一名張姓男子22年前出境到大陸，直到兩年前回來，卻被機場攔下無法入境，這才發現自己5年前就被聲請了「死亡宣告」，妻子還將張男房子遷到自己名下，並聲稱是他贈與的。張男一狀告上法院，妻子卻爆料，他當時離開台灣是因為性侵被判刑所以逃避刑責，不過法官認為這和房子轉移一事無關，並根據缺乏張男承諾贈與的證據，判妻子敗訴。

判決書指出，張男86年出境到大陸，但妻子就在87年就將房產以贈與名義轉到自己名下，更誇張的是，雖然2人一直保有聯繫，張男也固定從大陸匯生活費給妻小，但5年前妻子竟慫恿兒子到法院幫張男聲請死亡宣告，法院也裁定獲准。
張男被蒙在鼓裡，直到2年前要入境台灣遭拒才發現，他急忙向法院申請撤銷死亡宣告，沒想到又發現房地產也已轉到妻子名下，還是「贈與」名義，於是提起訴訟。妻子在法庭上表示張男是因為25年前犯下性侵案遭判6年，為了躲避刑責潛逃大陸，於是留下房子授權書，並且口頭告知會把房產贈與她。
不過法官考量授權書內並無提及房屋贈與，並且張男離境後數月房產才開始過戶，足以顯現是妻子盜蓋張男印章而非張男之意，判決妻子敗訴，房產所有權歸還張男所有。
