SINGAPORE - A businessman's four-year court battle to get back $2 million from his former mistress has ended in defeat.

Mr Toh Eng Tiah will no longer be able to recover any money from Ms Angelina Jiang, who is 25 years his junior, following a decision by the Court of Appeal last Friday.
Instead, he will have to pay her $45,000.

It brings to a close a court saga that began in 2017 when the married businessman sued his former mistress, claiming the $2 million he had transferred her through a series of payments during their relationship consisted of loans.

Mr Toh, who has three grown-up children from a previous marriage, met Ms Jiang in November 2016 when he was 55 and she was 30.

They began a romantic relationship the following month but by May 2017 they had grown apart.

He later sued Ms Jiang at the High Court to try to get back the $2 million.

Mr Toh, whom the Straits Times understands is a director and shareholder of several companies including a recycling firm, relied on a loan agreement signed in March 2017 as evidence to support his claim.

But Ms Jiang said the sums she received were gifts instead.

She claimed that the 2017 agreement, signed by them both, was a sham document to placate Mr Toh's wife, improve his standing among his family and friends, and obtain a loan from one of his companies.

Last year, the High Court held that about $680,000 of the $2 million sought was transferred to Ms Jiang as gifts and not recoverable by Mr Toh.

It ruled that he should be repaid $1.12 million once such a sum became due under the loan agreement.

The court said the businessman also had to separately pay Ms Jiang $45,000 that he owed her.

Both Mr Toh and Ms Jiang appealed against the decision.

On Friday, the Court of Appeal overturned the findings on the 2017 agreement, saying it was a sham document and therefore Ms Jiang did not have to pay back the $1.12 million.

However, it upheld the other rulings by the High Court.

The Court of Appeal held that the duo had intended for the 2017 agreement to be used to give an impression to third parties that the money was being loaned to Ms Jiang, even though there was no such loan.

It noted that the agreement said the money was for Ms Jiang to buy a property at 9 Hillcrest Road near Bukit Timah Road. The property was not purchased in the end.
But the $2 million included sums that Mr Toh, represented by lawyers Anthony Lee and Wang Liansheng, had given her for unrelated expenses before the agreement was signed.

"There was no good reason to recharacterise them as loans for the purpose of purchasing 9 Hillcrest Road, as that was obviously false," said the court.

It also said the introduction of the 2017 document as a formal commercial agreement appeared "incongruent", in the light of the earlier monetary gifts and their romantic relationship.

The Court of Appeal also noted that Mr Toh had referred to Ms Jiang as his "wife" as far back as Jan 1, 2017. They had also referred to 9 Hillcrest Road as their "home" in various WeChat messages to each other.

This further supported the claim by Ms Jiang, who is represented by lawyers Mahesh Rai and Stephania Wong, that the money was not intended as a loan.

The three appeal judges disagreed with the High Court's view that two provisions in the Evidence Act applied when considering Ms Jiang's allegation that the agreement was a sham.

The provisions - which deal with proof of the terms of a contract - did not apply as her claim was concerned with whether a contract existed in the first place, the court said.

SINGAPORE - A married businessman took a beauty contestant as his mistress for almost two years and showered her with gifts including a luxury car, but when she found herself a younger lover, he flew into a rage.

According to court documents, Lim Hong Liang, 55, twice ordered his mistress' lover to be attacked.

Over the two attacks, Mr Joshua Koh Kian Yong suffered several injuries including fractures to his nose and lacerations to his face.

A scar on the now 35-year-old's mouth is likely to remain a permanent feature.

On Tuesday (April 2), District Judge Chay Yuen Fatt found Lim, the owner of SNL Logistics, guilty of taking part in a seven-person conspiracy to cause grievous hurt to Mr Koh by using a weapon.

The judge also found a middleman linked to the attack - mover Ong Hock Chye, 48 - guilty of the same offence. The pair were convicted after a 10-day trial.

Lim was smitten with Ms Audrey Chen Ying Fang, 27, after they met in 2014. Although he was married with three children, the pair became involved in an intimate relationship.
Ron Lim De Mai, 26, was jailed for three years, with four strokes of the cane, on March 21, 2018.


He gave her a job at his logistics firm. As an administrative executive, she was paid about $2,000 a month but the court heard that she did not have to turn up for work.
The car he gave her - a white Mercedes Benz - carried the plate "1991", her birth year.

She used his credit cards and paid for her needs with it.

Lim even allowed her to live rent-free in a unit he owned at The Parc condominium in West Coast Walk, renovating it to her preferred "Hello Kitty" theme.

But he set her a condition - she was his and only his.

In their submissions, Deputy Public Prosecutors Tan Wen Hsien and Stephanie Koh said: "In return, Lim expected her to be faithful to him, and not to 'fool around outside'."

But she did. In March 2016, Ms Chen started dating Mr Koh, a banquet waiter, and announced their relationship on social media.

When Lim discovered Ms Chen, who was crowned Miss Mermaid 2016, was seeing Mr Koh and taking him to the apartment, he paid $5,000 to hitmen to scar Mr Koh's face.

