Geopolitical boundaries had always been changing throughout human civilisation for the past few thousands years. If we go by historical basis as benchmark, there will be full of overlapping claims and where exactly do we draw the line? Ownership of land are broadly determined in 4 ways.

3. War and conquest
4. Through International arbitration.

The Sabah dispute falls under point no.2. The brits claimed that Sulu Sultan ceded Sabah to them and they in turn transferred the ownership of Sabah to the then newly formed Malaysia Federation. The Pinoy in order to have a case against Malaysia need to prove that Sabah was leased to the British and not ceded.
