'Antiquated' law 377A should be repealed: Tommy Koh

SINGAPORE: Veteran diplomat Tommy Koh called again for the repeal of Section 377A of the Penal Code, which criminalises gay sex, in an opinion piece published by The Straits Times on Monday (Sep 24).

The Ambassador-at-Large at the Ministry of Foreign Affairs is one of the prominent personalities to have spoken out against the 80-year-old legislation after India's Supreme Court struck down a similar law early in September.

In Dr Koh's commentary published on Monday - Section 377A: There is a difference between a sin and a crime - he delved into the history of the legislation and scientific studies on homosexuality.

On the scientific evidence for repealing the law, Dr Koh wrote: "Scientific research has shown that homosexuality is a normal and natural variation in human sexuality and is not in itself a source of negative psychological effects."

He cited a World Health Organisation decision in 1973 to delete homosexuality from the Diagnostic and Statistical Manual of Mental Disorders.

"This decision was endorsed by the general assembly of WHO in 1990 when it agreed to delete homosexuality from its list of mental disorders. In WHO's view, being LGBT (lesbian, gay, bisexual and transgender) is not a disease," he added.

He also pointed out that of the 196 states in the United Nations, the majority - 124 states - do not criminalise sodomy. Singapore is among the minority of 72 states which do.

While all the developed, Western countries do not criminalise sodomy, a notable number of Asian territories also fall into this category, including China, Japan, South Korea, Hong Kong, Taiwan, the Philippines and Thailand, he said.

Meanwhile, many of the countries who have a similar law in place were former British colonies.

"Singapore is part of the minority mainly because it inherited from the British a penal code which criminalises sodomy. For a country which embraces science and technology, it is surprising that, on this one aspect, the law has not been updated, in the light of the scientific evidence," he wrote in The Straits Times.

SEPARATION BETWEEN RELIGION AND STATE

In making his argument, he also elaborated on the difference between a sin and a crime: While adultery and fornication are regarded as sinful, they are not "criminal behaviour".

Former attorney-general Walter Woon was "unhappy" with the compromise of "retaining 377A and not enforcing it because it brings the law into disrepute", Dr Koh said.

Addressing the calls of Christian and Muslim religious groups to retain Section 377A, he said: "It is not the business of the state to enforce the dogmas of those religions. In Singapore, there is a separation between religion and the state. Church leaders and Islamic leaders should respect that separation."

He called on Christian and Muslim leaders to refrain from "pressuring the Government to criminalise conduct which they consider sinful".

Laying out court decisions in the US and India which had ruled that laws criminalising sodomy were unconstitutional, he wrote: "In most cases, the antiquated sodomy laws were repealed by the legislatures of the respective states or countries. However, in a few cases, the laws were declared unconstitutional by the courts."

Summarising his arguments, Dr Koh said: "Section 377A is an antiquated law, not supported by science, and should be repealed."
He concluded that the Singapore Court of Appeal should overturn a 2014 decision and declare Section 377A to be unconstitutional.

Desire to amputate healthy limbs shows up in brain scans

It’s a bizarre and rare disorder, but its consequences can be horrific. One man with body integrity identity disorder(BIID) dumped his lower leg in dry ice for several hours until doctors were forced to amputate. Others have resorted to wood chippers and gunshots to do away with healthy limbs they never wanted.
Now a study of four men with BIID suggest their condition is linked to reduced activity in a brain area involved in forming a mental body map.
“They can feel the body being touched, but it does not integrate into their sense of body image,” says Paul McGeoch, a neuroscientist at the University of California, San Diego, who presented the study at a recent conference on the condition in Frankfurt-am-Main, Germany.
“They know the limb is part of their body, but it’s ‘more’ than it should be. It should be gone,” he adds.



Sexual oddity
The disorder, also known as apotemnophilia, was first described in 1977 by the American sexologist John Money. He classified it as an intense sexual desire to have an amputation, hence its original name, which is Greek for love of amputation.
Most patients, however, don’t describe their desire to be amputees as sexual, says Michael First, a psychiatrist at Columbia University in New York who has conducted extensive interviews with dozens of patients.
“It’s very, very rare,” First says of all forms of the disorder. “I’ve been working on this condition now, researching it for 8 years, and I almost never get calls from therapists saying ‘I have somebody with this. I need your advice.’ “

Brain malfunction
Explanations for how BIID develops have run the gamut, from a cry for attention to early childhood exposure to an amputee, McGeoch notes. Those explanations “seemed absolute nonsense to us”, he says.
Instead, he and co-author David Brang theorise that the disorder is caused by a malfunction in a brain area called the right parietal lobe. Other studies have linked this region to people’s representation of their own body: stroke patients who suffer damage to this area sometimes fail to recognise a limb as their own.
“We suggest that perhaps apotemnophillia, or BIID or whatever you want to call it, is a cognitive variation on this – there’s something cognitively wrong with their right parietal lobe,” McGeoch says.
To test this hypothesis, McGoech’s team recruited four men with BIID via internet support groups. Though precise numbers are hard to come by, the disorder is about 10 times more common in men than in women.

