OpenNet commences legal action against Government

The consortium building Singapore's ultra fast broadband network, OpenNet, has commenced legal action against the Attorney-General's Chambers (AGC) and another party.

The Straits Times reported today that OpenNet is seeking a 'quashing order' from the Supreme Court in its originating summons.

A quashing order is usually sought when a party wants to void a directive given by an authority.

The AGC, the Government's principal legal adviser, confirmed with the English daily that it has ceased to be involved in the case.

However, it is not known who the other party is as court documents have not been updated since private hearings in February.

It is also not known what OpenNet is trying to nullify as court documents are sealed.

OpenNet did not comment when contacted about the pending court case.

The company is represented by Senior Counsel Tan Chee Meng of Wong Partnership, while the defendant is represented by Senior Counsel Cavinder Bull of Drew & Napier, court listings showed.

OpenNet has been under pressure lately for delays in connecting subscribers to the Next Generation Nationwide Broadband Network.

Subscribers have waited for up to six weeks before getting connecting.

According to The Straits Times, OpenNet also did not suggest a new quota after regulator Infocomm Development

Authority of Singapore (IDA) directed it to step up weekly installations from the current quota of 2,400.

IDA also brought forward its review of OpenNet's service contract by 18 months.

OpenNet points to SingTel, ISPs for its unsatisfactory performance
By Tan Weizhen, TODAY |
Posted: 08 May 2012 2250 hrs

SINGAPORE: In its first press conference held since a series of disputes and problems started more than a year ago, the consortium tasked to install and activate high-speed fibre broadband in Singapore today pointed to its dispute with key sub-contractor SingTel to explain its unsatisfactory performance.

OpenNet, which has been hit by installation delays and long wait times for customers, also blamed a lack of market information from internet service providers.

On Tuesday morning, chief executive Mr Khoo Chin Hean said that a dispute resolution process has been started with SingTel to seek some closure to disputes the two companies have been facing. He said that "some aspects of its performance" had been affected by the dispute.

In response to calls to engage more contractors to ease the crunch, Mr Khoo said OpenNet's relationship with SingTel might be damaged in doing so, and the "intricately connected" system may not provide such an ideal backdrop for different contractors.

Responding also to a court case the company initiated against the Government, he declined to comment on what it is about, except that it is not regarding the problems it had been embroiled in - namely activation capacity and installation quotas.

We have all seen how deaf the PAP can be unless there is a GE around the corner. With some companies they will only sit up & take notice if you threaten to sue them. Even LKY has used the courts to get people's attention & compliance:rolleyes:

I just had my fibre optic internet done at my house yesterday. The installation guy warned me that the network might be unstable. Thank goodness the speed was quite reliable.

This is very interesting. No details on OpenNet's "quashing order" but it sounds like they are going for something big
