EU fines 11 airlines for air cargo cartel
Posted: 10 November 2010 0250 hrs

BRUSSELS: Europe's competition watchdog hit 11 airlines with nearly 800 million euros in fines on Tuesday for running a global cargo cartel that included Air France-KLM, British Airways and Japan Airlines.

"It is deplorable that so many major airlines coordinated their pricing to the detriment of European businesses and European consumers," said European competition commissioner Joaquin Almunia.

The fines, totalling 799.4 million euros (1.1 billion dollars), were slapped on airlines that span the globe, from Air Canada and LAN Chile in the Americas to Cathay Pacific Airways and Singapore Airlines in Asia and Qantas in Australia.

The 11 cargo carriers coordinated their action on surcharges for fuel and security without discounts over a six-year period, between December 1999 and February 2006, the European Commission said.

The cartel covered flights from, to and within the European Economic Area.

The Air France-KLM group was hit with the biggest fine, 310 million euros, of which 183 million euros was for Air France and 127 million euros for KLM. Martinair, which is owned by Air France, was fined 29.5 million euros.

Elsewhere in Europe, British Airways was ordered to pay 104 million euros, Scandinavia's SAS group was fined 70.2 million euros and Luxembourg's Cargolux will have to pay 79.9 million euros.

In Asia, Singapore Airlines was fined 74.8 million euros, Cathay was hit with 57.1 million euros and Japan Airlines will pay 35.7 million euros.

Air Canada must pay 21 million euros while Qantas and LAN Chile got the smallest fines, 8.9 million and 8.2 million euros, respectively.

Five airlines applied for a reduction in the fine, claiming they were unable to pay it, but the commission said none of them met the conditions.

Lufthansa and its subsidiary Swiss International Air Lines escaped a fine under the commission's leniency programme for being the first to provide information about the cartel.

The commission said it dropped charges against another 11 carriers and one consultancy firm which it did not name.

The cartel initially began with contacts between airlines to ensure that worldwide air freight carriers imposed a "flat rate surcharge per kilo for all shipments," the commission said.

The cooperation expanded with the introduction of a security surcharge. The companies refused to pay a commission on such surcharges to their clients, the regulator said.

"By refusing to pay a commission, the airlines ensured that surcharges did not become subject to competition through the granting of discounts to customers," the commission said.

So much for the clean image of Singapore.

PM Lee go Europe red face now.

EU itself is one cartel, camouflaged as one country. They have so many laws such as pollution standards, agricultural products involving GM, motor vehicles which monopolistic, Trust those European angmoh mafia. Even their elderly PM publicly got girlfriends.

SGD133 million, wow, did Temasek lose more or SIA lose more?

Another homegrown banditry organisation that shared their bounties amongst themselves but when caught, the whole peasantry have to pay for them.

Head they win, tail you lose... What else is new ?

HA! who cares! They are ripping the angmos off anyway

Really?, today they rip angmo off, tomorrow, it will be you. Reminds me of those restaurants that charge angmos one price and locals another price.

They came first for the Communists,
and I didn't speak up because I wasn't a Communist.

Then they came for the trade unionists,
and I didn't speak up because I wasn't a trade unionist.

Then they came for the Jews,
and I didn't speak up because I wasn't a Jew.

Then they came for me
and by that time no one was left to speak up.

Its not a cartel when even the members fight over the same laws and standards that anyone doing business with EU have to.

All this honest mistake mah. There will be no firings, no investigative journalism by the shit times, and life will go on. $133 million is sup sup when Ho jinx can lose $billions.

Please lah, Air France-KLM, British Airways and Japan Airlines, Air Canada, LAN Chile, Cathay Pacific Airways, Singapore Airlines and Qantas. This lists out any airline who is anybody in the airline industry (Only United is Missing). Singapore would be red faced if SIA were NOT on that list.

None of these countries say they got clean, corruption free, crime free environment, mah. Only S'pore claims it. So, the failure to live up to it by a govt. owned enterprise is directly impacting the S'pore reputation. Remember, Old Goat always position S'pore as 1 big company, hence the term Singapore Inc. If one subsidiary is dirty, the whole company looks bad.

Actually I see nothing wrong with what they are doing in the pure capitalist context. Unfortunately the bleeding heart liberals have created this stupid anti-trust anti-business law.

And really seriously, if SIA were not on that list I really WOULD worry because we were excluded from that cartel.

SIA has always been ripping off the locals.

If you buy an SIA ticket in Spore it's higher than if you buy from elsewhere. They are also very miserly in giving out those Kris flyer mileage is points.

The only difference is that the angmo are treated better than locals.

Airline Qantas executives risk up to 10 years in jail if they continue to engage in cartel price-fixing practices, Australia's competition watchdog said on Wednesday.

The European Commission announced earlier on Wednesday to fine Qantas and 10 other airlines one billion U.S. dollars for fixing air cargo prices.

The Commission has found Qantas, British Airways, Air France, Japan Airlines and seven other carriers co-ordinating action on surcharges for fuel and security between 1999 and 2006.

Qantas received one of the smallest fines, 12.27 million U.S. dollars, for its part in co-ordinating a cartel that covered flights within the European Economic Area.

A Qantas spokesman told ABC News that the airline has received official advice on the fine and is now examining the European Commission's decision.

Australian Competition and Consumer Commission (ACCC) chairman Graeme Samuel said that from July 2009, the ACCC viewed serious cartel conduct as criminal, and could push for jail terms of up to 10 years and fines of 10 million U.S. dollars or more.

"You'd have to be a really stupid executive to be involved in cartel activity after July last year," Samuel told ABC TV on Wednesday. "The triple element of that now applies is that if you engage in this sort of activity, don't worry about reputations and don't worry about fines, you now face 10 years in jail."

It is not the first time Qantas has been hit for anti- competitive behavior. In 2007, the airline was fined 40 million U. S. dollars for price fixing in the North American Air Cargo market.

In 2008, Qantas agreed to pay a fine of 20 million U.S. dollars under a deal reached with the ACCC over the same price-fixing cartel.

What is it that's awaiting those SIA executives ? Brickbats/bouquets or jail times for this sanctioned/unsanctioned fraud/crime or since this is classed as misdeamours by the MIWs, all will be sweep under rhe carpet ?

The GLCs are the licenced robber barons of our time but somehow, with a bit of protection from you know who, all will escape unscathed.History has proven that.

You people are imbeciles. If there is a cartel of who's who's who in the airline industry, you better be very very worried if SQ is not invited to that cartel. I rather SQ pay the fine than be excluded from that cartel.

In any crime there are victims & victimisers.

Look at the recent price increase in electricity & public fare.
GLC=2(Victimiser), lesser mortals=zero(Victims) & we continue paying extra until the next hike.
