Section 55 has been around for as long as I've lived. It was a very powerful tool against the triads and gangsters in the 50s-70s. It practically gives the police a free hand and the Minister his pleasure. Why did it take the govt so long to recognise the problem and to use simple bt effective tools like Sect 55 to deal with these intimidation, unruly and unlawful behaviour? Shall we gve 3 Hail Marys to PAP?
When and how did I backtracked ? I just disagreed with that detention without trial and the family thingy. Investigating and convicting them in a proper court with full transparency is the only way to go.
Infact they did invoke section 55 a few years back and had detain quite a number arrested for loan-sharking or atleast on suspicion for that matter but for some unknown reasons they make a U turn and start charging people in court. Just like gang clashes, previously those involved are detained under this section but now they are charged with rioting penal codes.

If I am informed correctly, section 55 was a section of the public security act the british uses to suppress dissidents. And David Marshall had once expressed deep regrets it was not excluded from the constitution when negotiating for independence.

When Lim Yew Hock became chief minister, he invoke this section to suppress those anti-colonial activist (PAP ) and the communist, it impresses the british in the second round negotiation and won internal self government for singapore.
Then he went on to round up the triads and secret societies putting them in pulau senang with no hope of leaving the island. But in 1960 a riot erupted and the superintendent and two officers were killed. Many were charged but only 18 were found guilty and sentenced to death. I dont have the dates but I was told these 18 were hanged in a single day,it made history.
When the old fart came to power, he similarly invoke this section 55 or it's various subsection to detain his political opponents. Then later the triads, secret societies members and later drug pushers as well as drug addicts. A few years back loansharking were also included but now I am not too sure.
Section 55 was not a penal code, nonetheless its subsection amendments are made spelling out extracts of various offences or crimes. But the fact that its a tool for detention without trial, an accuse even if with an attorney is never going to court but only going thru a panel consisting of maybe an officer from CID and an officer from MHA and finally a court sanction.
This section of detention without trial is against the Rule of Law, its tyranny, it has to be repeal.

You are absolutely right. In 1998, they detained the younger brother of Chua Tiong Tiong (Ah Long San), Chua Tiong Chye (Lau Ter Kor) under CLTP. Its the younger brother that is the actual kingpin and not the Ah Long San. Even Subash got that part wrong.

55 comes from the year 1955 when the British Colonial Govt introduced it to combat secret societies and general disorder such as strikes. It expires every 5 years hence the term "temporary provisions" in the Criminal law Temporary Provisions Act. It has been faithfully renewed every 5 years.
Its biggest effect is when witnesses are intimidated and no court conviction can be secured. No man with a decent IQ will consider testifying against a secret society or an organised racket. Court cases cannot operate in a vacumn. The law and order comes to a standstill. During the "Troubles" in the Northern Ireland with the civil war raging with the Provisonal IRA, similar laws were introduced and many were detained without trial. I am talking about 1970 to 1975. Witnesses or their family members kidnapped, shot and the bodies prominently left by roadside to deter others from testifying in courts.
By the way over 70 Ah Longs are currently held in detention. The syndicates now operate across borders.
I had no info what year that section came into existent. I was only given to know that section is a sub section of the british public security act in all british colonies.
Some abolishes it when they gain independence but singapore retain it and just like us malaysia too retain it. I too had no info about the 5 yearly renewal. All I know is detainees are subjected to yearly reviews and MHA holds the power to extend or release.
In modern day singapore, those witness intimidation you're saying no longer exist, thus that section is no longer valid, it's high time it is repealed. Like I said before that section is open to abuse by the power and whoever wields it. You may choose not to agree but history had shown it has been abused before atleast politically. For anti-terrorism maybe they should introduce an anti-terrorism act if they deem necessary.
