REPORT OF A PERSON FLOUTING HDB RULES - KOJAKBT


We refer to your email of 22 Jun 2010 to our CEO.

HDB flats are primarily for home ownership purpose. However, lessees who have fulfilled their requisite occupation period (5 years for flats purchased directly from HDB or from the open market with a CPF Housing Grant; and 3 years for flats purchased from the open market without a CPF Housing Grant) may apply to sublet their whole flats subject to HDB's written approval and subletting terms and conditions.

Lessees who have illegally sublet their whole flat without HDB's written approval would have infringed our Housing & Development Act. Thorough investigations will be conducted and legal actions will be taken against them.

We appreciate feedback from members of the public when there are suspicious cases. This will allow us to investigate and carry out appropriate actions on the lessees where applicable.

HDB reply makes sense. If this joker meets HDB requirements then he is free to rent out. Unless the Gov come out with new laws what he is doing is perfectly legal.

It is pointless to start having all sorts of restrictions for a certain group of people. HDB can always tighten requirements on who can buy flat and they can increase time before being able to rent out. However once person meets requirments that is it.

If he fufilled the MOP for the flat, then yes he is free to rent out the entire unit. However if he owns a private property as well he needs to either stay in the flat or stay somewhere else and can rent out both properties.

All that need to be done is to check what his registered address is. If his address is a private property that he owns then he is flouting the rules. If his registered address is the flat he owns then he is in bigger trouble.

Gahmen bodies are the most useless organizations. They are like vermin. Or leeches. In a global business environment without the government funding, most of them would have been bankrupt.

For gahmen bodies, it is actually very simple. Officer level can do nothing! Good for answering emails using templates at best. My past dealings with these morons have been frustrating to say the least. Need to talk to the top guns.

Firstly, he must get approval from HDB before he can sublet out the entire unit (no approval is needed for subletting of rooms, but must give tenant info to HDB).

Second, he must inform Comptroller of Property Tax as rental income are taxable. If he has not declared his past rental income in his tax returns, then IRAS can take action against him.

According to the yellow page listings, there is a Sinha Shekhar staying in 53 Bedok Road. This the address for Country Park Condominium along Bedok Road, not far from Bedok Rd Hawker Centre. I wonder if it is the same person.

Rules are for lesser mortal but we do make exception for higher mortal....read carefully "exception is made for those who have obtained prior approval from HDB ...". Join elite MIW and you are granted exception!
