Probation for man who got half-brothers, aged 8 and 10, to touch his genitals

SINGAPORE — A 20-year-old man who had his two young half-brothers touch his penis was given a year and nine months’ probation on Monday (16 August).
He had asked the elder of the two, 10, to touch his genitals after the boy lost at a Playstation game. The man also asked the eight-year-old brother to touch his genitals, despite being instructed by their mother to look after the young ones.
The man had earlier pleaded guilty to two charges of procuring an obscene act from a child.
All parties in this case cannot be named to protect the identity of the victims, who share a biological mother with the accused man. While the accused was born from the mother’s first marriage, the younger boys were born from her second marriage.
The second marriage also ended in divorce, with the parents of the two younger boys sharing custody. The boys would spend their weekends at their mother’s home, which was how they became familiar with the accused man.
Told mother of the incident
In August or September 2020, the accused visited his mother, 43, at her home and played a soccer game with the 10-year-old half brother on a gaming console in a room. The younger boy lost the game and was about to leave the room when the accused man grabbed his armThe man told the younger boy to touch his penis since he had lost the game. The man then lay on the bed and exposed his penis. The younger boy declined but was offered $5. He felt that his elder brother looked intimidating and agreed to do so.
The man instructed his brother on how to touch him over the next 10 minutes. The boy felt disgusted and scared. He refused to accept the man’s money and ran out of the room to inform his mother of the incident.
Undeterred, the man targeted the younger boy on 5 September last year, when he was again visiting his mother. His mother instructed him to look after his half brothers, promising to pass him some money afterwards.
While the man and his eight-year-old half brother were in a room, the man told the boy to touch his penis. The younger boy refused to initially, but agreed eventually at the man’s insistence.
After some time, the boy said he wanted to use the toilet and left the room. He told his mother, who was outside, that he was going to wash his hands as they were “dirty”, adding that he had touched the man’s genitals.
On 16 September 2020, the boys’ father lodged a police report, stating that his sons had been sexually assaulted. Court documents did not state how the offences came to light.
Other conditions
In addition to his probation term, the man will be required to follow a time curfew, perform 60 hours of community service, and and was placed on electronic monitoring for six months, or up to his national service enlistment. His father was placed on a $5,000 bond to ensure his good behaviour.He will be required to attend a court review on 14 February next year before the same judge.
For procuring an obscene act from a child, he could have been jailed up to seven years, and/or fined up to $10,000.
