At law, the one who strikes first is in aggression unless mitigated by provocation and the one who strikes back is in retaliation unless mitigated by self-defence. All onlooking sinners don't and needn't cast the stones at the one found guilty. The court casts the stones.

Subhas Anandan (b. 1947, Kerala, India - ) is a prominent criminal defence lawyer in Singapore. He has appeared in numerous high-profile cases, including that of “one-eyed dragon” Tan Chor Jin and the kidney transplant case involving retail tycoon Tang Wee Sung. He is now a senior consultant in law firm KhattarWong and heads its criminal law department. He is a founding member and the first president of the Association of Criminal Lawyers of Singapore (ACLS). He is also the president of Cuesports Singapore, the national sports association for billiards, snooker and pool.



Early Life
Born to a Malayalee family, Anandan is the second of five children. When he was five months old, the family migrated from India to Singapore, where his father had found work as a clerk in the British Royal Navy. They lived in the staff quarters within the British naval base in Sembawang until his father retired in the early 1970s.

Anandan attended primary and secondary school in the naval base, first at Admiralty Asian School and then Naval Base School. Except for his first two years in secondary school, he was a good student who excelled academically and in sports, including cricket and football. In 1963, after achieving a first grade in his ‘O’ level examinations, he left for India to study medicine at Loyola College in Madras (now Chennai) to please his mother. But after the first few lessons, he was convinced that he was not meant to be a doctor. He returned home after three months and started his pre-university education at Raffles Institution in 1964.

After completing his ‘A’ level examinations, he wanted to join the police force but eventually enrolled in the University of Singapore at the insistence of his father. While pursuing a degree in law, he participated in various extra-curricular activities, including playing on the university’s football team and serving as secretary-general of the Socialists’ Club. He obtained his law degree in 1970 and went on to do his pupilage at Shook Lin & Bok under Chan Sek Keong, then a senior partner at the firm and currently the chief justice of Singapore.



Career
Shortly after he was called to the Bar in 1971, Anandan started his own practice, sharing the premises of a law firm run by his friend M. P. D. Nair, a former legislative assemblyman. However he suffered a major setback in 1976 - he was arrested for alleged involvement in a secret society and sent to prison without trial. He was released nine months later on a police supervision order, which required him to stay indoors between 7 pm and 6 am daily and report to the police every Saturday. He returned to his law practice with a vengeance after the incident and merged his firm with Nair’s to form M. P. D. Nair & Co. In 1987, he found himself in another potentially damaging situation - he was charged with gross professional misconduct for allegedly acting as a political aide to his client, opposition politician J. B. Jeyaretnam. Fortunately, he was cleared of the charge. Following Nair's death in 1989, he became the managing partner of M. P. D. Nair & Co.

In 2000, Anandan closed the firm and joined Harry Elias Partnership as a consultant to help build up its criminal practice. In recognition of his achievements, the Law Society of Singapore honoured him with the Legal Eagle Award of 2001. Going beyond defending clients, he helped to set up ACLS in 2004 to contribute to the development of criminal law and promote the interests of criminal lawyers in Singapore. In 2007, he joined KhattarWong and, having proven his prowess in the criminal arena, expressed his interest in taking on more civil cases in addition to heading the firm’s criminal practice.

Still, it is no secret that criminal law is Anandan’s passion. He had started his practice handling mainly civil, accident and family cases but soon began gravitating towards criminal law. To date, he has handled over 1,500 criminal cases involving a wide range of crimes, including murder, rape, maid abuse, drug trafficking and white-collar offences. Known for his sharp and stinging attacks in the courtroom, he is nicknamed “the basher” within the legal community. His piercing eyes, bushy hair and thick beard also give him an intimidating presence (though he has been described as jovial, affable and even soft-spoken outside the courtroom). As one of Singapore’s top criminal defence lawyers, he has appeared so frequently in the media that some people have called him a publicity hound.

While he is critical of some aspects of the criminal justice system in Singapore, he believes that the system must be followed. Subscribing to the tenet that everyone deserves a proper defence regardless of the crime, he never rejects cases because of what the person has been charged with. This is why he has defended clients accused of the most horrifying crimes despite the condemnation and occasional death threats that he receives.



His most infamous convicted clients include:

•Abdul Nasir Amer Hamsah - caused the death of a Japanese tourist in her room at Oriental Hotel while trying to rob her, and then attempted to escape from the police lock-up by taking an officer hostage;
•Constance Chee - caused four-year-old Sindee Neo, daughter of her former lover, to fall to her death;
•Took Leng How - killed eight-year-old girl Huang Na;
•“Kallang body parts murderer” Leong Siew Chor - killed and dismembered his lover Liu Hong Mei;
•Anthony Ler - planned his wife’s murder and coached a 15-year-old boy to commit the deed; and
•“One-eyed dragon” Tan Chor Jin - shot a nightclub owner several times thus killing him.




