Redditer: Need honest take on insurer's assessment

I was driving at within building's speed limit. After spotting the other car, I immediate brake to a stop but the other party couldn't and collided with me.

I had to pay my own towing due to license plate dropped and lost of use for 4 days. Dealer recommend that I claim own damage first to reduce downtime as he mentioned that I was not at fault and will be made whole without penalty.

Few day's later, my insurer's surveyor mentioned that "We have concluded that both parties are liable for the accident thus the excess amount is $500." I'm still pursuing for more reasoning into that judgement.

Question: How was I at fault and was this preventable (aside from teleportation)? If my insurer insist on the excess, what are my options?
