I read a few articles on this case, and they all seemed to have copied one another's report. This Kovan Tan, a 27-year old, appeared from nowhere in the events leading to the accident. It started with (Jarrett) Tee and (Vincent) Loh in separate cars, and Loh picked up two 16-year old girls. And the deceased (Lim) and her 16-year old boyfriend joined them subsequently.

At this point, there was no mention of the motorcycle. Together, they were playing "blocking and braking" in two separate cars driven by Tee and Loh.

Then the motorcycle suddenly appeared in the report:

Mr Tan (Kovan Tan, 27) was introduced into the story at this point, and he was already riding a bike. Mr Tan is NOT the boyfriend of the deceased. The boyfriend was 16 years old and at the time of the accident he was travelling in Tee's car.

Where and how did this Mr Tan appear ?

The 16yo doesn't have a motosikal so Ms Lim followed the 27yo bf as pillion?

1. Tee's ego was inflated by the rented Mercedes Benz + the fact that he was an NUS undergraduate at the time
2. Tee was attracted to Ms Lim and wanted to impress her
3. Tee invited Ms Lim and her boyfriend to a ride on his car. The boyfriend accepted but Ms Lim chose the car of Vincent which is not a Benz (1st rejection)
4. Then the motorcycle came into the picture, and again, Ms Lim chose the humble motorcycle instead of Tee's rented Mercedes Benz (2nd rejection)
5. Tee could not take the repeated rejections and wanted to embarrass Ms Lim by making "the motorcycle fly"

This explains why Tee said after the accident:

He was charged under section 64(6)(a) of the Road Traffic Act which carries a maximum sentence of 8 years. He was sentenced to 5 years and 8 months, which is not a light sentence relative to the section that he was charged.

You cannot sentence more than what is permitted under the charge. And you cannot discuss the justice of sentencing decisions without reference to the relevant charges.

So the clear minded question is to ask why didn't the prosecution charge him under Penal Code for Culpable Homicide ?

So if the prosecution can achieve a 5 to 8 years jail sentence with a risk-free plea of guilty (RTA) which will save plenty of court time, both for the prosecution and the judge, why take the risk of going to trial for (culpable homicide) a 10-15 years sentence which outcome is not cast in stone ?
