Cop admits to computer misuse

A POLICE officer unlawfully accessed the police computer system to look for information on his missing Indonesian maid.

The maid, Ms Erma Pujiyatun, had reported to the police that her employer, station inspector Sheik Faisal Shaik Abdul Kader Ali, had molested her.

It turned out that the then 20-year-old maid had made a false report as her relationship with Shek Faisal soured. She was later given a stern warning in lieu of prosecution.

When Sheik Faisal realised that Ms Pujiyatun had not returned home since early morning on Nov 22, 2009, he went back to Bedok Police Division and used the computer system in a bid to trace the missing maid.

Sheaik Faisal, 35, who was the investigation officer of the arsenic case involving Fong Quay Sim, 69, admitted on Thursday to three of 14 counts of computer misuse that day. Fong has appealed against both the conviction and 12-month jail sentence. Sheik Faisal will be sentenced on July 8.

This is a classic every day tactic used by the police prosecution to turn the culprit into a state witness. In other previous cases, there were maids who had been jailed for making false reports. In this case, the maid is let off with just a warning.

The police want to nail their station inspector for computer misuse. Is this acceptable?

The decision to prosecute or administer a stern warning in lieu of court prosecution rests with the AGC through one of the DPP.

In this particular case, it is indeed very strange. You don't need any evidence from the maid to nail the mata mata. He would have left behind a trail of evidence to hang himself.

False reports and false statements are very common. Most accused persons will give false statements denying their involvement in an alleged crime. When the accused PG in court, no decision is taken to charge him/her with false statement - denial of offence.

When a false report leads to the arrest of an innocent party, the complainant is most likely to go to jail. For instance, a maid accuses her employer of assault but medical evidence concludes it was self-inflicted, the complainant goes to jail.

Yes, the above case is not the norm. Maybe some facts were not made known to the public for their consumption.
