上月發生長榮航空空服員遭乘客逼擦屁股事件,鬧得沸沸揚揚,事後桃園市勞動局針對長榮航空進行勞檢,並於日前發函認定長榮違反職安法。

長榮航空企業工會今(18日)於臉書發文,表示上月19日發生的BR15長榮空服員被乘客逼擦屁股事件,繼工會陪同當事人辦理記者會說明後,桃園市勞動局也在上月22日對長榮進行勞檢。
勞動局日前發函,表示因長榮「未有預防勞工於執行勤務(機艙內作業)遭受不法侵害之暴力預防措施,已認定長榮航空違反職業安全衛生設施規則第324-3條,以及職業安全衛生法第6條。」

工會呼籲長榮航空盡速改善,針對此案及被不當約談的當事人給予事後補救與支持,並依醫囑給予公傷假,並強調既然勞動部已公開表示雇主有權認定,長榮應當硬起來保護員工,別再推拖。
對此,長榮航空表示,「本公司對於空服員在機上作業已製作『職安衛作業風險評估表』,鑑別出有職場不法侵害之風險,唯未涵蓋『職場不法侵害預防之危害辨識及風險評估表』,經勞檢員認為尚有未詳盡之處,目前已著手進行相關改進措施。」
職業安全衛生設施規則 第324-3條
雇主為預防勞工於執行職務,因他人行為致遭受身體或精神上不法侵害,應採取下列暴力預防措施,作成執行紀錄並留存三年:
  1. 辨識及評估危害。
  2. 適當配置作業場所。
  3. 依工作適性適當調整人力。
  4. 建構行為規範。
  5. 辦理危害預防及溝通技巧訓練。
  6. 建立事件之處理程序。
  7. 執行成效之評估及改善。
  8. 其他有關安全衛生事項。
前項暴力預防措施,事業單位勞工人數達一百人以上者,雇主應依勞工執行職務之風險特性,參照中央主管機關公告之相關指引,訂定執行職務遭受不法侵害預防計畫,並據以執行;於僱用勞工人數未達一百人者,得以執行紀錄或文件代替。

職業安全衛生法 第6條
雇主對下列事項應有符合規定之必要安全衛生設備及措施:
  1. 防止機械、設備或器具等引起之危害。
  2. 防止爆炸性或發火性等物質引起之危害。
  3. 防止電、熱或其他之能引起之危害。
  4. 防止採石、採掘、裝卸、搬運、堆積或採伐等作業中引起之危害。
  5. 防止有墜落、物體飛落或崩塌等之虞之作業場所引起之危害。
  6. 防止高壓氣體引起之危害。
  7. 防止原料、材料、氣體、蒸氣、粉塵、溶劑、化學品、含毒性物質或缺氧空氣等引起之危害。
  8. 防止輻射、高溫、低溫、超音波、噪音、振動或異常氣壓等引起之危害。
  9. 防止監視儀表或精密作業等引起之危害。
  10. 防止廢氣、廢液或殘渣等廢棄物引起之危害。
  11. 防止水患或火災等引起之危害。
  12. 防止動物、植物或微生物等引起之危害。
  13. 防止通道、地板或階梯等引起之危害。
  14. 防止未採取充足通風、採光、照明、保溫或防濕等引起之危害。
雇主對下列事項,應妥為規劃及採取必要之安全衛生措施:
  1. 重複性作業等促發肌肉骨骼疾病之預防。
  2. 輪班、夜間工作、長時間工作等異常工作負荷促發疾病之預防。
  3. 執行職務因他人行為遭受身體或精神不法侵害之預防。
  4. 避難、急救、休息或其他為保護勞工身心健康之事項。
前二項必要之安全衛生設備與措施之標準及規則,由中央主管機關定之。

Last month, the flight attendant of Evergreen Air was forced to wipe the ass by the passengers. The Taoyuan City Labor Bureau conducted a labor inspection on Evergreen Air and issued a letter to the company to confirm that Evergreen violated the occupational safety law.


The EVA Air Enterprise Trade Union issued a letter on Facebook today (18th), indicating that the BR15 Evergreen flight attendant on the 19th of last month was forced to wipe the butt by the passengers. After the trade union accompanied the parties to explain the press conference, the Taoyuan Labor Bureau was also on the scene. On December 22, he conducted an inspection of Evergreen.

The Labor Bureau has issued a letter recently stating that Evergreen has "violated the precautionary measures against violence caused by unlawful infringement of labor in the cabin (in the cabin), and has determined that EVA Air violates Section 324-3 of the Occupational Safety and Health Facilities Regulations, and occupational safety and health. Article 6 of the Act."

The trade union appealed to Evergreen to improve as soon as possible, to provide remedies and support for the case and the parties who were improperly interviewed, and to give public injury leave according to the doctor's advice, and stressed that since the Ministry of Labor has publicly stated that the employer has the right to determine that Evergreen should harden to protect employees. Don't push it again.

In this regard, EVA Air said, "The company has created a "Evaluation of Occupational Safety and Health Work Risk Assessment" for flight attendants on the aircraft to identify the risk of unlawful infringement in the workplace, but does not cover the hazard identification of workplace unlawful infringement prevention. The risk assessment form, after the inspectors believe that there are still no detailed information, has begun to carry out relevant improvement measures."

Occupational Safety and Health Facilities Regulations 324-3

In order to prevent a worker from performing his duties and suffer physical or mental abuse due to the actions of others, the following violent precautions should be taken to make an execution record and remain for three years:

Identify and assess hazards.
Properly configure the workplace.
Adjust manpower appropriately according to work suitability.
Construct a code of conduct.
Handle hazard prevention and communication skills training.
Establish a handler for the event.
Perform evaluation and improvement of performance.
Other related safety and health matters.

For the precautionary measures for violence in the preceding paragraph, if the number of workers in a public institution is more than 100, the employer shall, in accordance with the risk characteristics of the employee performing his duties, refer to the relevant guidelines issued by the central competent authority, and formulate a plan for the prevention of illegal infringement of the execution of duties. If the number of employed workers is less than 100, they can be replaced by records or documents.

Occupational Safety and Health Law Article 6

Employers shall have the necessary safety and health equipment and measures in accordance with the following requirements:

Prevent damage caused by machinery, equipment or appliances.
Prevent damage caused by substances such as explosive or flammable substances.
Prevent damage caused by electricity, heat or other energy.
Prevent damage caused by quarrying, mining, loading, unloading, handling, accumulation or harvesting.
Prevent damage caused by workplaces that fall, objects, or collapse.
Prevent damage caused by high pressure gas.
Prevent damage from raw materials, materials, gases, vapors, dust, solvents, chemicals, toxic substances or oxygen-deficient air.
Prevent radiation, high temperature, low temperature, ultrasonic, noise, vibration or abnormal air pressure.
Prevent damage caused by monitoring instruments or precision work.
Prevent damage caused by waste such as exhaust gas, waste liquid or residue.
Prevent damage caused by flooding or fire.
Prevent damage caused by animals, plants or microorganisms.
Prevent damage caused by passages, floors or stairs.
Prevent damage caused by insufficient ventilation, lighting, lighting, insulation or moisture.

Employers should properly plan and take necessary safety and health measures for the following matters:

Repetitive work and other causes of prevention of musculoskeletal diseases.
Abnormal workloads such as shifts, night work, and long hours of work contribute to the prevention of disease.
Prevention of physical or mental abuse by a person's actions.
Refuge, first aid, rest or other matters to protect the physical and mental health of workers.

The standards and rules for the first two necessary safety and health equipment and measures shall be determined by the central competent authority.
