An IT analyst who faced a rape charge after forcing himself on a woman he met after two dates had the offence reduced to one of aggravated outrage of modesty instead.
Ng Han Tong, 37, also known as Jimmy Ng, pleaded guilty and was sentenced to three years' jail and six strokes of the cane yesterday.
The Straits Times reported that he and the 31-year-old woman first met online in January 2010 before meeting in person in March.
Ng, who is married, went with the woman to a karaoke pub, and took a walk on a Sentosa beach, where they then kissed.
He tried to touch the woman inappropriately that night, but she resisted.
On their second date the next day, he suggested that they meet, and they ended up in a Chinatown hotel room after visiting a pub. The court was told that she agreed to go to the hotel upon his reassurance that they would only kiss.
However, Ng then tried to remove the woman's clothes, even though she tried to push him away. He also ignored her when she said she did not want to have sex with him.
The court was told that Ng tried to persuade her to perform various sex acts, but she resisted most of his suggestions.
He proceeded to have sex with her anyway, and did not use a condom.
The woman left the hotel in a taxi after that and reported him to the police for rape the next day.
In mitigation, Ng's lawyer R.S Wijaya said that Ng had been stressed and unhappy because he and his wife was unable to conceive at the time of the offence. Ng's wife, also an IT analyst, had forgiven him and expressed that she had no wish to divorce him in a letter to the court, as he was a 'caring and understanding husband'.
Ng's wife described him as a fillial son who was popular among his colleagues and lent his time to charitable causes for the elderly and needy families.
It was unclear why the rape charge was reduced to one of outrage of modesty. The maximum sentence for the latter offence is a jail term of between two and 10 years and caning.
