You may have read about Chee Ah Sau, the distraught father who tried to jump off the second-storey balcony of a courthouse, when the rapist-cum-murderer of his daughter was acquitted. This was in June 2013.
Several reporters held onto him whilst others tried to calm him down, in Hokkien. The poor man was weeping uncontrollably and was inconsolable. He was eventually taken home, by his wife and a friend.
The 56-year-old man had earlier been in the High Court, to hear Justice Zaki Abdul Wahab acquit and discharge car salesman, Shahril Jaafar, 32, of murdering Chee’s daughter, Gaik Yap. Zaki said that the prosecution had failed to prove a prima facie case.
A grief-stricken Chee said, “I wanted justice for my daughter. I have waited so long for it but it turned out like this.”
SHAHRIL THE COWARDLY BEAST
Twelve years ago, on 15 January 2006, 25-year-old Chee Gaik Yap, a Universiti Utara Malaysia (UUM) graduate, was jogging with her younger sister, when she was abducted, raped and murdered. The crime was committed near Kelab Cinta Sayang, Taman Ria, Sungai Petani and her body was later dumped in a housing estate.
The suspect was Shahril. He evaded capture by running-off to Australia, where his father had obtained permanent residence.
Shahril was eventually re-arrested, at KLIA, when he returned from Perth, in 2012.
BOTCHED INVESTIGATIONS
It was reported that Shahril’s semen was found on the victim but the Judicial Commissioner Zaki Abdul Wahab said that ‘the semen did not completely match with his DNA and that it was possible for a third person to have contributed to the DNA profile’.
What tests were conducted to ascertain that the semen was Shahril’s? In what way did this semen not match his DNA? Was there a problem with the collection of the forensic evidence or the way the samples were stored or tested?
WHY RUN-AWAY TO AUSTRALIA? WHY DO MALAYSIAN MURDERERS SEEK REFUGE IN AUSTRALIA?
If Shahril was not guilty, why did he abscond to Australia? Is it because he has no faith in the prosecution, the Chemistry Department, the investigation process or the judiciary?
It is alleged that his father is a “Datuk”. So, was Shahril being set up to intimidate his father?
Or was Shahril being protected because his father is a Datuk? Who was the third party?

ROLLER-COASTER OF JUDGEMENTS
June 2013: The High Court acquitted Shahril as the prosecution failed to establish a prima facie case.
October 2014: The Court of Appeal set aside the High Court’s decision and ordered Shahril to enter his defence.
Shahril gave an unsworn statement from the dock where prosecutors could not cross-examine him.
He told the court that he met Chee for the purpose of having consensual sex, and paid RM350 to an individual called “Wayne” for sexual services from her. He claimed that they had sex in his car and that Chee was still alive when she left. He claimed that he was not responsible for her death. He denied fleeing to Perth to escape prosecution.
2015: The Alor Setar High Court sentences Shahril to death for murdering Chee.
November 2016: The Court of Appeal affirmed the death sentence. A three-man bench. chaired by Justice Mohd Zawawi Salleh, dismissed Shahril’s appeal, and said that the guilty verdict was supported by strong evidence. Zawawi said, “The trial judge did not commit any appealable error and this court need not intervene.”
January 2018: The Federal Court upheld the death sentence of businessman Shahril Jaafar for the murder of Chee Gaik Yap in 2006
Chief Justice Raus Sharif said, “We are unanimous in our decision. Based on the circumstantial evidence, we found that the accused is the person responsible for the deceased’s death”.

There is no proof except the the accused's claim that the victim was a prostitute and was paid for having sex with him. What sort of kangaroo court can acquit him and let him go scot-free? Anyway justice delayed is justice denied!

A businessman standing trial for allegedly killing a woman in Sungai Petani almost nine years ago told the Alor Star High Court that he paid her for sex on the day she died.

The accused, Shahril Jaafar, 33, as reported by The Star, said he asked a friend identified as 'Wayne' to find him a non-Malay girl in her 20s for sex on January 14, 2006.

“At about 4pm, 'Wayne' called and said he had arranged for a girl to meet me near the Cinta Sayang Club.

"He said the girl would look for me. At about 5pm, while I was waiting in my car, the deceased appeared and knocked on my window.
“After introducing ourselves, I asked her to move to the back seat. She demanded RM350 and without further delay, we had sex,” Shahril said in his defence yesterday, The Star reported today.

