I have a Lexus with an anti-collision safety system with sensors to detect potential frontal collisions. If a collision is likely, the system automatically applies the brakes, tighten seatbelts and prepares the braking system.
 
I am inclined to believe the umbrella blocked the driver's view. How was the driver to know there's a person behind the umbrella?? It could've been the wind that blew it across the road.
It may be a Penguin and not a person behind the umbrella.
