Yang Yin case: Widow has mental capacity to revoke LPA, family court rules
The ruling came after the family court heard testimonies from two medical experts on Mdm Chung Khin Chun's mental capacity, after she was diagnosed with dementia this year.
SINGAPORE: Madam Chung Khin Chun - the multimillionaire widow at the centre of an estate tussle between her niece and former tour guide Yang Yin - has the mental capacity to revoke her Lasting Power of Attorney, the family court ruled on Monday (Nov 24).
The ruling came after the court heard testimonies from two expert witnesses about Mdm Chung's mental capacity. She was diagnosed with dementia this year.
Last Friday, the court heard from Professor Chiam Peak Chiang, a senior consultant at the Institute of Mental Health (IMH), who was appointed by the court to examine Mdm Chung. The report was submitted to court earlier this month.
The court also heard from Dr Calvin Fones, who is in private practice, last Thursday. He had previously certified that Mdm Chung had the capacity to revoke the Lasting Power of Attorney to Yang.
The widow then applied to the Office of Public Guardian (OPG) in September for the LPA to be cancelled based on Dr Fones' report, after Yang had allegedly manipulated her. The OPG subsequently applied to the court to have an IMH medical expert examine her, while suspending Yang's powers.
The OPG had said it will decide on the cancellation of the Lasting Power of Attorney "after the court has made a determination on Mdm Chung's mental capacity". An OPG spokesperson told TODAY: "Now that the court has given a definitive finding with regard to Mdm Chung’s capacity to revoke her LPA, the Public Guardian will proceed to process her application to cancel her LPA from the register."
Yang is currently under remand on a separate set of 331 charges of falsifying receipts to his company, Young Music and Dance Studio, between 2009 and this year. If convicted, he could be jailed up to 10 years and/or fined.
