Serious Jolovan case reflects govt lack of confidence

“Recalcitrant” is a very powerful word. Within it are suggestions of the authority wielded by the speaker and the flagrant deviance exhibited by the recipient.

“Recalcitrant” was the term used by the Singapore government against activist Jolovan Wham, when the Singapore police laid a litany of charges against him on 28 November, which ranged from conducting illegal protests and vandalism to refusal to sign his police statements.

Using a word does not necessarily make it true. However, most Singaporeans reading the news about the charges might already be inclined to think that the government is justified in dealing harshly with Wham. What a petulant child; he must be punished; how dare he disturb the peace and destroy public property; jail and fine; drain the swamp of dissidents; make Singapore great again!

Few would see the emperor standing naked in the corner, praying hard that no one would notice that all the strong paternalistic language can barely conceal his insecurity when dealing with uncertainly.

Now, whether you wish to judge Wham in the word or the spirit of the law, the final decision resides with three wise judges. But something has to be said about the government’s attitude shown thus

far.

“Why should peaceful protests be criminalised?” Wham was quoted as saying. “Why should anyone have to seek official permission to hold a Skype conversation? Are we giving the government too much power? These are important questions.”

Yes they are. But you are no longer in any position to ask them, Jolovan. You are now a dissident, outlaw, anarchist – because the government says it is so, and the people believe it is so. Or so it hopes.

The police – the “Everyday Guardians” that their advertising campaigns proudly proclaim – in highlighting Wham’s actions as egregious has not only side-lined him in the public eye, but done us all a disservice.

The blunt truth is that the government is used to doing this. For positions that it cannot win by reason, it forces a penalty goal with verbal violence. We have seen our leaders doing this to opposition politicians, activists and bloggers alike, who have invariably been called failures, rabble-rousers and the lunatic fringe.

The same applies to the causes that Wham happened to be championing when he allegedly broke the law. He organised and participated in events related to the Internal Security Act and the death penalty. The Singapore government has always been adamant about itself being right on these two issues. Marxist Conspirators, revolutionaries and drug peddlers must have their basic rights and dignity, even their lives, stripped away from them. And the government will do it again and again, for the security and prosperity of its citizens.

Yet in spite of its heroic righteousness, the government has never once sought to demolish Wham and what he stood for by doing what many have lauded it for: stick to the facts, apply logic and reason. To this day, the government has not provided concrete proof of the Marxist Conspiracy, or of the effectiveness of the death penalty in deterring drug-related offences.

The only possible conclusion: the government has nothing but words to justify itself with, and can only legitimise its own actions by delegitimising its opponents. When a champion becomes a criminal, he becomes the least capable in manifesting change. That is the harsh social reality that all of us are guilty of perpetrating.

Bold rhetoric reflects self-affirmation. But such self-affirmation only serves to demonstrate how unsure the government is about its own status in the public eye. True strength lies not in silencing your worst critics, but in confronting them head on.

So if you believe in having strong leaders in government, reject such rhetoric and win-by-silencing attitudes. The government should not be allowed to name-call in the hope of hiding behind someone else’s alleged faults.

The state grows stronger with accountability, and the Singapore government has yet to be accountable for the issues identified here: the indiscriminate detention of activists without demonstrable proof, the travesty wrought by the death penalty, and the right for citizens to seek change through unlimited peaceful protest.

It might be time for Wham to face the music, but so should the government.

- Teo Soh Lung and Geylang Catholic Centre for Foreign Workers
and now Jolovan who is with Migrant Workers" Centre

They have previously used the Communist Bogeyman such as Marxist Conspiracy but they will be laughed at if they used in this day and age.

What Jolovan needs to do is not to do silly things and focus on the good work he has been doing.

We all know that the PAP govt's immigration and foreign worker policy is big-time fucked up, but that's the fault of the PAP, not the foreign workers themselves. When these people come to our country and do the work we don't want to do and make our economy tick, the right thing to do – which is actually also self-serving – is treat them fairly, as you would any local-born worker. Hell, a happy worker is a good, productive worker!

(I've been one of most fervent critics of the foreign 'talent' policy here, for social and economic reasons, so am definitely not an apologist for the foreigners.)

