No point going to court. The court applies the law that Parliament makes. The courts cannot make law or create exceptions to statute laws. The statute law says it's an offence to smoke outside smoking yellow box. Even if his bulging kukujiao is outside the yellow box while he is smoking, he commits an offence. The court will apply this law made by MPs which the guy voted into Parliament. Vote already cannot complain.
