In my honest opinion, for murder, yes.

The argument is that nobody is 100% sane or 100% insane anyway. If you take another person's life and it was not an accident or in self defense, you pay for it. Life is precious and sacred, but not THAT precious and sacred that you should get away with it.

That is nothing to do with being sane or insane.
That's infringement of individual freedom and rights if they cannot provide a logical or medical reason why they should do so, other than the reason that they want you to or it suits their objectives at the point in time.
