Man abused stepdaughter after release from jail for raping niece

SINGAPORE — He was sentenced to 24 years’ jail and 24 strokes of the cane for the statutory rape of his 11-year-old niece and released from prison in 2016.
But about a year after his release, the man sexually abused his stepdaughter and her best friend who were aged between 12 and 13.
At the High Court on Thursday (12 March), the 58-year-old recalcitrant sex offender pleaded guilty to one charge of sexual penetration of a minor and two counts of aggravated molestation.
Six charges of sexual exploitation of a child, five counts of aggravated molestation and another charge of sexual penetration of a minor will be considered when he is sentenced, pending a report on his suitability for preventive detention.
The prosecution is seeking the maximum 20 years of preventive detention for the culprit whom it called a “menace to society” and a “sexual predator who poses an imminent danger to adolescent females”.
“It is imperative that the accused be removed from society for a substantial period of time. His recalcitrance, high risk of reoffending, and sheer inability to control his sexual urges underscores the immediate need to take him out of circulation completely,” said Deputy Public Prosecutors Goh Yi Ling and M Kayal Pillay in their submissions.
Preventive detention, which lasts between seven and 20 years, is a sentencing option meant to protect the public from recalcitrant offenders, who must serve their jail terms in full with no remission for good behaviour.
The man cannot be named to protect the identities of his victims.
Victim’s mother believed culprit had changed
The man was jailed in 2001 for the statutory rape of his niece and released early from prison in 2016 due to good behaviour. In early 2017, he married a divorcee and moved in with her. She was aware of his previous conviction, but believed that he had changed, the court heard. He worked in a factory.
The woman’s young daughter initially stayed with her biological father but she later moved in with her mother and stepfather sometime in 2017. The daughter was close to the stepfather and her mother did not impose any restrictions on him being alone with the girl.
In February 2018, the man started groping the girl at home. “These initial acts included resting his palm against the side of (the victim’s) breast over her clothes. This escalated over the next two months to squeezing (her) breast and rubbing her vagina over her clothes,” said DPP Goh.
“The accused continued touching (the victim) in this manner until September 2018, when he decided to slip his hand into (her) underwear and rub the outside of (her) vagina, skin-on-skin,” the prosecutor added.
The perpetrator continued to sexually abuse the victim even after they shifted to a new home in November 2018. On one occasion the next month, he held on to her right breast, licked and bit her nipple, and kissed her on the lips. After the incident, the culprit also digitally penetrated the victim on two successive occasions while she was sleeping.
Most of the incidents took place while the victim’s mother was home, the court heard. “The accused would seize opportunities when (the victim’s mother) was not looking or busy doing something else, to commit the offences against (the victim),” said DPP Goh.
Molested stepdaughter’s best friend
On two occasions in 2018, the perpetrator also groped the victim’s best friend, who would often visit her and referred to him as “papa”. The culprit molested the second victim whilst his stepdaughter wasn’t around or was asleep.
On one of the occasions, he offered the second victim a ride on his e-scooter and then slipped his hand into her shirt and touched her breast. He also touched her vagina, over her clothes, using his other hand.
Shocked, the second victim wriggled free from the perpetrator’s grip and walked back to her friend’s house. The second victim didn’t visit her friend for a period thereafter to avoid the culprit.
Offences come to light
In January last year, the first victim’s mother thought that she was dating someone and told her that she would bring her to the hospital to check her virginity, the court heard.
Afraid, the girl confided in a neighbour about how the culprit had touched her. The neighbour then told the girl’s mother about the matter and the latter confronted the perpetrator.
Afterwards, the girl went to stay with her biological father. He found text messages which she had sent to a friend about the culprit touching her private parts and her father then brought her to a neighbourhood police centre to make a report.
During police investigations, officers discovered that the perpetrator had also molested the girl’s best friend.
The girl knew that what the culprit did to her was wrong but didn’t tell anyone about it as she wanted her mother to be “happy”, the court heard. “She feared that disclosing the accused’s acts would cause (her mother) to become upset; hence she kept these incidents to herself,” said DPP Goh.
When interviewed by a government psychiatrist, the perpetrator said he had only touched the first victim in December 2018 after she seduced him by taking off her shirt and exposing her breasts.
The culprit was assessed by the psychiatrist to have a high risk of reoffending.
The punishment for sexual penetration of a minor below 14 is a jail term of between eight and 20 years, along with at least 12 strokes of the cane.
The maximum penalty for using criminal force to outrage the modesty of a minor under 14 is up to five years’ jail along with a fine and caning.
Only male offenders below 50 can be caned.

