Settling old score with MINDEF

i sympathise with you as alot of mindef doctors are just MO and not specialist. my pro bono advice is that settle outside court as legal fees if lose(high probablity as no garmen agnecies have lost before) would bankrupt you esp when you have to pay the otehr side experts opinion. my understanding is that alot of medical condition can be silent and although congenital , it need not mean it should manifests itself. like heart attack or stroke. No test in the world can predict it and you cannot sue for sudden heart attack or stroke.
the very fact that you pass pes B means you are fit and the hole in heart is not lethal or life threatening , they may argue. nowadays alot of cases (read today papers ST headline) gi to court and the only winner are the lawyers!!!!! even those NS who get into accident or collapsed suddenly and kaput, only a few thousands in compensation. mindef generals are all really good "taichi" masters. you know what i mean

2 un-named NSFs were killed when their FH-2000 155mm heavy artillery gun blew up in New Zealand because of a defective Made in China fuze. One NSF was killed in Singapore after an unexploded warhead from a misfired Armbrust light anti-tank weapon picked up by infantrymen blew up. Five others were injured, including a Lieutenant who lost his arm.

The SAF’s deadliest accident took place on Jan 24, 1987, when six lives were lost in a helicopter crash. Staff Sergeant Goh Kim Loong, Corporal Ramiya Mohan, Lieutenants Ng Soon Hup, Siow Poh Guan and Wee Tong Leong and Captain Lakbir Singh died after an air force UH-1H Huey crashed 14 nautical miles south-east of Brunei International Airport.

All NS deaths prior to 1997 are largely unreported from the PAP Government, SAF and state-controlled media.

Three SAF soldiers died over a span of 10 days. Recruit Sim Keat Kee, 19, collapsed after a 2km run. Lieutenant Koh Meah Wan, 23, was killed during an exercise at Sungei Gedong. And Recruit Bak Yow Hock, 17, died at the School of Naval Training.

First reported training death in October 1968. In that incident, Recruit Allen Tan Chong Huat, 19, was stung by hornets in the Chua Chu Kang forest. He was rushed to Taman Jurong Camp but there was no doctor on duty there ( military doctors then clocked an 8am to 5pm shift). What’s more, the garrison’s ambulance was out on another call. So Recruit Tan’s officers rushed him to the main road to flag down a passing vehicle. It took an hour to get him to hospital.

there was a case of a real bright scholar serving on a warship. He was knocked overboard and crushed against the side of a ship due to lousy piloting by the PTE/CPL steering. All of his friends attended his funeral. Due to his dday being a big shot, second son was not exempt from NS but made to serve as clerk or in air con unit.

1997 [Source]
2 un-named NSFs were killed when their FH-2000 155mm heavy artillery gun blew up in New Zealand because of a defective Made in China fuze. One NSF was killed in Singapore after an unexploded warhead from a misfired Armbrust light anti-tank weapon picked up by infantrymen blew up. Five others were injured, including a Lieutenant who lost his arm.


Jan 1987 [Source]
The SAF’s deadliest accident took place on Jan 24, 1987, when six lives were lost in a helicopter crash. Staff Sergeant Goh Kim Loong, Corporal Ramiya Mohan, Lieutenants Ng Soon Hup, Siow Poh Guan and Wee Tong Leong and Captain Lakbir Singh died after an air force UH-1H Huey crashed 14 nautical miles south-east of Brunei International Airport.

All NS deaths prior to 1997 are largely unreported from the PAP Government, SAF and state-controlled media.

Three SAF soldiers died over a span of 10 days. Recruit Sim Keat Kee, 19, collapsed after a 2km run. Lieutenant Koh Meah Wan, 23, was killed during an exercise at Sungei Gedong. And Recruit Bak Yow Hock, 17, died at the School of Naval Training.

First reported training death in October 1968. In that incident, Recruit Allen Tan Chong Huat, 19, was stung by hornets in the Chua Chu Kang forest. He was rushed to Taman Jurong Camp but there was no doctor on duty there ( military doctors then clocked an 8am to 5pm shift). What’s more, the garrison’s ambulance was out on another call. So Recruit Tan’s officers rushed him to the main road to flag down a passing vehicle. It took an hour to get him to hospital.

2. Law is about proof beyond reasonable doubt.

3. Proof beyond reasonable doubt that there is possibility of death from physical stress that cause the heart to fail or malfunction. Not necessary death but neart death.

4. Proof that the medical facilities in Mindef is inadequate to preform their duty of care and due diligence for enrollment of conscripted NS to check for hear problem.

5. Proof that someone, a medical officer or medical institutions, has had warned Mindef of such type of conditions which Mindef turn a deaf ear on.

6. If the above cannot work, take down your pant, spread your legs wide open, bend down and see the tiny dot between your buttock, then kiss that little ass of yours goodbye.



Any lawyer or law student here that can advise me my chance of winning if I were to sue MINDEF for negligence.

Case 1
Not too long ago, I was diagnosed to have hole in the heart. My heart consultant confirmed that it is a born defect. He was astonished that I was enlisted for Pes B National Service, and said that he can write me a discharge letter if I were to call for reservist. I told him I had already completed my cycle of NS. I then ask him if I intend to sue MINDEF for negligence, is he able to be the witness. He said he can provide my diagnose report.

Case 2
I had severe back pain and after some detailed MRI, specialist asked me if I had carry very heavy object. I never do any weight lifting in my life. Also I did not do any manual labour work in my career. The heaviest object I ever carried was being forced to caservack my buddy during NS. I was then 58-60kg, buddy was fatty 90-100kg type. After the exercise I started to have back pain and it only get more serious today.

I am more confident on Case1. Case 2 is hard to prove since it happened long ago.
Case 1 is clearly a negligence by MINDEF during the pre enlistment checkup, even though it happened long ago. MINDEF could defend that I am still in 1 piece and alive, but the firmed thing is they were negligent, and I could have lost my life during SOC and IPPT.

I would like to seek for compensation, preferably in monetary form as I am in need of money . I will engage lawyer if chance of winning is medium to high . Any serious advice is appreciated.

So my lao cheow friend was right when he tipped me with his lao peng anti-dote formula to siam peng and IPPT: take 1/2 Panadol with a can of coke half hour before see MO and high blood pressure shoot >200 scare the MO to death.... then forever no more IPPT.

My risk paid off worth taking than to die sudden collapse in IPPT. Run IPPT can die and take the anti-dote IPPT also can die, guess the latter paid off ..... hehehe.



Along the way, help to also seek for the grievances of the below deaths during national service and reservist

ic..everyone told me the justice will protect garmen. But we are unsure if there is such thing as having a foreign court to fight with sinkieland garmen on such national issue.
 
what you can do is class action where more than 1 can share the legal cost.

They dun even acknowledge receipt of your registered letter!

Your only chance is to convince Medical Board and/or work with Director of Manpower who can move things at staff level............
