Earlier today, Low Thia Khiang, Sylvia Lim and Pritam Singh, all parliamentarians from the Workers’ Party (WP) were found liable for damages in a case that investigated misuse of town council funds.
Between July 2011 and July 2015, the Aljunied Hougang Town Council (AHTC) paid at least S$33.7 million to their town council managing agent FM Solutions & Services (FMSS), which was appointed without tender.
Mr Low was the secretary-general of the WP while Ms Lim had chaired AHTC, and Mr Pritam served as a member of the town council’s committee for tenders and contracts.
High Court Judge Kannan Ramesh today said (October 11) that Mr Low and Ms Lim had breached their fiduciary duties to AHTC and that Mr Pritam breached his duties of skill and care to the town council.

Judge Kannan said, Both had “failed to act in AHTC’s best interests and had acted for extraneous purposes.”
As for Mr Singh, while “it cannot be said that he has breached his fiduciary duties to AHTC”, he had breached his “duties of skill and care”, the judge said.
In a statement following the event on their blog ‘In Good Faith’, Mr Pritam, Ms Lim and Mr Low said:
“The court judgment for the first tranche of our case was released this morning. We are in the midst of reviewing the judgment and will take advice from our lawyers. We will share more details on our next step/s in due course.
On his personal Facebook page, Mr Pritam wrote, “In the meantime, our Town Council work continues in earnest. This afternoon, Faisal and I were involved in a briefing at the AHTC office in Hougang with a team from the Municipal Services Office to discuss the evolution of the OneService app amongst other things, while Mr Low and Mr Png were a few hundred metres away at a meeting at the HDB Hougang branch office discussing the Neighbourhood Renewal Program in Hougang SMC”.

SINGAPORE — Three Aljunied GRC MPs – the Workers’ Party (WP) chief Pritam Singh, Sylvia Lim and Low Thia Khiang were on Friday (11 October) found by the High Court to be liable for damages suffered by Aljunied Hougang Town Council (AHTC), which is said to have made millions in improper payments under their watch.
The long-running saga will now move on to a second round of hearings to determine the quantum of damages suffered by AHTC, and how much it can recover from the MPs.
Here is a recap of the major developments so far:
May 2011
The WP wins Aljunied GRC and Hougang SMC in the general election.
August 2011
The WP takes over AHTC and appoints FM Solutions and Services (FMSS) as its managing agent.
January 2013
WP wins Punggol East in the by-election.
February 2014
The Auditor-General's Office (AGO) is directed to audit the town council's accounts after its auditor raises issues of concern.
February 2015
The AGO flags lapses in governance and compliance, including FMSS’ co-owners being town council staff.
January 2016
KPMG is appointed to audit AHTC after a court order.
October 2016
The audit finds flaws in the town council's governance and highlights improper payments of $33.7 million to FMSS
February 2017
AHTC appoints an independent panel to review the KPMG report.
July 2017
The independent panel files a civil lawsuit against several town councillors, including WP MPs Low Thia Khiang, Sylvia Lim and Pritam Singh for breach of fiduciary duties.
October 2018
The trial begins in the High Court.
October 2019
Justice Kannan Ramesh finds the WP MPs liable for damages suffered by AHTC. Damages will be assessed by the court at a later date.

No need to invoke ISD when PAP can always trust the oppies to fuck themselves up by being dishonest. JBJ told lies, Oppie Chee cheated on taxi claims and threw his mentor out of his own party and the WP oppies treated the Aljunied Town Council as their own fief where they gave contracts to their own friends and cronies.

SINGAPORE - It is up to the town councils to show what their "true or proper loss" is when they try to recover monies from eight defendants, including three Workers' Party MPs, in the next stage of a long-running civil suit.

Former WP chief Low Thia Khiang, chairman Sylvia Lim and current leader Pritam Singh have been found liable for damages suffered by the Aljunied-Hougang Town Council (AHTC), which is said to have made $33.7 million in improper payments under their watch.

In his judgment on Friday (Oct 11), Justice Kannan Ramesh said all the payments under two major contracts the AHTC awarded to its managing agent FM Solutions and Services and its sister company could be said to involve the misapplication of the town council's funds.


However, the town council had received the relevant services. The amount of money AHTC can recover, therefore, is the difference between what was paid and the value of the net benefits actually obtained by AHTC, he wrote.

This would mean that the "loss cannot possibly be as much as the full amount disbursed under the impugned contracts", he added.

As well, "the legal burden of proving loss falls upon the plaintiffs", Justice Ramesh said, adding that the plaintiffs must prove that the defendants' breach was the "but-for" cause of their loss.

The "but-for" cause is a legal term to show that something would not have happened but for the contributing factor.

Pasir Ris-Punggol Town Council (PRPTC) had also sued the same set of eight defendants, over claims related to Punggol East constituency when the WP won the ward at the 2013 by-election.

Justice Ramesh also said the court would not be exercising its discretion to order a common account, since the purpose of such an account would be to identify the whereabouts of the money.

In this case, "there is no confusion as to where and to whom AHTC's funds were paid".

He also set out guidelines for the other remedies sought by AHTC and PRPTC in relation to the defendants' breach of fiduciary duties.

For example, they can try to get FMSS and its co-owners, Ms How Weng Fan and her late husband Danny Loh, to repay any profits earned from their contracts with AHTC.

But they would have to choose between doing that or compensating the town council for losses suffered.

The judge has also allowed the plaintiffs to seek from the town councillors and the other defendants the costs of investigating their breaches of duty.

Friday's verdict brings to a close the first tranche of the trial to determine liability. The next step of the trial would be to determine the damages.
