Any lawyer or law student here that can advise me my chance of winning if I were to sue MINDEF for negligence.

Case 1
Not too long ago, I was diagnosed to have hole in the heart. My heart consultant confirmed that it is a born defect. He was astonished that I was enlisted for Pes B National Service, and said that he can write me a discharge letter if I were to call for reservist. I told him I had already completed my cycle of NS. I then ask him if I intend to sue MINDEF for negligence, is he able to be the witness. He said he can provide my diagnose report.

Case 2
I had severe back pain and after some detailed MRI, specialist asked me if I had carry very heavy object. I never do any weight lifting in my life. Also I did not do any manual labour work in my career. The heaviest object I ever carried was being forced to caservack my buddy during NS. I was then 58-60kg, buddy was fatty 90-100kg type. After the exercise I started to have back pain and it only get more serious today.

I am more confident on Case1. Case 2 is hard to prove since it happened long ago.
Case 1 is clearly a negligence by MINDEF during the pre enlistment checkup, even though it happened long ago. MINDEF could defend that I am still in 1 piece and alive, but the firmed thing is they were negligent, and I could have lost my life during SOC and IPPT.

I would like to seek for compensation, preferably in monetary form as I am in need of money . I will engage lawyer if chance of winning is medium to high . Any serious advice is appreciated.

You would have better luck squeezing blood from a stone than getting monetary compensation from Mindef.

The most you can do is make a public complaint so that Mindef/SAF wakes up its bloody idea and does a proper pre-enlistment health checkup for all future recruits.

Many footballers would have dropped dead if they had done a CMPB-style medical checkup prior to signing for a football club. Yeah, take off your pants and cough. Very good, PES A for you. :rolleyes:

If anything, the fact that nothing happened to you vindicates what the MINDEF doctors diagnosed and if everything was done according to prescribed standards, even if something happened to some young boys, it is also not their fault as everything is done as prescribed.

As the other bro said, good luck with that.

P.S. boys who died during NS only got payout of 10k-20k. How much you think you can get even if successful? Worth the effort? Channel your effort and resources into getting out of this place and/or your son(s) from the same shit as us.

After several cases of young boys drop dead during NS, not sure have they step up on pre enlistment check..should have lah just the degree of stepping up.
Do you think if I bring this case up with my doctor diagnosis report, will MINDEF willing to settle with me out of court ? Even settle for $3-5k I find is better than nothing.

No case la, in your time, maybe hole in the heart also must do NS, and furthermore, hole in the heart not easy to check, especially more than twenty years ago when medical equipment were not such high tech.

If you really need money, suing MINDEF isn't a solution la. The Thai girl lose her legs liao, SMRT also can win the case. SMRT is merely a GLC, MINDEF Is Ah Gong itself. Somemore don't forget if the courts let you win the case, it will be setting a dangerous precedence that will pave the way for every service injury to be litigated, which will be a big headache for MINDEF lawyers, and big hole in Ah Gong's pocket.

There are many young and fit people running around with a hole in their hearts.There are many women with hole in the heart leading a very normal life. Unless there are complications, hole in the heart is no issue.

running around with hole in the heart is risky depending on the size of the hole. Also having dental treatment without taking antibiotics in advance have a very high risk of heart infection.

Thanks Poomer, what you said is true, MINDEF can say 20 yrs ago hole in the heart may not be easily check .But in fact it is the same lah..only GP doctor with skills can detect it. My case was detected by a GP during a normal flu visit, she suspected I have hole when she heard the heart murmur. Sent for specialist and confirmed.

totally agree. if you developed a hole in later life, better go for a thorough check. you might have a septal infarction!
check you blood pressure. check your cholesterol. if possible, go for a more detailed heart investigation.

my 56 years old neighbour suddenly felt breathless. he went to his GP doctor who discovered a murmur in his heart. he was sent to the hospital where it was confirmed he had a "hole in his heart" due to a "heart attack" which destroyed his dividing muscle - septal infarction. go check it out! very unlikely that your hole in the heart has been missed for so long.....if it is a recent development, better be very careful.