SINGAPORE — He was a father figure to a pair of sisters who addressed him as “bapak”, which means father in Malay.
But instead of caring for them, he took advantage of their naivety and sexually abused both girls when they were as young as nine.
His crimes only came to light six years after they began, after the older 16-year-old victim - who had been abused over a four-year period - was placed in a shelter, having displayed suicidal tendencies.
At the High Court on Wednesday (14 August), the perpetrator, who is now 59, was jailed for 23 years.
The sentence includes a one-year jail term that was meted out in lieu of 12 strokes of the cane. Only male offenders below 50 are liable for caning.
The Singaporean man, who cannot be named to protect the victims’ identities, had earlier pleaded guilty to three charges of sexual assault by penetration.
Seven other counts - two of sexual assault by penetration and five of molestation - were considered in sentencing.
In handing down the sentence on Wednesday, Justice Pang Khang Chau agreed with the prosecution that it was not “crushing”.
With a possible one-third reduction of jail time due to good behaviour in prison, and with the sentence backdated to the date of his remand on 23 June 2017, the man could walk out of prison when he is 72, noted the judge.
Close family friend
At the time of the offences, which were committed from 2011 to 2015, the man was between 51 and 55. He resided in Malaysia and travelled frequently to Singapore to do odd jobs. He got to know the victims’ father about 20 years ago and they became close friends who often met to talk about their lives and religion.
The victims’ father felt that the man had good business acumen and asked the latter for financial help. He also asked the man to help look after his family when he was remanded in prison, the court heard.
After the perpetrator divorced his wife in 2011, he began to stay overnight at the victims’ home on weekends. He also used the HDB flat as his mailing address.
The man would sleep in the same bedroom as the victims, on a mattress between both girls. He was so close to the victims that he would often hug them and shower them with attention and gifts.
The older sister felt that the man treated her better than her parents. She would confide in him about problems she encountered in school and he would listen and offer her advice.
The victims’ father also felt that the man treated the girls like his own daughters.
On weekends, the man would bring the victims’ family on outings and treat them to meals. But after the outings, he would ask the sisters to individually accompany him to park his car at a multi-storey car park. He would then sexually assault the victims in the car and the lift before they returned to the flat.
Abused older sister
One night in 2011, when the younger sister was asleep in the bedroom, the man told the older sister, who was 9, to kiss his lips. Thinking it was a normal way of showing affection, she complied.
He then asked her to suck his nipples, before he touched her body over her clothes and directed her to perform oral sex on him.
On another night in early 2015, as the younger sister slept, the man groped the older sister’s breasts over her clothes and again made her perform oral sex on him.
After the incident, the victim, who was then 13, tried to tell her parents about the sexual acts. But her parents didn’t act on the information as they didn’t understand what she was trying to tell them.
Abused younger sister
On one night in 2013, after a family outing, the man asked the younger sister to follow him as he parked his car. She sat in his front passenger seat.
After he had parked the car on the top floor of the deserted car park, the man leaned over, hugged the girl, who was between 9 and 10, and kissed her lips.
She didn’t resist as she regarded him as a father figure and thought that he was just showing her affection.
He then reached under her clothes, touched her breasts and told her that they were growing. He also directed her to perform oral sex on him.
Afterwards, the man warned the girl not to tell anyone about what happened, or else he would stop visiting her family. She agreed not to tell anyone as she wanted him to continue spending time with her and her family.

