i do heard from a lawyer, she ever told me if take such case they will peng their stories and consider many other things. like did he die becos of the medical care (eg lack of blood etc), in another word can push to other factor they will aim in that direction.

Yes, it's their lawyer's job to cast doubt on intention to murder. For murder to stand, the prosecutor must prove both action and intention beyond reasonable doubt. Their action was clearly beyond argument. So cast doubt on the intention and the circumstances leading to the consequences, i.e. injury and death.
