There were 42 survivors from the accident two days ago and the total number of passengers on the boat is unclear, a customs statement said. Prime Minister Julia Gillard, who returned from leave after the incident, said police were questioning three Indonesian crew and it was unlikely more survivors would be found.

“There are three Indonesian crew members among the survivors and they are being interviewed by the Australian Federal Police,” Gillard told reporters in Sydney today. “It remains unclear exactly how many people were on the vessel and we may never know that number with precision.”

About 145 Australian customs, police and medical officers will today continue the search and salvage operation, the government said in a statement. An identification unit has been set up for the victims and there will be a coronor’s inquest.

A total of 353 people drowned in 2001 during a bid to reach Australia when the 19-meter Siev-X sank in waters south of Indonesia with only 44 survivors.

Christmas Island, about 1,600 miles (2,600 kilometers) northwest of Perth, houses a center for people claiming refugee status. Almost 6,400 asylum seekers from countries including Iraq and Sri Lanka have arrived by boat in Australia this year, up from 2,726 in 2009.

Announcing a criminal investigation into the disaster that claimed at least 28 lives, Prime Minister Julia Gillard confirmed the wooden boat was filled with Iranian, Iraqi and Kurdish passengers.

She said the investigation would be carried out under Australian people smuggling laws, which are far tougher than Indonesia's. This suggests that anybody arrested in Indonesia will be sought by Australia for extradition.
The director of Indonesian police's transnational crime division, Agung Sabar Santoso, said his officers would work with the Australian Federal Police in hunting down the people smugglers.

''They contacted us yesterday,'' he said yesterday.
He confirmed the boat was crewed by three Indonesians, but said the AFP had yet to inform him about where and when the vessel that sunk departed Indonesia.

Regi is believed to be a senior member of a transnational people smuggling network. According to asylum seekers who spoke to The Age on condition of anonymity, he is the point-of-contact in Indonesia for irregular immigrants from Iran and Iraq, collecting money, and arranging accommodation and transportation to boats in remote spots along and off the Indonesian coast

Warren Snowdon, the Labor MP whose electorate includes Christmas Island, yesterday launched a scathing attack on the people smugglers who organised the vessel. ''We would not have ever anticipated that some idiot would have put people on a wooden vessel in the cyclone season and tried to bring them to Christmas Island,'' he said.

''That is just the grossest, most irresponsible behaviour I could ever imagine. It is criminal behaviour of the worst possible type.'' Asylum seekers from the region typically fly to Malaysia or Singapore first, and then take a boat to the northern Indonesian island of Sumatra. They are then taken to Java, or to eastern Indonesia, from where vessels make the journey to Australia.

However, a relatively large number of Iranians fly direct to Jakarta as they can more easily obtain tourist visas than Afghans or Sri Lankans.

Iranians are the second-largest nationality among ''irregular maritime arrivals'' this year. Afghans are the largest group.