Crimes come to light
In 2015, the older sister, who was in Secondary 2, attended a science lesson and learnt about sexual offences involving victims under 16. She realised that what the man had been doing to her was wrong.
She told her boyfriend about the incidents and he advised her to make a police report. But she didn’t do so as she was afraid of what would happen to the perpetrator.
In mid-2017, the girl was placed in a shelter as she displayed suicidal tendencies. She revealed the sexual abuse to Child Protection Officer from the Ministry of Social and Family Development and a police report was made.
The abuse against the younger sister came to light in the course of police investigations.
The punishment for sexual assault by penetration of a minor under 14 is a mandatory jail term of between eight and 20 years, with a minimum of 12 strokes of the cane.

SINGAPORE — An elderly man allegedly asked his then step-daughter for permission to commit an indecent act. When she protested, asking how he could do that when he was married to her mother, he apparently told the teenager that her mother’s breasts were small.

The pest control technician, who is now 71, has claimed trial in the State Courts on one count of insulting the then Secondary 3 student’s modesty over the incident, which was alleged to have occurred on June 21, 2017. He cannot be named to protect the identity of his alleged victim, who is no longer his step-daughter.

His charge sheet stated that he had insulted the modesty of the girl by telling her in Malay: “Daddy dreamt about you last night”, “please lah, daddy cannot control it”, “mama’s breasts are small, daddy doesn’t feel satisfied” and also describing the act he wanted to commit.

The girl’s mother, a former hawker stall assistant who married the accused in 2013 and divorced him in 2019, was the first to take the stand to testify in the trial on Wednesday (Feb 5).

The housewife said that the incident happened at their Woodlands flat at night when she was out delivering wedding invitations on behalf of her brother whose child was getting married.

When she returned home that night, she recalled that her daughter told her: “Mama, I am scared. (The accused) came to my room and wanted to suck my nipple.”

The mother told the court that she then tried to calm her daughter, asked her if she was “really very sure” of what he had done, and told her to be patient because she would “find some ways to rectify” the matter, such as living elsewhere.

Ten minutes after their 20-minute conversation, she said that she questioned her then-husband, who reacted: “You believe her? Whatever your daughter said?”

He then barged into his step-daughter’s room and scolded her with vulgarities, as well as calling her “rude” while the teenager kept quiet.

His ex-wife testified: “He did not admit (to his alleged conduct). He said he didn’t do (what he was accused of)... When I pressured him, he said he was just fooling around.”

The matter blew over at that time, as the mother did not make a police report.

When Deputy Public Prosecutor Kevin Ho asked why she did not involve the police, she said that she did not want to disrupt her daughter’s studies as she was taking many exam papers at that time.

She then clarified that her daughter was taking religious classes since it was the June school holidays. The tests were conducted after the religious lessons.

When defence lawyer Ng Kwong Loong was cross-examining her, he asked if religious lessons were more important to her than her daughter’s safety. In response, she said: “Of course it is (my daughter’s) safety.”

The police learnt of the alleged incident only in 2018 in the course of investigating a complaint by the mother alleging that the accused man had physically abused her.

In 2015, she also accused him of abusing her, which resulted in her leaving the house as she applied for a personal protection order against him. After that, she returned home to give him another chance.

As part of the 2018 investigations, the police interviewed her daughter, son and brother.

Her daughter’s interview lasted about two hours, and the mother said that she found out afterwards that the daughter had told the police about the incident of the indecent request.

The ex-wife said that the accused later tried to persuade her to withdraw the case, thinking that she was the one who had filed the police report.

He had even told her what to say, suggesting that she say she was jealous of him for taking a woman home. She did not elaborate on that incident.

The court also heard that the mother had never really grown comfortable with her then-husband’s behaviour around her daughter.

“If it was not of utmost importance, I would not go out and leave my daughter alone with (the accused),” she said. “I didn’t want anything bad or unpleasant to happen between my husband and my daughter because they were step-daughter and father.”

She also noticed that there was something strange about him, in that he would knock on the door whenever her daughter was taking a shower and would not allow her daughter to close her bedroom door even if the girl was alone in the bedroom, she said.

“I know my husband. He is fond of watching some pornography on his phone,” she added.

If convicted of insulting his step-daughter’s modesty, the accused could be jailed up to one year, fined, or both.

The trial continues.
