The Western type of law was based on Gregorian period where there can be only one party is right/correct/true/make sense blah blah blah....

The other side lied, does not make common sense and therefore he is wrong.

The Eastern type of law was based on both parties will lied, and therefore we come into the middle ground to settle the dispute. Knowing he lied, and u lied what do u want us to do...

Japanese type of law is based on trust, lose face and promise to do get it right to sort out the dispute.

In a Japanese contract, for building construction only contained 7 lines of agreement of promise to do this, this, this and this as agreed on this price. If regards to Act of God problem, the costs of project changed.

Westerner get s lawyers to draft shitty sided a ton of stack papers in a contract to hurt the other party, if Act of God happen or changed in situation.... fraud, cheats the lawyers shouted.... Heaps of legal fees to pocket to make, says the lawyers with a hatchet to meet u at the cal de Sac courthouse.

The Asian courthouse says fuck off, go settle yr dispute like gangster....

I think you’re talking about the difference between Law and Justice , both are not the same

laymen usually goes to the court to get justice but in common British law you don’t get justice but an interpretation of written law

this itself is acknowledged in courts of law , as a Supreme Court justice in US recently said , do not come here to get justice

the gist is this , it’s usually the parliament that approves the law that is framed by the Attorney General office ...and true enough , the wordings of the law so framed cannot encompass the original intent completely , or the spirit of the law so as to speak

so through the course of time the spirit of such do gets fuzzy and the presiding Judge needs to interpret it
