Sexual penetration of a corpse

377.—(1) Any man who penetrates, with his penis, the vagina, anus or mouth, as the case may be, of a human corpse, shall be guilty of an offence.

(2) A man who is guilty of an offence under subsection (1) shall be punished with imprisonment for a term which may extend to 5 years, or with fine, or with both.

(3) Any person (A) who causes any man (B) to penetrate with B’s penis, the vagina, anus or mouth, as the case may be, of a human corpse, shall be guilty of an offence if B did not consent to the penetration.

(4) A person who is guilty of an offence under subsection (3) shall be punished with imprisonment for a term which may extend to 20 years, and shall also be liable to fine or to caning.

SARAWAK, Malaysia – The body of a 15-year-old girl was stripped of her clothes and raped after it had been buried for three days.

The corpse was found naked, with the deceased’s green shirt, black pants and underwear discarded on the ground beside of the grave.

The assailant had replaced the lid of the coffin and then buried it again.

Chinese daily Lianhe Wanbao reported that the corpse was discovered by her family members after they went back to the grave three days after the burial.

They were shocked to find the body lying naked outside the coffin. The family hurriedly re-buried her.

According to Lianhe Wanbao, this is the first time such an incident has happened in the area. The case is still under police investigation.

The girl had died of an illness.

Not a solo act

The district chief for the area said the assailant may have other motives for committing this crime.

Lianhe Wanbao reported him as saying that the entire incident looked very organised and was not something that could be executed by one person.

Residents in the area speculated as to what could be the cause of the incident. However, none of the rumours were confirmed as the girl’s family did not accept any interviews.

A 33-year-old Bangladeshi morgue worker accused of raping a dead woman denied he committed the crime, saying he only wanted to see the corpse’s genitals at the Devil’s request, a newspaper reported on Sunday.

A Saudi employee at a government hospital in the western town of Makkah caught the Bangladeshi with the naked dead woman inside the morgue last week and told the hospital management that the worker was raping the corpse.

“The worker told police that he did not rape the corpse but that he took the sheets off her and caressed the body out of curiosity,” Sabq Arabic language daily said.

“He confessed to his crime but denied that he raped the dead woman…he said the Devil was there when he did so and pleaded for forgiveness.”

Man convicted over raping corpse

A man was jailed for life today for killing his teenage neighbour and having sex with her body in a crime described by a judge as horrible and depraved.

Colin John Richardson, 36, pleaded guilty in the Supreme Court in Brisbane to murder and indecently interfering with a corpse between October 20 and 28, 2001.

His victim, Claire Franklin, was an 18-year-old from Noosa on the Sunshine Coast who had moved into a block of units at inner city South Brisbane so she could be close to TAFE to complete a hospitality course.

Richardson lived in a unit next-door.

A few weeks before the killing, Ms Franklin was plagued by a series of bizarre incidents including her radio inexplicably being on when she woke up, lit candles appearing in her flat, and finding her things had been moved every time she came home.

The court was told she had the locks changed, but shortly afterwards she was killed.

When police went to interview Richardson about Ms Franklin's disappearance, they found her partially clothed body decomposing on his bed with a gag in her mouth and a ligature around her neck.

Richardson's story to a psychiatrist was that he accidentally ran over her cat and that he had told her he'd strangled it to put it out of its misery.

He said Ms Franklin reacted by becoming hysterical, and to silence her screaming he strangled her to death, then hours later had sex with her cold, stiff body.

Justice James Douglas in sentencing Richardson to mandatory life imprisonment, described the killing as one full of horror.

MARIA AURORA, Aurora, Philippines – Police are fielding two witnesses against three suspected necrophiles who allegedly dug up the rotten corpse of a pretty teenaged girl and allegedly raped her inside a cemetery here last February.

Chief Inspector Michael Amio, police station commander, said a 40-year-old and a cemetery worker will be among the witnesses in the cases they filed against Rey Mark Regero, one John Does and one Peter Does. The three are still at large.

The three were tagged as the ones who dug up the corpse of the 15-year-old victim inside the public cemetery in Barangay 01 and sexually abused her last Feb. 20.

The incident has left Aurorans horrified and outraged, wondering how living people could carry out the act of raping a dead person who was buried for more than a week already.

