The unfair practices of the PAP are not deemed unconstitutional under S'pore's current legal framework, but are fundamentally undemocratic and violate the principle of a fair and free GE. The absence of a formal, independent body to oversee the electoral process and the lack of a constitutional provision to prevent gerrymandering are why these widely criticised practices are legally permissible.
 
Power corrupts, and absolute power corrupts absolutely. So we know what happens when a govt puts the Elections Dept under the Prime Minister's Office and gerrymanders to stay in power. It wants absolute power to do as it pleases to benefit themselves and their cronies.
 
Placing the Elections Dept under the Prime Minister's Office creates a serious conflict of interest and an appearance of bias. The PM as the leader of the ruling party, has a vested interest in the outcome of the elections. By having the Elections Dept report to the PM's Office, the govt controls the very body that draws electoral boundaries, updates voter rolls and administers the election process. This erodes public trust in the electoral process and makes it difficult for the opposition to compete on a level playing field.
 
With absolute power, the PAP can do whatever they like .... anyway they like.

The criminal trial of the former CEO of publicly-listed New Silkroutes Group, Goh Jin Hian, and the company’s former chief corporate officer Kelvyn Oo began on 4 Feb, with the prosecution citing evidence including WhatsApp chats showing their discussions on how to push up the company’s share price in order to fund its acquisitions and raise capital. In Sep 2023, Goh, the son of former PM Goh Chok Tong and 3 other men were handed a total of 132 charges related to false trading offences. If not for his influential father, Jin Hian would have been behind bars long ago.
