-circuit television footage, the police traced Chew, who was arrested the next day.

SINGAPORE - A 42-year-old man was sentenced to 29 years’ jail and 24 strokes of the cane after he admitted in court that he fed his wife sedatives and had her raped by five men to fulfil his wife-sharing fantasies over a period of eight years.
The father of four, identified as J, also admitted that he had raped the wives of two of the men. The assaults were often carried out without the use of protection, with the men taking photos and videos of the acts.
J is at the centre of an unprecedented case where husbands with wife-sharing fantasies conspired with other men to have their own partners drugged and raped.
Of the seven men who have been hauled to court, J, a safety officer, faces the most number of charges.
On Thursday, he pleaded guilty to six charges, with another 11 charges taken into consideration.
During sentencing, Justice See Kee Oon said: “This case involves a shocking betrayal of marital trust and egregious sexual perversion.”
The judge said he was not persuaded that J was unreservedly remorseful, despite the man’s claim that he wanted to come clean and atone for his sins.

He said the man’s mitigation plea was replete with self-serving attempts to deflect responsibility and shift blame to others, including his co-accused, and that he even resorted to victim-blaming.
Justice See said: “Any perceived grievance on his part could neither justify nor mitigate his actions.”
In his written mitigation plea, the man, who was not represented by a lawyer, described his offences as a retaliatory measure against his wife for her alleged infidelities.

Addressing the court, he said he was pleading guilty “to own up” and “to accept my due punishment”.
“Right now, my main concern is the safety of my wife as well as my children,” he added.
J had also submitted a psychiatric report stating that he had a sex addiction. But the judge did not accept that the report was reliable or relevant.
Five of the seven men have been sentenced to between three years and 22 years in prison. Three of them were each also sentenced to 20 strokes of the cane.
Three of the men – Husband K, 45, Husband L, 54, and Husband M, 45 – had helped another man gain access to their respective partners and then watched as the accomplice raped, or tried to rape, the unconscious women.
The victims were all given sedatives without their knowledge.

J had conspired with the three husbands, as well as two other men, N and O, for them to rape his unconscious wife on their matrimonial bed between 2010 and 2018.
He also raped K’s wife on three occasions between 2012 and 2013, and raped M’s former wife in 2018.
Investigations showed that J and his accomplices got to know one another on the SammyBoy online forum and other platforms where people talked about exchanging sexual partners and sharing their wives. They then introduced the other accomplices to one another.
In both private and group chats, they discussed wife-sharing fantasies where the husband would watch another man have sex with his wife.
They also exchanged details of their sex lives and shared explicit images or videos of their wives or partners with one another.
J and K each also secretly live-streamed themselves having sex with their wives to others. After watching, the men would sometimes commend one another for the acts performed.
The crimes came to light after J‘s wife discovered explicit images of herself on his mobile phone on Jan 1, 2020, and found out that her husband and K had been “exchanging wives”.
The case against O is pending.
J admitted he got to know O, 44, between 2009 and 2010. J agreed to let O contact his wife to test whether she would be faithful to him.
Between 2010 and 2011, on the pretext of feeding her medication, J gave his wife a sedative. He then invited O over and watched as O raped his unconscious wife.
Separately, J told M, a company director, that he enjoyed seeing O court and have an affair with his wife.
Between 2010 and 2011, J gave his wife Dormicum, a sleeping pill, then blindfolded her and told M, who was waiting downstairs, to go up.
While M raped J’s wife, J took photographs and a video. Some months later, J spiked his wife’s wine and invited M to come over. J took photos as M molested his wife.
In 2018, M asked his former wife to go with him to J’s flat, where J offered her a spiked drink and then raped her while M took photos.
K drugged his wife with sleeping pills on three occasions between 2012 and 2013, and when she fell unconscious each time, J raped her on the couple’s matrimonial bed.
In turn, with J’s help, K, who worked in business development, raped J’s unconscious wife at J’s flat in 2014.
After raping each other’s wives, K and J continued to reminisce about what they had done.
K said it would be nice if J could “manage to knock her up”. They also spoke of plans to get their wives raped and impregnated by other men.
In 2013, J invited L, a business development manager, to come over after spiking his wife’s wine. J later sent videos of L raping his wife to N, though L and N never met.
L went on to conspire with a seventh man, P, to rape his own wife in 2017, but she regained consciousness before P could do so.
N, a food delivery worker, raped J’s wife on two occasions between 2017 and 2018 while J took photos.

