A 14-year-old boy from New South Wales could face a lengthy jail term in Indonesia after allegedly being caught with drugs while on holiday in Bali.
It is understood the boy was arrested on Tuesday allegedly in possession of a small amount of marijuana.
News Limited reported that he was allegedly caught with 6.9 grams gross of marijuana or 3.6 grams net.
The schoolboy is now being held at police headquarters in Denpasar.
If charged with possession he would face amaximum penalty of 12 years in prison.
However, as there is no juvenile court system in Indonesia, he would likely be placed in an adult prison if convicted.
He is the youngest Australian to be arrested in Indonesia.
The Department of Foreign Affairs and Trade has been contacted for comment.

Nature has given the answer but lawyers and politicians must go about making artificial laws that's all encompassing but unfair to all individuals concerned, especially in criminal cases. The answer is of course adulthood is at puberty. There's no such magical age as 18 or 21 when one suddenly turns adult on his birthday. It varies from person to person.

It will be quite hard to exactly determine what separates childhood from adulthood. Biologically, the age of puberty is the dividing period. Some cultures practise circumcision rituals at this period of a males child's entering adulthood.

However, depending on individual family's circumstances, some children are sent out to work even before this stage. To me, that makes them adults, especically compared to cases where the dud son or daughter is 30+ and still mooching from mom and dad and not responsible for earing a day's honest wages.

In this case, the country of Indonesia does not have a juvenile court. What happens then?

Personally, I feel that if the authorities are not prepared to legalize grass, the next best thing is to decriminalize it. Possession will then be classified as a misdemeanor and not a criminal offense. Just like parking violation - a fine will do. If the offender is 14 yrs old - the one to be punished is the seller.

Few years back I once read a book about this NZ mom and son who were caught trafficking drugs into Malaysia during the 80s.. The mom was a working gal while the son was in his teens... Kirpal Singh was their defence lawyer.. They escaped the gallows and were sentenced to life imprisonment... Think they were released in the mid 90s..
