The man suspected of killing a maid and dumping her body in an HDB rooftop water tank may go free.

The Straits Times reported today that at a pre-trial hearing last week, the prosecution gave notice that it would apply for a discharge not amounting to an acquittal for Md Repon Mostafa, a 29-year-old Bangladeshi.

The cleaner was arrested at the scene of the crime and has been held in remand since his arrest in May last year.

His uncle, Mr Mazibar Md Sadhumiah, told the paper that Mostafa was 'overjoyed' upon hearing the news.

Mostafa's lawyer, Ram Goswami, told The Straits Times that the case had been taken off the High Court list where capital cases are heard.

Eight court pre-trial conferences had been held since the suspect was charged earlier.

Lawyers told the paper that the prosecution's move is usually caused by lack of sufficient evidence, or the absence of a key witness.

The story made headlines last year after the dead body of an Indonesian maid was discovered on May 16 inside the rooftop water tank of Block 686B, Woodlands Street 73.

It was reported that blood stains were found in the 2m-deep water tank.

Mostafa was subsequently charged with the murder of Madam Ruliyawati, 30, who was found wearing wearing a t-shirt and bermudas with several wounds. It was believed he had access to the rooftop as it is his job to clean the roof and check the water tank. The rooftop is normally locked.

Mostafa was reportedly seen limping and had cuts on his legs when he was led away by the police.

An autopsy revealed that the maid, who had been working for a family living in that block for only six weeks, drowned.

It was reported then that the corpse in the water tank may have tainted the drinking water of 700 residents.

This led to new measures by the PUB to secure water tanks in all HDB buildings.

The water tank in the affected block was replaced by a $40,000 tank about a month later by the Sembawang Town Council.

The case will be brought up for mention in the Subordinate Courts tomorrow.

If successful, this will be the second such case in Singapore where a murder suspect is involved. The first is Larry Lim, who was granted a discharge not amounting to an acquittal for a murder in 2003.

Knn haven't they heard of forensic investigation ? How can they just let him off like that one ? Surely there are circumstantial evidence that can pin him to the crime, someone gotta go look harder & rethink.

It is a question of how much effort the police wants to pour into investigating the case. There was a case of the tour guide punching and beating his maid to death over a period of time. In the end the tour guide was charged with man-slaughter instead of murder (what it should have been). The reason was that to charge the tour guide with murder requires more onerous evidence, which required spending more effort.

In summary: the police can't be arsed to do further investigations when there are no political points to score.

And given the current climate of the govt countering xenophobia by admonishing Sinkies to integrate more with the foreigners, sending a Bangla to the gallows is not a conducive move.

Man given discharge in water tank death case

SINGAPORE: A Bangladeshi man who had been accused of killing a maid and dumping her body in an HDB rooftop water tank has been given a discharge not amounting to an acquittal on charges of trespassing and possessing obscene films.

Twenty-nine-year-old Md Repon Mostafa appeared in court on Wednesday to hear the verdict handed down by the court, after the prosecution withdrew its remaining five charges brought against him in July.

Repon's lawyer, Ram Goswami, said his client is now "completely free of any charge", but will have to remain in Singapore for a Court of Inquiry hearing on 25 October.

Wednesday's ruling follows a similar decision on 10 July -- for the charge of murder.

Repon was given a discharge not amounting to an acquittal in the death of a 30-year-old Indonesian maid, Madam Ruliyawati.

Her body was found in a rooftop water tank at Block 686B Woodlands Drive 73 on 16 May last year.

The case sparked concerns among residents over the safety of drinking water.

actually i suspect most of the forensic evidence is hard to pin against him. i think need witness etc to pin against him. i am not a law trained, but do know a tiny bit of forensic staff.

main reason 1 the body is in the water tank that is being constantly replaced. in general the first approach is to find suspect tissues under the nails for signs for struggle or unique t-shirt fibers. such samples unlikely to survive in constantly replaced water after so long....
