What happens if the case is settled out of court? Does the US lawyer still get a third of the settlement?

Yes. As long as the client receives compensation, the lawyer gets one-third, whether in open court, in closed chamber or out of court. That's his contingency fee, in consideration for waiving his regular fee.

What do the lawyers lose if they lost the case? What do the lawyers win if they win the case?

It doesn't make any sense if 18 people can invest 154 million into minibonds and yet cannot afford a lawyer. Get the drift?
