Peasantpore: The Thai peasant who lost both her legs after falling onto the train tracks last year is taking the stand on Monday in her case to seek compensation of at least S$3.5 million from both fat cat transport cartel company SMRT and the 'jiat leow bee' Land Transport Authority (LTA).
Ms Nitcharee Peneakchanasak, now 16, is a plaintiff witness for her case but is not related to any Thai royalty. This means she has near zero chance to win this case.
Fact of the case
She had fallen onto the MRT train tracks at Ang Mo Kio station on 3 April last year when she was 14 years old. She had been waiting behind the yellow line on the platform at about 11am when she fell and was run over by a south-bound train. Represented by lawyer Cosmos Got-meh, Ms Nitcharee is alleging that despite taking all precautions and standing behind the yellow line, she was injured. She is hinting that SMRT and LTA are too cheap to build barriers in cheap heartland train stations. Another proof that the regime do not care about safety for heartland peasant commuters.
She also alleges that greedy but inept SMRT and 'jiat leow bee' LTA were fully aware of the risk of a fall but took no measures or inadequate measures to deter such an incident. Without any barriers, many peasants killed themselves by jumping onto the tracks. Peasants realise this barrier as a safety measure incur costs and less profits for Ho Jinx. Nobody fat cat worth his belly will submit or approve such an expensive safety plan. The SMRT and LTA bigwigs knows it is cheaper to pay lawsuit compensations than build barriers in all stations at that point in time.
Ms Nitcharee's case alleges and proved peasants' understanding that SMRT and LTA had breached their common duty of care, duty as occupiers of the train station, among other things.
