After news of the online leak of the confidential information of 14,200 HIV-positive people, lawyer and politician Lim Tean had harsh words for Health Minister Gan Kim Yong on a Facebook post on Monday night, January 28, 2019.

Gan had issued an apology for the leak, saying, “I am sorry that one of our former staff who was authorized to have access to confidential information in our HIV registry appears to not have complied with our security guidelines,” which was published in Channel NewsAsia (CNA) earlier that night.

Lim Tean posted a link to the CNA article but did not mince his words. He called Gan “undoubtedly is the most incompetent Health Minister in Singapore’s history” and listed a series of mess-ups related to the Ministry, including

The next issue at hand: what legal redress or protections do the affected patients have? 34 years after the first HIV-positive case was reported in Singapore and despite huge medical advancements in treating it, the stigma of the disease remains very real. It is no exaggeration to say that the disclosure of an HIV-positive status could ruin lives, end careers, and destroy relationships.

With the information online – including names, IC numbers and contact details – there is nothing to stop anyone from posting the data on social media accounts or online forums. Will MOH be liable if say, someone were to lose his job as a result of the illegal disclosure? Given that employers typically do not need to disclose the reasons when giving employees notice, this scenario is a distinct possibility.

What about individuals who end up ostracised by family and friends? Will MOH be responsible for the emotional distress this causes them and their loved ones?

It is not just about the 14,200 patients. The collateral damage from this incident extends beyond them.
 
The most galling part of the recent revelations is that the unauthorised access took place in 2012-13, MOH found out about it by 2016, and *still* tried to ram through a compulsory NEHR in 2017-18 despite having had actual knowledge of the privacy risks of electronic medical databases.

Sad to say, we have to be grateful to the SingHealth attackers. Had it not been for them, we might already have a compulsory NEHR law on the books.
 
This cover-up dating back to more than two years will lose them their moral high horse - remember Ms Vivian saying about when we make a mistake, we admit it.

Actually the most incompetent health minister was Hairdo Kim. He screwed up on the SARs procedure. He basically did not even know wat to do. So even these elites worth their salt like the way dead fart proclaim?
