China rejects treaty that defined Taiwan’s status, accidentally reviving Japan’s pre-1951 claim
The San Francisco Peace Treaty clearly states that Japan renounced Taiwan but did not transfer it to China or any other country.
This means Taiwan’s legal status was intentionally left “undetermined,” and Japan only gave up its claim without handing sovereignty to Beijing.
Because neither the PRC nor the ROC signed the treaty, neither government was assigned ownership of Taiwan through its terms.
That is why the United States and Japan have long held that the treaty does not award Taiwan to China.
Now China is declaring that same treaty “illegal and invalid,” claiming it was a US-made document used to divide countries after World War II.
But if the treaty is truly invalid, then Japan’s renunciation of Taiwan would also be invalidated.
Under China’s own logic, Taiwan would legally revert to its pre-1951 status, which places sovereignty back under Japan.
This is why Japanese social media is now laughing that China may have accidentally argued for Taiwan to be “returned” to Japan.