The victim’s 57-year-old father filed the complaint before police which in turn filed the information for desecration of the dead and malicious mischief before the provincial prosecutor’s office in Baler town for the act constituting necrophilia, the act of having erotic attraction to corpses.

The victim, described as ravishing and with many suitors when she was still alive, died when a speeding motorcycle ran her over in Barangay San Jose last Feb. 3. After a nine-day wake, she was finally buried at the cemetery on Feb. 12.

The cemetery worker, in his affidavit to police, said he saw the three suspects on three consecutive days while roaming around the cemetery on Feb. 18, 19 and 20 looking at the tombs as if searching for something.

He said that on Feb. 21, he went to the police station to seek cash advance from a policeman who was his boss when he learned about the reported forcible destruction of a tomb wherein the naked corpse of a girl was pulled out.

He said he then recalled his encounter with Regero who he positively identified in a police line-up and his two other companions days before the incident.

PO3 Angelo Gawat, investigator of the local police, said Dr. Roman Balangue said the dead victim may have been raped after examining her private parts.

When the victim’s cadaver was found, it was decomposing fast and worms could be seen around it.

The woman witness said she saw Regero hitting the tomb containing the victim’s corpse with a piece of rock.

Singapore actor Lim Yu Beng has joined the growing chorus of netizens condemning recent pleas by two church pastors against the repeal of Section 377A in Singapore.

"To put it simply, Pastor Khong wants it illegal to be homosexual in Singapore. My point is this. Nobody is making it compulsory for him to be gay. Why should he make it compulsory for others to be straight?," he said in a Facebook post on Sunday.
The respected veteran stage and film actor said he was not questioning the Pastor's beliefs but rather "his right to impose those interpretations on others through legislation".
Lim's comments come amid a growing and bitter debate in the past week over Senior Pastor Lawrence Khong's plea to the government not to overturn Section 377A, which criminalises sex between consenting gay men.

Khong, of Faith Community Baptist Church, called the repeal of the statute "a looming threat to the basic building block (of family) by homosexual activists".

In front of a congregation last weekend that included ESM Goh Chok Tong, who happened to be passing by the church during his regular Marine Parade walkabout, Khong urged the government to provide "moral leadership" and to "protect constitutional rights to free speech and religious liberty"

Another more strident Facebook post by Pastor Yang Tuck Yoong of Cornerstone Community Church came out on Saturday in support of Pastor Khong. In it, he called for the church to "get herself into battle-footing, and be battle-ready."

"This war is winnable and the church will arise victorious... Be ready for a sharp polarising of our society over the gay and lesbian issue and when it happens, you better make sure you know which side you are on," he added.

Thaddaeus Wee, who studies postgraduate law at Singapore Management University is among those who took issue with Pastor Khong's "questionable statements".

Similar to how adultery or single mothers or childless married couples went against the idea of a "traditional" family unit, he asked in a Facebook post why gay relationships were deserving of any special attention.

Gay pastor Reverend Miak Siew, executive pastor of Singapore's Free Community Church, also said in a Facebook post Pastor Khong's statements only served to stigmatise the gay and lesbian community.

"The repeal of 377A poses no threat to families bound together by love... you have placed obstacles in how parents understand their children who are different, and create huge rifts in these families," he said.

Heated debate since 2007

A heated debate on the issue began in 2007, when then Member of Parliament Siew Kum Hong filed a petition to repeal Section 377A, which he cited as discriminatory and a violation of constitutional safeguards on equal rights.

However, then-Senior Minister of State for Law and Home Affairs Ho Peng Kee shot down the petition, highlighting that Singapore is a conservative society and “majority of [Singaporeans may] find homosexual behaviour offensive and unacceptable”.

“While homosexuals have a place in society… repealing Section 377A will be contentious and may send a wrong signal that the government is encouraging and endorsing the homosexual lifestyle as part of our mainstream way of life,” an AFP report quoted Ho as saying at the time.

An appeal to challenge Section 377A will be heard in court on February 14 and was filed after two men who have been partners for 15 years said the law entrenches “stigma and discrimination against lesbian, gay, transgender and bisexual people in society”.

A second and separate appeal has also been filed by a man who was arrested in March 2010 for having oral sex with another man at a public toilet in CityLink Mall.