The murder victim, Chee Gaik Yap, and her case attracted nationwide attention in January 2006. Chee, 25, was a marketing executive, who allegedly kidnapped, raped and then murdered near the Cinta Sayang Club in Taman Ria Jaya when she went for a jog with her younger sister.
Her semi-nude body was found in a housing estate nearby hours after she had disappeared.

Shahril, the son of a Datuk who reportedly owned a meteorite and opal company, was detained as a suspect shortly after. He fled to Perth, Australia after he was released on police bail pending a DNA test in 2006.
He was arrested at the Kuala Lumpur International Airport on January 17, 2012 on his return from Perth, and was charged with Chee's murder two weeks later.

The case made headlines again when Shahril was acquitted and discharged by the Alor Star High Court without his defence called on June 25 last year.

The court ruled that the prosecution failed to prove a prima facie case as there was no clear evidence to implicate Shahril in the murder.

Chee's father Ah Sau, 58 – who had tirelessly sought justice for his daughter over the years – was devastated by the court's decision and tried to jump off the balcony of the two-storey court complex, shocking pressmen, who managed to grab him in time.

The case went to the Court of Appeal and in October, Shahril's acquittal and discharge was set aside and he was ordered to enter his defence.

Yesterday, on the first day of the hearing since he entered his defence, the report stated Shahril said he did not use a condom.

He said that Chee left his car when he received a call from his mother. Shahril's mother told him to pick her up after a golf tournament at the club.

He said the young woman was alive then.

“It was the first and last time I saw her. I only got to know about a body being found outside the club the following day, and discovered that Chee had been murdered after reading about it in a newspaper the next day,” Shahril said, adding that 'Wayne' could not be reached on the phone. – December 29, 2014. :rolleyes:

I think he was acquitted first round, sentenced to death by hanging second round and now, its the third and final round. If he loses, no more appeal unless new evidence crop up. No mention of paying the girl in first and second round so more like a desperate attempt to escape the noose.

A separate murder in Malaysia, and unfortunately in this case, the court dismissed the case and all the murderers were released scot-free.



KUALA LUMPUR: The High Court here today discharged and acquitted six men and a woman of the charge of murdering and conspiring to murder a female real estate agent at Overseas Union Garden (OUG) last year.

Judge Datuk Azman Abdullah discharged the seven accused without calling for their defence after finding the prosecution had failed to prove a prima facie case at the end of the prosecution's case.

Two unemployed, M. Pal Ganapathy, 26 and S. Vijendran, 29, were charged with murdering Datin Wong Siew Ling, 32, in Jalan Hujan Emas 4, OUG, off Jalan Klang Lama, between 2pm and 2.30pm on July 6, 2016, under Section 302 of the Penal Code which carries the mandatory death sentence.

Five other accused, K. Sri Kanapathy, 34, Chen Yuen Ming, 41, Chin Kok Leong, 43, K. Sattiyarad, 29, and a woman, Liew Lai Chen, 46, were accused of conspiring to murder the woman at the same place and time.

They were charged under Section 109 of the Penal Code, read together with Section 302.

Azman in his judgment said the failure of the victim's husband to come forward drew two possibilities, that he knew about the murder but was afraid to attend or was involved together.

"However, in her final testimony, the victim's younger sister stated that the victim had informed her to hand over all documents to her husband if something happened to her.

"On studying the testimony, it appeared the victim's husband was not involved but his absence in court made the testimony incomplete on the roles of all the accused which could have caused the death of the victim," he said.

After the decision was announced, all the accused and their families present in court were seen relieved and hugging each other.

The prosecution was conducted by deputy public prosecutor Aznika Mohd Anas while the accused Pal Ganapathy and Vijendran were represented by their counsel Vijey Esvaran and Loh Suk Hwa.

The five other accused, Sri Kanapathy was represented by counsel Nur Hayati Omar, Chen by Datuk Geethan Ram Vincent, Chin by Datuk N. Sivananthan and Low Huey Teng, K. Sattiyarad by Datin Freda Sabapathy and Datuk Simon Sabapathy, and Liew by M. Rajakumaran.

The prosecution had called 27 witnesses during the trial which began on April 11.

On July 6 last year, the real estate agent died at the scene while her daughter was injured when gunmen fired several shots at the vehicle they were travelling in at about 2.30pm. — Bernama
