Gardener who restrained and sexually assaulted maid at condo jailed 8 years, caned
SINGAPORE — After disposing a potted plant at a condominium garden, a domestic helper was returning to her unit when she was attacked by a gardener who was eyeing her.
The 26-year-old man, Islam Md Shariful, followed the 53-year-old Filipina and restrained her before sexually penetrating her in broad daylight.
Sentencing Islam to eight years’ jail and four strokes of the cane on Tuesday (4 February), District Judge (DJ) Marvin Bay described his case as a “deeply egregious violation of a hapless domestic worker.
“You had followed her, and forced yourself on her, restrained her and then sexually intruded into her private parts. Such brazen attacks cannot be condoned, and a deterrent sentenced is called for,” he added.
The Bangladeshi had on the same day admitted to one count of sexual assaulting the maid with his fingers. One count of molesting the maid, by groping her breast, was considered for his sentencing.
Islam worked as a gardener at the condominium in the east, where the maid also resided with her employer. She cannot be named to protect her identity.
On 30 October 2018, at about 11.25am, the maid left her unit to dispose of a potted plant at the condominium’s garden. She passed by Islam at the garden and said “hi” to him out of courtesy, as she knew him as the condominium’s gardener.
She then proceeded to the second floor to the garden. Islam followed her.
Minutes after accomplishing her task, the maid headed downstairs back to the unit with Islam trailing behind.
As the maid walked down the stairs, Islam hugged her from behind and groped her breasts. Struggling, the maid fell to the ground in a sitting position. Islam sat down behind her and grabbed her shoulders. He also locked her legs before touching her genitals over her clothing. He then sexually assaulted her while restraining her.
The maid screamed loudly and Islam released her. He stood and apologised to the maid, telling her not to report the incident to the police or the condominium management. The maid replied that she did not care and returned home. She later informed her employer, who called the police.
Islam was arrested on the same day.
The prosecution had sought at least eight years’ of jail and four strokes of the cane for Islam.
In a mitigation letter to the court, Islam cited financial circumstances of his family and expressed his desire to return to Bangladesh as soon as possible.
