Hi just wondering....

Can telco take any legal actions to recover the amount owed ? I have outstanding of about $2,000.

Can they file bankruptcy ? (I though only above $10,000 then can ?)

Can they come my house and paste auction stickers on my furnitures ?

Any bro here who had any legal experience with the telcos ? Pls share

1st question : Yes

2nd question : No (only $10k and above)

3rd question : Possible. They can sue u first and once they get the judgement from the court, they can enforce it with a writ of seizure and sale.

Tell the Telco that u willing to settle out standing bill for half price nicely. Most will be willing to settle because they will get nothing. After that U name will be black listed by the Telco.
If you have roaming they will not able to give discount all roaming call because Telco need to pay others party/country with full fee.

You obviously read the whole thing wrongly. This has to do with a client actually giving his own lawyer the authority to act. Nothing to do with the other lawyer or the other party. Its a common issue in insurance claims cases where the insurance company chooses the lawyer rather than the client. That is why the case law in your link refers to an insurance case. The other lawyer brought it up because he must have found out that the client on the other side had not signed the letter giving authority. Its a delaying tactic.

Think very carefully about this. Why do lawyers always represent both sides of the argument?

Example:

I owe you payment. This is a contract between the 2 of us only. Subsequently, you got so pissed off that you hired a lawyer to sue my pants off. Now, bearing in mind that the contract is between the 2 of us, how did your lawyer manage to butt in? He needs agreement from both sides.

If I did not deny that your lawyer has authority to butt in, by default I agreed that he has authority!

So your lawyer acts all gungho and starts to talk in court. I ask the judge about Order 64 Rule 7 and puts in a dispute of solicitor's authority to act. Game over for your lawyer, who now has to leave the court...

He can only represent your side and not mine. Remember, a lawyer must represent both sides!

Owe M1 about $800 five years ago till now, no letter no nothing until recently wanted to sign up for mobile service with them but got rejected, asked to settle the outstanding bills first before they can proceed.

quite impossible that they ignore your $800? Did you shift house during that time?

Why don't you pay the bill, since you appear able to and know that the bill is outstanding?
Why would you want to go back to them, knowing that your bill is outstanding and you are not paying it?

definitely can

they hv to sue first; amount is not the criterion

Can they come my house and paste auction stickers on my furnitures ?

after Court award them the win n after they file the necessary papers or summons which the Court must first approve