SINGAPORE - A 17-year-old student of a popular school here has been charged with helping a teenage girl to bury the body of a child, and a separate charge of sexual penetration of a minor.
There is a gag order on the identities of the alleged offender and the victim.
The teenager was charged on Friday with abetting a girl, who was 16 then, to conceal the birth of a child by secretly disposing of the infant’s body.
According to court documents, he allegedly instigated the girl to conceal the birth by burying the body at the front yard of an undisclosed location on June 10, 2021.
The teenager was also charged with the sexual penetration of a minor. He allegedly had sex with a 15-year-old girl in a Housing Board unit some time in July 2020.
The boy, who according to his lawyer is still studying at the school, is out on bail and will return to court on Aug 7.
If convicted, he can be jailed for up to two years, fined or both for abetting the concealment of birth by secret disposal of a dead body.

SINGAPORE - A businessman's four-year court battle to get back $2 million from his former mistress has ended in defeat.

Mr Toh Eng Tiah will no longer be able to recover any money from Ms Angelina Jiang, who is 25 years his junior, following a decision by the Court of Appeal last Friday.
Instead, he will have to pay her $45,000.

It brings to a close a court saga that began in 2017 when the married businessman sued his former mistress, claiming the $2 million he had transferred her through a series of payments during their relationship consisted of loans.

Mr Toh, who has three grown-up children from a previous marriage, met Ms Jiang in November 2016 when he was 55 and she was 30.

They began a romantic relationship the following month but by May 2017 they had grown apart.

He later sued Ms Jiang at the High Court to try to get back the $2 million.

Mr Toh, whom the Straits Times understands is a director and shareholder of several companies including a recycling firm, relied on a loan agreement signed in March 2017 as evidence to support his claim.

But Ms Jiang said the sums she received were gifts instead.

She claimed that the 2017 agreement, signed by them both, was a sham document to placate Mr Toh's wife, improve his standing among his family and friends, and obtain a loan from one of his companies.

Last year, the High Court held that about $680,000 of the $2 million sought was transferred to Ms Jiang as gifts and not recoverable by Mr Toh.

It ruled that he should be repaid $1.12 million once such a sum became due under the loan agreement.

The court said the businessman also had to separately pay Ms Jiang $45,000 that he owed her.

Both Mr Toh and Ms Jiang appealed against the decision.

On Friday, the Court of Appeal overturned the findings on the 2017 agreement, saying it was a sham document and therefore Ms Jiang did not have to pay back the $1.12 million.

However, it upheld the other rulings by the High Court.

The Court of Appeal held that the duo had intended for the 2017 agreement to be used to give an impression to third parties that the money was being loaned to Ms Jiang, even though there was no such loan.

It noted that the agreement said the money was for Ms Jiang to buy a property at 9 Hillcrest Road near Bukit Timah Road. The property was not purchased in the end.
But the $2 million included sums that Mr Toh, represented by lawyers Anthony Lee and Wang Liansheng, had given her for unrelated expenses before the agreement was signed.

"There was no good reason to recharacterise them as loans for the purpose of purchasing 9 Hillcrest Road, as that was obviously false," said the court.

It also said the introduction of the 2017 document as a formal commercial agreement appeared "incongruent", in the light of the earlier monetary gifts and their romantic relationship.

The Court of Appeal also noted that Mr Toh had referred to Ms Jiang as his "wife" as far back as Jan 1, 2017. They had also referred to 9 Hillcrest Road as their "home" in various WeChat messages to each other.

This further supported the claim by Ms Jiang, who is represented by lawyers Mahesh Rai and Stephania Wong, that the money was not intended as a loan.

The three appeal judges disagreed with the High Court's view that two provisions in the Evidence Act applied when considering Ms Jiang's allegation that the agreement was a sham.

The provisions - which deal with proof of the terms of a contract - did not apply as her claim was concerned with whether a contract existed in the first place, the court said.

