Eight Philippine coast guard officers have told Taiwanese investigators that their commanding officer ordered them to open fire on the fishing boat Kuang Ta Hsing No. 28, which the commander maintains was trespassing in Philippine territorial waters on May 9, our sister paper China Times reports.

The Taiwanese team, which is in the Philippines investigating the fatal shooting of fisherman Hung Shih-cheng, had their first opportunity on May 30 to question the officers on board the Philippine ship at the time of the incident. An officer who says he refused to fire on the fishing boat claimed that his commander seized his rifle and shot at the fish boat for "at least 10 minutes."

Of the 20 officers on board the coast guard boat, the team concluded that eight of them, including the commander, fired on the Kuang Ta Hsing using at least two different automatic rifles and a machine gun.

The investigators asked to carry out a polygraph test on the coast guard officers but the request was declined by the Philippine's National Bureau of Investigation.

China Times reported that video footage of the incident seen by the investigators suggested that the fishing boat appeared to back up and then move forward again when it encountered the Philippine vessel. This, they said, gave the commander the pretext that the boat was trying to ram them and prompted his order to open fire.

Taiwanese investigators said on May 31 that they have identified the gun and the gunman that fired the bullet that killed Taiwanese fisherman Hung Shih-cheng after completing their investigation in the Philippines and returning to Taiwan.

"We have collected enough sufficient evidence this time," said Yang Wan-li, chief prosecutor of the International and Cross-strait Department under Taiwan's Ministry of Justice.

In addition to confirming the officer who fired the weapon, an M14 rifle, Yang said the investigators after reviewing video footage and the voyage data recorder of the fishing boat Ta Kuang Hsing No.28 that the Taiwanese vessel did not attempt to ram the Philippine coast guard boat as the Philippine side had claimed, nor were the fisherman engaged in illegal fishing when they were confronted.

"The Philippine government has been helping and cooperating with us this time," said Lin Yen-liang, chief prosecutor for Pingtung District Prosecutors' Office. Investigators had traveled to the Philippines for the first time in the week after the incident but were not granted any assistance by local authorities.

Lin and Yang led a group of eight investigators to the Philippines, where they interviewed related personnel and examined evidence on May 29 and May 30.

Taiwan's vice justice minister, Chen Ming-tang, said that the team of investigators from Taiwan and a team from the Philippines, which has been conducting a parallel investigation, will not disclose their final report before they confer with each other and reach an agreement. No deadline has yet been set for the announcement of the findings.
