Intimidation at work, Legal Recourse?

Need some advice here, especially from bosses and subordinates who have gone through this situation:

(1.) A and B had a dispute at work. A reported incident to supervisor.

(2.) Supervisor chose to use his own approach by directly confronting B. B denied the wrong he has done.

(3.) Supervisor called A and told A "let's have a direct confrontation with B."

(4.) A does not agree with supervisor's approach (confronting one by one will only create lag time and have everybody creating wonderful lies and further accusations against each other. Moreover A and B see each other everyday) A send a sms saying he is not in for direct confrontation, and also told the supervisor he will go to the supervisor's boss should B repeat his nonsense.

(5.) Supervisor finds this sms as a threat and showed it to his colleagues and his boss. Supervisor says he is disappointed in A because he feels if A goes directly to report future incidents, it will make him look incompetent. His boss agrees with him and says the sms is a "potential" threat.

My issues:
(i) Does A have any legal recourse, e,g, sue his supervisor and his boss as they are now intimidating him not to go to higher authorities, that is to cover their own asses? Under what law or section can he sue for?

(ii.) Call log is in A's phone regarding (5.). If he decides to proceed with legal action, can he retrieve the call log? How much to retrieve call log from telcos?

(iii) Any other kind and useful advice is much appreciated.

(iv) If the person involve is reading this, sad to say, you have always been respected as a elder brother and a very fair person, but you are too stubborn for your own good, hence you are always using the wrong approach (always direct confrontation), and creating conflicts among your own team and also your own subordinates, and you are just digging your own grave. You peranakans have a very proud heritage, but if you would have watched Lord of the Rings, the show is just not about the elves. I hope you will change for the better, and also all that is ever done by the staff (esp calling you on your dayoff to keep you inform of work situation so that you have a clearer picture should the boss quiz you when you are back)is to help you look good and get your promotion, which we feel you deserve it.

Happens to most big org. nearly everyday usually the sup will seperate both of them and let them cool down after sometime they mellow down will go back to normal.
 
That is just a preview of how sinkie goes through their daily life. i am not surprise if there are more such nonsense.
 
Why don't A and B find ways to deal with the FT nuisance, better than fighting with each other

How did the supervisor get to know of the situation in the first place. Who spoke to him first - A or B?

A told sup first. B is an FT. B has since apologised to A. Issue is if A is made to write a statement regarding his sms, can he get a call log from the telcos and whether he can sue for intimidation...
 
Then A is in trouble. The sup has approached B to get his version as A has already given the sup given his version. This typically is the general approach. If A wanted to avoid such things as "lag time" to create " and "wonder lies" etc, he should have approached the Sup in the company of B to be fair both to A and B. The next thing if the versions differ is to bring the 2 parties together for a consensus on the incident. And so far, the sup is right.

Going over the sup to the boss without attempting to resolve it is tantamount to threathenining the sup. If the attempt to resolve as suggested by the Sup is not successful then escalation is justified. If I was the boss, I would have sacked A for subverting the authority of the supervisor. I can assure you that A will be treated as a pariah by the workforce for this unless the sup is an arsehole and unfair in his dealings with the rest. It does not matter if B is at fault in the face place. Court proceedings require complaints/plaintiff to face the culprit/defendent in the first place for this very basic rule of natural justice.

What is good for the goose must be good for the gander. Better look for a new job or the label of "hantu", "balls carrier" etc will follow thru in the workplace.

ps. for court proceedings, the lawyer of the client will know how to seek the call log. Better save money and learn to put oneself in the shoes of the sup, the boss and B.

Wah LAN eh... A needs to get a job on standby!
 
If I were the Manager, I would view it as the Sup is incompetent to resolve such a small issue that he has to resolve it with me.

I'd sack the sup and let A and B get on with their lives but with a warning that if things continue further, another will get the sack.

In one fell swoop all Sups get the message, I don't get bothered, A and B get on together. Problem solved, Sinkie style.
