1) The legal cost of the plaintiff for which Roy did not offer an amount
2) The damages sought for the defamation for which $5K was considered derisory
3) The aggravated damages

Roy has admitted to the defamation and apologised. So 1 and 2 were pretty much up to the judge after hearing argument from both sides. Its No 3 that is contentious as he claims that those actions are protected by the constitution.
