Duo escapes gallows after split apex court decision on chain of custody of seized heroin

SINGAPORE - Two men, originally sentenced to hang for heroin trafficking, were cleared on Wednesday (Dec 5) after a split decision by the Court of Appeal, with two of the three judges pointing to inconsistencies in how the seized drugs were handled after the arrest.

In acquitting Mohamed Affandi Rosli and Mohamad Fadzli Ahmad of trafficking 132.82g of heroin, Chief Justice Sundaresh Menon and Senior Judge Chao Hick Tin said the prosecution had failed to establish the chain of custody of the exhibits.

Hanging them won't stop the demand for drugs. This isn't a supply side issue; the war on drugs has lasted decades and hundreds (maybe thousands since independence) have been hanged. Yet here we are today.

Kudos to the judges for taking the strictest possible interpretation of the law before depriving anyone of their lives. It is not a trivial matter that the evidence could have been mishandled in leading to a false conviction.

Likely their sentence will be at least 20 years behind bars with canning and that is a sufficiently strong deterrent. At the very least, one generation of children will face 2 less traffickers in their lifetime.

All in all, a satisfactory outcome.

I propose hard labor camp for both illegal drug users and peddlers alike, 25 and 30 years respectively without reprieve, regardless of age.
