Man abused stepdaughter after release from jail for raping niece

SINGAPORE — He was sentenced to 24 years’ jail and 24 strokes of the cane for the statutory rape of his 11-year-old niece and released from prison in 2016.
But about a year after his release, the man sexually abused his stepdaughter and her best friend who were aged between 12 and 13.
At the High Court on Thursday (12 March), the 58-year-old recalcitrant sex offender pleaded guilty to one charge of sexual penetration of a minor and two counts of aggravated molestation.
Six charges of sexual exploitation of a child, five counts of aggravated molestation and another charge of sexual penetration of a minor will be considered when he is sentenced, pending a report on his suitability for preventive detention.
The prosecution is seeking the maximum 20 years of preventive detention for the culprit whom it called a “menace to society” and a “sexual predator who poses an imminent danger to adolescent females”.
“It is imperative that the accused be removed from society for a substantial period of time. His recalcitrance, high risk of reoffending, and sheer inability to control his sexual urges underscores the immediate need to take him out of circulation completely,” said Deputy Public Prosecutors Goh Yi Ling and M Kayal Pillay in their submissions.
Preventive detention, which lasts between seven and 20 years, is a sentencing option meant to protect the public from recalcitrant offenders, who must serve their jail terms in full with no remission for good behaviour.
The man cannot be named to protect the identities of his victims.
Victim’s mother believed culprit had changed
The man was jailed in 2001 for the statutory rape of his niece and released early from prison in 2016 due to good behaviour. In early 2017, he married a divorcee and moved in with her. She was aware of his previous conviction, but believed that he had changed, the court heard. He worked in a factory.
The woman’s young daughter initially stayed with her biological father but she later moved in with her mother and stepfather sometime in 2017. The daughter was close to the stepfather and her mother did not impose any restrictions on him being alone with the girl.
In February 2018, the man started groping the girl at home. “These initial acts included resting his palm against the side of (the victim’s) breast over her clothes. This escalated over the next two months to squeezing (her) breast and rubbing her vagina over her clothes,” said DPP Goh.
“The accused continued touching (the victim) in this manner until September 2018, when he decided to slip his hand into (her) underwear and rub the outside of (her) vagina, skin-on-skin,” the prosecutor added.
The perpetrator continued to sexually abuse the victim even after they shifted to a new home in November 2018. On one occasion the next month, he held on to her right breast, licked and bit her nipple, and kissed her on the lips. After the incident, the culprit also digitally penetrated the victim on two successive occasions while she was sleeping.
Most of the incidents took place while the victim’s mother was home, the court heard. “The accused would seize opportunities when (the victim’s mother) was not looking or busy doing something else, to commit the offences against (the victim),” said DPP Goh.
Molested stepdaughter’s best friend
On two occasions in 2018, the perpetrator also groped the victim’s best friend, who would often visit her and referred to him as “papa”. The culprit molested the second victim whilst his stepdaughter wasn’t around or was asleep.
On one of the occasions, he offered the second victim a ride on his e-scooter and then slipped his hand into her shirt and touched her breast. He also touched her vagina, over her clothes, using his other hand.
Shocked, the second victim wriggled free from the perpetrator’s grip and walked back to her friend’s house. The second victim didn’t visit her friend for a period thereafter to avoid the culprit.
Offences come to light
In January last year, the first victim’s mother thought that she was dating someone and told her that she would bring her to the hospital to check her virginity, the court heard.
Afraid, the girl confided in a neighbour about how the culprit had touched her. The neighbour then told the girl’s mother about the matter and the latter confronted the perpetrator.
Afterwards, the girl went to stay with her biological father. He found text messages which she had sent to a friend about the culprit touching her private parts and her father then brought her to a neighbourhood police centre to make a report.
During police investigations, officers discovered that the perpetrator had also molested the girl’s best friend.
The girl knew that what the culprit did to her was wrong but didn’t tell anyone about it as she wanted her mother to be “happy”, the court heard. “She feared that disclosing the accused’s acts would cause (her mother) to become upset; hence she kept these incidents to herself,” said DPP Goh.
When interviewed by a government psychiatrist, the perpetrator said he had only touched the first victim in December 2018 after she seduced him by taking off her shirt and exposing her breasts.
The culprit was assessed by the psychiatrist to have a high risk of reoffending.
The punishment for sexual penetration of a minor below 14 is a jail term of between eight and 20 years, along with at least 12 strokes of the cane.
The maximum penalty for using criminal force to outrage the modesty of a minor under 14 is up to five years’ jail along with a fine and caning.
Only male offenders below 50 can be caned.