Personal Life

Anandan has a penchant for big-capacity cars that stems from his secondary school days, when he saw other students driving or being driven around in fancy cars like Mercedes Benzes and Jaguars. Besides owning luxury cars, he likes collecting antique or miniature swords, sabres and Malay krises. He often goes to the Singapore Cricket Club to play snooker, which helps him relax when he is working on a case. He also spends a lot of time at the Holy Tree Sri Balasubramaniar Temple, where he is currently serving as chairman of its board of trustees.

Formerly an active sportsman, he now takes 15 to 16 types of medication every day because of his poor health. He has had three heart attacks and undergone a heart bypass and an angioplasty. He has lost one kidney to cancer and is diabetic.



Family
Wife: Vimala Kesavan, whom he calls Vimi. She worked with him in M. P. D. Nair & Co and was the late Nair’s sister-in-law.
Children: One son, Sujesh.
Parents: Father R. Anandan and mother Govindan Pushpanjaly, both deceased.
Sisters: Subhashini and Sugadha.
Brothers: Sudheesan and the late Surash, who was one of the crew members that perished when the Singapore Airlines flight SQ006 crashed in Taiwan on 31 October 2000. Surash was also a well-known national footballer in the 1970s.

LAWYER M. Ravi was ordered by a judge to be admitted to the Institute of Mental Health (IMH) yesterday for psychiatric evaluation.
District Judge Carol Ling made the remand order at the second request of the prosecution who, last Friday, had argued the case for sending him to IMH.

Ravi, 39, faces two charges of disturbing a religious prayer session at a mosque in Chinatown earlier this month and for harassment. When he was charged on Aug 11, the prosecution had also asked for him to be sent to IMH but Ravi's lawyer Chia Ti Lik managed to argue against it.

Judge Ling had adjourned the case on Friday and delivered her decision yesterday, instructing that the case be brought up again in a fortnight's time.

Mr Chia said yesterday that Ravi had discharged him from the case.

The police had issued a statement after arresting Ravi, saying it was not the first time that they had received public complaints about his behaviour.

He had been known 'to have behaved violently and abusively at places of worship, shops, the Subordinate Courts, and other public places'. Several years ago, Ravi made headlines for being rude to a district judge, which led him to be suspended from practice for a year in 2006.

The disturbance charge Ravi faces carries a maximum jail term of three years or a fine, or both, while the harassment charge could set him back by a fine of up to $2,000 if convicted.

The case is believed to be the first in recent times involving a lawyer facing criminal charges who has been ordered to undergo a psychiatric examination.

TV host refutes cabby's 'taxi rage' allegations

SINGAPORE - Television host Quan Yifeng (picture), who is embroiled in a "taxi rage" incident, has undergone a medical check-up on the advice of her lawyer, Mr Subhas Anandan.

Quan, 36, who was abroad, returned to Singapore yesterday morning.

When asked about her injuries, Quan, speaking to MediaCorp from the hospital while waiting to see a doctor, said: "I don't know. I have to wait for the doctor's report."

Quan, the zany host of Channel 8's New City Beat every Friday at 8.30pm, was filming in Mauritius, when reports of her altercation on Saturday with the cabby surfaced. She was due back on Friday but said a communication breakdown and the time difference could have led to the confusion over the timing of her return.

Taxi operator ComfortDelGro is supporting the taxi driver.

MediaCorp said in a statement that it would not comment on the case as it is under police investigation.

Taxi operators Smart Cab and Prime Taxi say they advise their drivers to be patient with customers to minimise conflict.

Mr Lim Chong Boo, managing director of Premier Taxis, said: "We have a walkie-talkie system - all a driver has to do is press a distress button and help will be sent."

A ComfortDelGro spokeswoman said its taxi drivers have also been told not to retaliate. The company's taxis also have a distress button.
Quan reportedly got into an argument with the cabby, known only as Mr Chan, after he allegedly refused to help her load her luggage into the boot.

She had boarded the taxi at a Nallur Road condominium and was going to the airport to catch a flight to Mauritius.

Mr Chan claimed that Quan had hit him, locked herself in the taxi, ripped out its meter and poured water on his belongings. He also alleged that Quan took the keys to his taxi and left in another taxi.

Quan has refuted the allegations and claimed that the driver swung the taxi door on her, hitting her on the back and leg.

