Singapore’s jurisprudence of political defamation and its triple-whammy impact on political speech


Singapore’s governing People’s Action Party (PAP) leadership has always been sensitive towards political criticism. Singapore has a highly sophisticated legal framework that imposes close and strict regulation on the local press and media system. The foreign media is also subject to considerable political control. Informal “out-of-bounds (OB) markers” had been mentioned and reported in the local press, in an attempt to give some clarity to the boundary of what the Singapore political leadership considered to be legitimate political criticism.




There have been consistent criticisms that the frequent use of defamation actions by the Singapore political leadership against opposition leaders and newspapers has the effect of silencing political dissent from within or without. It has been argued that this trend of political defamation actions is a violation of the fundamental constitutional right to freely hold and peacefully express one’s political opinions, and that it amounts to severe restrictions on freedom of expression that cannot be justified under international standards, seriously compromising the fundamental right to make political expression freely in public without fear of reprisal.

Contrast is comical. Yet when it came to a couple of drunk Indians, they withdrew and waited for the jammed radio sets to be freed up. That couple of Indians turned into over 100 rioting Indians.

Prof Tey Tsun Hang clearly mentioned in the book that Roy Ngerng and M Ravi will loss their case if this defamation case is officially brought to the court:

The success rate is overwhelming - no leader of the PAP, the ruling political party since 1959, has ever lost a defamation action against an opposition leader in Singapore courts, and no foreign publisher has ever successfully defended a defamation action brought by governing Singapore political leader in Singapore courts.

if this case is brought to the court, most likely Roy Ngerng will be bankrupted based on Prof Tey Tsun Hang article.

Very heavy awards of damages have been made. In a number of cases, as a result of failing to pay these hefty damages, enforcement proceedings were taken out, resulting in highly publicised successful bankruptcy proceedings against certain prominent opposition leaders.

Prof Tey Tsun Hang also argued that Bankruptcy Law has been raped and abused in Singapore.


This has in turn attracted criticism that it constituted an abuse of the bankruptcy law for political purposes.

When the name LHL is mentioned does it represent the PAP, government, CPF or him? This defamation suit has to spell out what LHL represents? Himself, CPF or the government?

In CHC case, the directors of CHC can decide to sue as a company but not on their personal name?

In CSJ case, was the government or PAP party or LKY himself sue him?

Dr Ping Tjin Tham condemned detention without trial and believes the conspiracy behind Operation ColdStorage and today he also condemning politically motivated defamation by PM Lee Hsien Loong.

I hope Dr Ping professorship will not be terminated and following the footstep of Prof Cherian George, Prof Tey and Prof Michael Hor who are not welcomed by both NUS and NTU and they were forced to seek professorship in Hong Kong University which value academic freedom.
