A taxi driver who endured a six-month lawsuit after overcharging a passenger by 50 Hong Kong cents (6 US cents) has finally had his name cleared by a Hong Kong court

ONG KONG: A taxi driver who endured a six-month lawsuit after overcharging a passenger by 50 Hong Kong cents (6 US cents) has finally had his name cleared by a Hong Kong court.

Tam Hoi-Chi walked free after his case was thrown out Thursday but was left questioning the city's justice system.

"I want to know why the opposite side, for the reason of this small amount, would want to sue me," Tam, 57, told reporters outside the court afterwards.

"It's really not just. Why did I have to waste so much time? I have to make a living," he said.

He stood accused of "taxi overcharge" according to the Hong Kong judiciary's website. The case was brought to court even though rounding up to the nearest dollar is a common practice amongst the city's taxi drivers.

Tam had overcharged a female passenger HK$0.50 on a HK$136.5 fare, local newspaper South China Morning Post reported.

She had handed over HK$200 at the end of the journey last October and received HK$63 in change, but did not immediately ask for the 50 cents. She later made a complaint to the police, the Post said.

Prosecutors offered no evidence to the court after they reviewed the case and witness statements, according to the newspaper.

"Given the trivial nature...it was considered not appropriate to proceed with it," the city's Department of Justice told the Post, saying that it had not been consulted before the charge was laid.

"This wastes Hong Kong people's money, and it wastes government money, and wastes time," Hong Kong Taxi and Public Light Bus Association chairman Wong Chung-keung told AFP, adding that he's never seen this happen to his drivers before.

It was not immediately clear how much the case had cost the Hong Kong taxpayer.

Taxi drivers have recently been in the firing line for overcharging and cheating tourists and have received fines, community service and bans on taxi driving as punishment.

if you have money, and are prepared to spend, then its very easy to go to a lawyer, prepare a letter and start the process of suing someone... whether or not you have the right grounds for suing is irrelevant.

all you need is money and a lawyer (not even if you know how to do the process yourself) to start a string of what may be very costly events for both sides


and nothing to stop you from suing again and again as long as your pockets are deep or as long as you have access to someone elses deep pockets

The cab rider may well be a Sinkie, complaining to police over a miserable 50 cents.

This reminds me of an incident a few years ago, which was reported in many HK Chinese newspapers. A HK actor got into a fight with a bread shop assistant. His wife went into the shop in Sai Kung and started to test for freshly baked bread by using her fingers to poke at various samples. Very inconsiderate behaviour. The bread shop assistant confronted her and told her to stop, but she picked up a quarrel with him instead. The HK actor walked into the shop, don't know head or tail but naturally supported his wife as part of his "manly duties" and ended up punching the assistant. Splashed all over the Chinese press, HK actor had to apologise to the public profusely and lie low for a long while.

While reading the article, when I got to the part about the wife poking her fingers into samples to test for freshness of the bread, I immediately thought - "this woman must be a Sinkie!". True enough, a few lines down, it was revealed that the HK actor's wife was a Sinkie.

Anyway, as for this taxi driver incident, it shows that the HK police are over-zealous. The complaint was made by the woman (maybe Sinkie), but the decision to prosecute was made by the police. I will rather have a police force that is a little bit over-zealous in protecting its citizens than one that is lazy. Heard that in Sinkieland, if someone assaulted you on the street, the police will not prosecute unless you had suffered grevious hurt! Oh My God, what sort of crap good-for-nothing police force is this!

I think you can't do that in singapore. If the amount sued is below certain threshold, the case must go for mediation or small claim tribunal first. This should help the small guys defeat rich bastards without employing lawyers

Alot of teochews in HK,,,as teochews are considered 'from Guandong'. They are the largest minority in HK but all integrated and speak canto. But in general hokkeins are the more stingy ones considered to teochews.