Quan Yifeng tight-lipped upon return

The fiesty TV host was unusually subdued when she arrived at Changi Airport on Wednesday morning. Appearing mild-tempered and impassive, Quan hopped quickly into a white Lexus car driven by fellow host Dasmond Koh upon arrival.

Looks like the beleaguered star will be avoiding taxis for awhile.

When asked if the bruises on her back and legs from Mr Tan swinging the taxi car door at her still hurt, she merely cracked a wry smile and nodded silently, The New Paper reports.

On her plans to take legal action against Mr Tan, the usually verbose host simply told the paper, “I’ll go and see my lawyer… I haven’t decided what to do.”

Quan appeared surprised when asked to comment about reports of her temperamental nature.

“Really? I’ll read the reports first and comment later,” she replied, before getting into the car.

Top criminal lawyer, Mr Subhas Ananadan, who will be representing Quan, confirms their meeting on Wednesday morning.

“The meeting did not last long as they were both tired. I told Quan to go home and rest, and we will meet again tomorrow (Thursday),” Mr Anandan said.

“I also told her to cooperate with the police who is investigating (the matter). After the investigation, we’ll know who’s the real culprit and who’s the real victim,” he added.

He believes that Quan will meet the police in one or two days to assist in investigations.

ComfortDelGro is backing the taxi driver involved in the incident. The company has described Mediacorp artiste Quan Yifeng’s incident with one of its taxi drivers as an ‘act of aggression’.

The land transport giant is supportive of the taxi driver accusing Quan Yifeng of thrashing his taxi, according to a Shin Min Daily report.

A spokesperson confirmed the cabby’s claims, saying that he was beaten up and the taxi was damaged. The taxi’s trip meter was ripped out as well.

The company is currently assisting police with investigations and is providing assistance to the driver who has been ‘badly affected’ by the incident.

The embattled star has reportedly hired criminal lawyer Subhas Anandan to represent her.

Quan Yifeng, a popular local TV host, made headlines again on Monday - but for all the wrong reasons.

The bubbly Taiwan-born celeb, 36, who is well-known for her quick temper and sharp tongue, was accused of hitting a cab driver, thrashing his taxi and stealing his car keys.

The Mediacorp star was on her way to the airport with a male friend and her 11-year-old daughter, Eleanor, when the spat occurred.

According to a Lianhe Wanbao report, the incident began when the 52-year-old cabby, only known as Mr Tan, failed to help the host with her luggage. Quan reportedly flew into a rage and demanded, “What sort of service attitude is this?”.

The driver claims that he did not help the star because he was recovering from an elbow injury.

Driving away from Hua Xin Court Condominium where he picked the trio up, he asked for directions to the airport, to which Quan allegedly snapped, “Are you from Malaysia? Don’t you know the way to the airport?”

Tensions reportedly reached boiling point when the driver braked hard at a junction and the star was thrown forward. The cabby said that Quan accused him of doing it on purpose and swore at him in Hokkien. She then insulted his mother and proceeded to shove and hit him, he told the paper.

Mr Tan claims that when he stopped the taxi, the TV host alighted and kicked his groin and a car door. She even locked herself in the taxi for 15 minutes to destroy it, ripped the meter and stereo out, emptied a bottle of water on his things and spilled his change everywhere, he said.

Police have classified this case as theft because Quan left the scene with the driver’s car keys, the report said.

The vivacious TV host, however, denied the allegations.

“Why would I take his keys? Do you think I’m mad?” she said in an interview from Mauritius where she was filming.

She also explained that she could not have spent 15 minutes thrashing the taxi as she was the one who called the police and had to leave to catch the plane to before they arrived.

“I called the police at 8.45am and arrived at the airport at 9.02am. The entire incident was five minutes, how could I have locked myself in his car for 15 minutes?”

According to Quan, the taxi driver was rude and had not only refused to help her with her baggage but also said, “Which law in Singapore says I have to help with the baggage?”

She adds that Mr Tan was the one who chased her out of the taxi after he braked abruptly at a junction when she complained about his driving. According to the star, he tried to stop her from retrieving her belongings.

”So I shoved him and kicked his car door,” she said.

Quan also accused the driver of shutting a door which she tried to open, hitting her on the back and leaving her with bruises. He also swore at her young daughter when she started to cry, she said.

According to the report, Quan is now seeking legal advice. In 1996, the star, who split from her ex-actor husband Peter Yu two years ago, was involved in a fight with a bowling alley attendant and was fined S$1,000.

With his word against hers in this dramatic case of he-said-she-said, it’s anyone’s guess whose version of events is true.