About a month after they started dating, Lim's older son and Lim's nephew Ron Lim De Mai, 26, turned up at The Parc condominium.

The first attack took place on April 8. The two men barged into the apartment Ms Chen and Mr Koh were in and Ron Lim attacked him relentlessly, punching and kicking him for about 15 minutes.

As he lay there injured, they took photos of Mr Koh with their phones.

At Ng Teng Fong General Hospital, Mr Koh was found to have fractures to his nose.

After the attack, Lim, who was then in China for a kidney transplant, sent Ms Chen voice messages in Mandarin. He accused her of bringing a man to the apartment while he was overseas.

But the young lovers were not deterred and continued seeing each other. However, they were found out again.

On April 30 at 1am, while the two were having supper at Huay Kwang Thai Kitchen in Townshend Road near Little India, Mr Koh was ambushed.

He was punched in the head and as he tried to run, he was slashed with a penknife on his arm and face.

Ms Chen testified that she saw a gaping wound on Mr Koh's mouth. Although he was treated at Tan Tock Seng Hospital, that scar is now likely to be permanent.
The DPPs said: "The disfiguring wound would be a poignant reminder to the victim to stay away from (Lim's) mistress."

According to court documents, Lim wanted his nephew to "teach Joshua a lesson" and it was Ron Lim who roped in Ong to recruit others to carry out the task.
The DPPs stated: "At Ong's suggestion, the plan evolved into slashing Joshua's face, which Lim agreed to.

"At all stages, Lim and Ong were actively aware of the manner and extent of the eventual attack on Joshua."

The slasher - Nur Muhammad Irwan Mohd Ngat, 30 - was dealt with earlier in court along with the other attackers, which included former technician Mohammad Amin Aman, 47; Juhari Ab Karim, 34; and Ron Lim.

They were each sentenced to between 15 months and 14½ years' jail.

Of these four men, only Juhari, who had punched Mr Koh but did not slash him, was spared the cane.

Irwan, who was also found guilty of drug trafficking, received the harshest sentence which also included 16 strokes of the cane.

His then fiancee - Nur Atika Fauziana Sherhan, 22 - who was also involved in the second attack, was sentenced earlier to reformative training.

On Tuesday, the businessman was offered bail of $10,000 while Ong's bail was set at $20,000. They are slated to be sentenced on May 17.

Offenders convicted of causing grievous hurt with a weapon can be jailed for life or jailed for up to 15 years with a fine or caning.

Lim cannot be caned as he is over 50 years old.

The High Court threw out a Singaporean businessman's bid to recover "love gifts" allegedly worth $500,000 from his China-born mistress after their two-year affair soured.

The court found Mr Kua Tee Beng, 67, could not back his claim that he had been pressured to give her lavish gifts including a $40,000 cheque and $295,000 to help buy a condominium unit.

"(Mr Kua)'s evidence that the defendant threatened to tell his current wife about their relationship does not sit comfortably with (his) own behaviour over the course of the parties' two-year relationship," said Judicial Commissioner George Wei. "Given that (Mr Kua) is an independent and successful businessman, I find it hard to believe that he would so easily succumb to the pressure he alleges," he said in judgment grounds released yesterday.

Mr Kua had sued for the return of three Rolex watches worth $50,000 in total, jewellery valued at $30,000 and monthly allowances amounting to $85,000 allegedly given over two years from June 2011 to hairdressing salon owner Ye Caiyan, 41.

He also sought the return of $295,000 he had put down for an $808,000 three-room apartment in Hong San Walk in Choa Chu Kang registered in her name.

Madam Ye, a Fujian native who is now a Singapore citizen, has three school-going children with her Singaporean husband, from whom she is legally separated.

Mr Kua is twice married and has three children, aged between 38 and 44, with his first wife.

He first met Madam Ye in August 2010 through her nephew, a mechanic at his workshop. Some seven months later, they became involved and he started giving her expensive items and money.

Both gave "wildly conflicting" versions of why the relationship ended in 2013, noted the judge.

Mr Kua's lawyer Subbiah Pillai argued she had exerted undue influence to make him give her the various items and that the condo was actually being held by her in trust for him so his children could not fight over it.

But Madam Ye's lawyer Ramalingam Kasi countered the items, given in the "context of a loving and sexually intimate relationship" were non-returnable as they were "voluntarily given".

The judge found Mr Kua did not offer a "single shred of evidence" to show he gave her the jewellery or three Rolex watches, instead of only one Rolex.

Nor could Mr Kua prove he had been threatened by Madam Ye into supporting her for over two years, paying maintenance monthly and holiday bills for her and her children.

Mr Kua claimed that Madam Ye went to his motor workshop office frequently to badger and "create a scene" for payments but no witness was called to support this claim, noted the judge, who was also not convinced Mr Kua wanted to buy the property for himself given his "lack of involvement" in the purchase, among other things.

"I do not find it extraordinary or implausible that (Mr Kua) intended to benefit (Madam Ye) with the entire $295,000. This is perfectly understandable given that the parties were in an intimate relationship at that point."
