Hi Gilbert,
My ex wife is from PRC and we were married for less than 4 years before the marriage ran aground.
The end of the marriage also was the start of a financial nightmare for me. Let me explain…
Few years back, my ex-wife’s father invested in a local business here. I helped to run the business and took a loan from the bank due to shortage of cash.
My ex-wife and I were guarantors of the loan.
Unfortunately, we divorced after I have helped her to apply for Singaporean citizenship. We have a young child.
I have no money to engage a lawyer during the divorce proceeding and ended up accepting the child maintenance bill of $1100/month even though she has a few businesses with her.
After we divorced, I took over the business loan instalment of $4000 per month for 4 years. My ex-wife also did not pressed me for the payment of any maintenance due to her because of that.
I also closed down the business as it was financially not viable for me to carry on.
However, it was an uphill struggle for me and after a while, I defaulted on the loan repayment plan and both of us received legal letters from the bank pressing for payment as we were guarantors to the loan.
Now, she is suing me for maintenance arrear of $20, 900 due to her and the child.
Meanwhile, to make ends meet, I managed to carry out some consultation job for my friend and make about $1500 per month before CPF.
My problem is made worse by the fact that I have gout attack very often. I also took at least 3 days of MC monthly and more if I have gout infection.
I was eventually asked to leave as I took too much medical leave and I was unable to perform well at work as required. I have been jobless for the past six months.
However, I am thankful to my current local wife who supported me in my current predicament. She gives me some money every month so that I can maintain my simple living expenses. However, I know that this can’t go on forever.
I am also not entitled to free legal aid as my wife is working and we failed the means testing. I also can’t afford a lawyer as it is costly. I may have to represent myself then.
Should I die or prepare myself to go to jail for the huge maintenance arrear?
Please advise. Thanks.
Regds,
Jimmy