SINGAPORE - Speaker of Parliament Tan Chuan-Jin and Tampines GRC MP Cheng Li Hui have resigned over an extramarital affair, in the latest incident to rock the ruling People’s Action Party (PAP).
Making the announcement in a statement on Monday, Prime Minister Lee Hsien Loong said their resignations are necessary to maintain the high standards of propriety and personal conduct that the PAP has upheld all these years.
At a press conference later, PM Lee said he had learnt about the “inappropriate relationship” between Mr Tan and Ms Cheng some time after the 2020 General Election, and counselled both of them – most recently in February 2023.
But he came across recent information that “strongly suggested that the relationship had continued”.
On July 10, a video in which Mr Tan was heard muttering “****ing populist” on the microphone during the first day of debate on the President’s Address on April 17, was uploaded onto social media platform Reddit while he was away.
PM Lee said he met Mr Tan after the Speaker returned from leave.
“During our discussion, he agreed to leave immediately – both for his unparliamentary conduct as well as his inappropriate relationship with Ms Cheng, which he had told me he would break off, but he did not,” he added.

Mr Tan and Ms Cheng’s resignations come on the heels of the arrest and release on bail of Transport Minister S. Iswaran last week. The corruption probe involving Mr Iswaran is ongoing.
In his letter to PM Lee, Mr Tan said that he was resigning from the party, as Speaker and an MP for Marine Parade GRC, with immediate effect.
He said he had made a mistake in Parliament when he uttered words that were “rude and unparliamentary” in nature, adding that he had apologised publicly and to Workers’ Party MP Jamus Lim for it.

Mr Tan said the hot mic episode had added to the hurt he caused his family.
“I have let them down. We have spoken about my personal conduct before. There are areas where I have fallen short,” said Mr Tan. “I need to take responsibility for them, and help heal my family.”
He added that he had discussed the matter with his wife and agreed he must step away from politics and devote himself to his family.
Responding in a letter, PM Lee said he appreciated Mr Tan’s admission that he had fallen short in his personal conduct. He said he understood Mr Tan’s desire to “step away from politics and help heal your family”.

During the press conference, PM Lee said Mr Tan had offered to resign in February. He accepted the resignation, but had to first ensure that Mr Tan’s residents in the Kembangan-Chai Chee ward of Marine Parade GRC continued to be taken care of.
However, when he learnt that the affair had continued, he decided “Mr Tan had to go forthwith, whether or not the arrangements were ready”. “It could not wait any longer.”
Minister for Culture, Community and Youth Edwin Tong will take care of Mr Tan’s ward, PM Lee said, adding that he would nominate a new Speaker when Parliament sits on Aug 1, and make a ministerial statement.

In her resignation letter, Ms Cheng said: “I am very sorry to be resigning in these circumstances, and would like to apologise to the party, as well as to my residents and volunteers.”
Minister for Social and Family Development Masagos Zulkifli will stand in for Ms Cheng in Tampines East.
PM Lee said: “It is painful to do this to our friends and comrades-in-arms, and it can also be politically embarrassing and costly. But the PAP has to maintain party discipline and standard of conduct. Our duty is to Parliament and the people of Singapore, and that is paramount.
“It is simply inappropriate to have the Speaker having a relationship with one of the MPs. It is not appropriate; it is not acceptable.”


In his letter, Mr Tan said the hot mic incident – which came to light after the video titled “SG Speaker of Parliament Tan Chuan-Jin insults Jamus Lim: ‘****ing Populist’” was uploaded to Reddit – had raised broader questions over his neutrality and impartiality as Speaker.
Mr Tan had been reacting to a speech by Associate Professor Lim on doing more to help lower-income Singaporeans.
“Deservedly, there has been much disquiet over my remarks. Many felt that I was not impartial,” wrote Mr Tan.

He added that others also felt it was “conduct unbecoming” of a Speaker of Parliament, and some have called for his resignation.
When such mistakes happen, Mr Tan said, all MPs, himself included, will have to apologise and withdraw their comments.
However, as the Speaker, he “should have known better” and held himself to a higher standard, he said, adding that the credibility of Parliament and the chair is critical and cannot be compromised.


Mr Tan was elected as an MP for Marine Parade GRC in 2011, and became the 10th Speaker of Parliament on Sept 11, 2017. He was previously minister for social and family development and minister for manpower.
Ms Cheng made her political debut in the 2015 General Election in Tampines GRC.