Scanning evidence
The team tested subjects using a non-invasive brain imaging technology called magnetoencephalography (MEG), which measures the tiny magnetic fields created when neurons fire.
When researchers touched the limb that BIID subjects perceived as normal, their right parietal lobe kicked into action. When they touched the limb subjects wanted gone, activity in the right parietal lobe didn’t change.
One patient who wanted both his legs amputated registered no increased activity at all, McGeoch’s team found. Meanwhile, four volunteers with no desire to hack off a limb cranked up their right parietal lobes when researchers touched either leg.
“The fact that they’re able to scan anybody is amazing,” given the rarity of BIID, says First. He guesses that no more than a few thousand people worldwide have the disorder.

Warped body image
He is, however, not yet convinced that a deficit in the right parietal lobe causes BIID. It’s also possible that a strong desire to amputate a limb could transform neural circuitry in a brain region responsible for body image, he says. “There’s a chicken-and-egg problem here.”
The limb that patients want amputated can change throughout their lifetime, First notes. “That can’t be explained by a cognitive mismapping [of the limb].”
Deeper insight into the causes of BIID could offer insight into how to treat the condition. Drugs that alleviate symptoms of obsessive compulsive disorders are one possibility worth testing, First says.
Yet many patients see an actual amputation as the best treatment possible. “I have never heard of them regretting it,” McGeoch says. “They’re always delighted.”

To the family next door, Armin Meiwes seemed the perfect neighbour. He mowed their lawn, repaired their car and even invited them round for dinner.

Other residents in the small German town of Rotenburg also believed there was nothing odd about the 42-year-old computer expert, whose light burned late into the night inside his creaking mansion. Yesterday, however, Meiwes appeared in court charged with killing - and then frying and eating - another man.

In one of the most extraordinary trials in German criminal history, the self-confessed cannibal admitted that he had met a 43-year-old Berlin engineer, Bernd Brandes, after advertising on the internet, and had chopped him up and eaten him.

It was, he said, something he had wanted to do for a long time. "I always had the fantasy and in the end I fulfilled it," Meiwes told the court on the first day of his trial for murder in the nearby city of Kassel.

Yesterday German prosecutors described how Meiwes had fantasised about killing and devouring someone, including his classmates, from the age of eight.
The desire grew stronger after the death of his mother in 1999, prosecutor Marcus Köhler said.

In March 2001 Meiwes advertised on the internet for a "young well-built man, who wanted to be eaten". Brandes replied.

On the evening of March 9, the two men went up to the bedroom in Meiwes' rambling timbered farmhouse. Mr Brandes swallowed 20 sleeping tablets and half a bottle of schnapps before Meiwes cut off Brandes' penis, with his agreement, and fried it for both of them to eat.

Brandes - by this stage bleeding heavily - then took a bath, while Meiwes read a Star Trek novel.

In the early hours of the morning, he finished off his victim by stabbing him in the neck with a large kitchen knife, kissing him first.

The cannibal then chopped Mr Brandes into pieces and put several bits of him in his freezer, next to a takeaway pizza, and buried the skull in his garden.

Over the next few weeks, he defrosted and cooked parts of Mr Brandes in olive oil and garlic, eventually consuming 20kg of human flesh before police finally turned up at his door.

"With every bite, my memory of him grew stronger," he said.

Behind bars, Meiwes told detectives that he had consumed his victim with a bottle of South African red wine, had got out his best cutlery and decorated his dinner table with candles. He tasted of pork, he added.

The unprecedented case has proved problematic for German lawyers who discovered that cannibalism is not illegal in Germany.

Instead, they have charged Meiwes with murder for the purposes of sexual pleasure and with "disturbing the peace of the dead".

The accused, however, has a unique defence: that his victim actually agreed to be killed and eaten.

Crucial to the case is a gruesome videotape made by Meiwes of the entire evening, during which Brandes apparently makes clear his consent.

Before setting off on his one-way journey to Rotenburg, Brandes was, outwardly at least, a successful, financially secure professional, with a live-in girlfriend.

The girlfriend, Bettina L, told German TV that she had enjoyed a healthy sex life with Brandes but they had split up after he revealed that he also liked men.

In fact, prosecutors said yesterday, Brandes was suffering from a severe psychiatric disorder and "a strong desire for self-destruction".

After killing Brandes, the German cannibal met five other men who responded to his internet advert, including one from London.

He did not, however, kill them. In July 2001 a student stumbled on Meiwes' chat-room and alerted the German authorities, who arrested him last December.

Yesterday Meiwes told the court that he had felt lonely and neglected as a child after his father walked out on the family. He had fantasised about having a blond "younger brother", who he could keep forever by "consuming him".

If convicted, Meiwes faces life in prison. A verdict is due early next year. The cannibal's defence team, however, say that Meiwes is guilty at worst of 'killing on demand', which is punishable by five years in jail. In his pre-trial interview, the cannibal said that after eating Brandes he felt much better and more stable.

Brandes spoke good English, he said, and since eating him his English had improved. He also revealed that he is now writing his memoirs. The trial, which is due to last three weeks, continues.