Lots of abuses go on in the workplace. Employees repatriated forcefully without pay and adequate compensation, inhuman living conditions, occupational safety legislation not on a par with other developed nations, and more importantly, MOM's lack of adequate enforcement of existing legislation re reporting of workplace injuries.

Not just the employers and MOM, but the medical community is also complicit. Doctors grant only 3 days' (!) – or less – medical leave for work-related fractures – just so that the company doesn't need to make an accident report and risk a stop-work order (SWO). These companies also risk affecting their safety ratings and having their work permit quotas reduced, all of which impinge on their profit earnings. So the doctors (some of whom are on a retainer) work in collusion with employers to give less than 3 days' MC and 2 weeks of light duties to exploit the loopholes. The patients report to work swathed in plaster casts, still wonky from the general anaesthetic, prime candidates for another workplace injury.

These abuses have come to our knowledge through the good work done by TWC2, HealthServe, HOME and the many social work volunteers out there. As it stands 14 orthopaedic doctors are currently being investigated for granting inadequate sick leave to workers sustaining severe workplace injuries. Let's hope justice prevails.

Just so that we don't just associate – and hence condemn – social workers with migrant workers, remember that many of them, Jolovan included, work with other disadvantaged people, Singaporeans like you and me. The paedophile victims, the poor and homeless, sex trafficking victims, broken families ... I've volunteered with them before and trust me, it's a thankless, arduous task. They definitely deserve our high regard and support, not brickbats and derision.

There's a book written by a white American journalist – Black Like Me. He took a drug (methoxsalen) to make his skin very dark and then travelled through the deep South in the US to understand what it was like to be a black man in a white man's world. This was in 1959, when racial segregation was still legal in the South. This experience so transformed him that he went on to become an ardent advocate and activist for the Civil Rights Movement.

Once in a while we should climb over the fence, put ourselves in the other person's shoes, and see the world from the other side. Do it, and see what happens.

SINGAPORE - Civil rights activist Jolovan Wham has been issued a stern warning for the use of the Singapore and Malaysian flags at an event at Hong Lim Park that he had organised last year.

During the event on Nov 13, 2016, which was held in support of the Bersih 5 rally in Malaysia, 15 or so participants laid a Singapore flag and a Malaysian flag on mats. They also held the flags up and took photos with them.

In a Facebook post on Tuesday (Dec 5), Mr Wham, the former executive director of the Humanitarian Organisation for Migration Economics (Home), uploaded photos of a warning letter that he had received from the police, dated Nov 28 this year.


It said that investigations into three offences against him - allowing the national flag to touch the ground, displaying national emblems in public, and refusing to sign a statement - had been completed. While the police had made an assessment that he had committed the three offences, a decision had not been taken to prosecute him in court for the offence. "If you commit any offence in future, the same leniency may not be shown towards you," the letter added.

Under the National Emblems (Control of Display) Act, the public display of the national emblem of any country, including flags, is prohibited except by certain people, such as diplomats, and when an order is published in the Government Gazette to allow it.

Offenders can be fined up to $500 and jailed up to six months.


Under the Singapore Arms and Flag and National Anthem Act, a person in possession of the national flag is prohibited from allowing or causing the flag to touch the floor or ground, even when lowering the flag from a staff or flagpole. Offenders can be fined up to $1,000.

For refusing to sign a statement, offenders can be fined up to $2,500 and jailed up to three months.

On Nov 29, Mr Wham was charged in court for other alleged offences of organising public assemblies without permit, vandalism, as well as refusing to sign police statements. He faces seven charges in total.

In his post, Mr Wham also noted a new element in warning letters - they now come with a clarification on the back page stating, among other things, that the warning does not result in a criminal record, and does not affect the legal rights, interests or liabilities of the person being warned.

It is not clear when such clarifications were introduced to warning letters. When asked, police confirmed that changes have been made to the letter of warning but did not elaborate.

Mr Wham believes the clarifications were added as a result of a High Court case he mounted in late 2015 to quash a warning he received in March 2015. He was concerned that the stern warning would cause severe prejudice against him as it remained on record.

The High Court dismissed his bid, saying that such warnings have no legal effect on the recipient so there is nothing for it to quash.

Justice Woo Bih Li had ruled that such warnings are no more than an opinion of the relevant authority that the recipient has committed an offence.

"It does not bind the recipient," he added. "It does not and cannot amount to a legally binding pronouncement of guilt or finding of fact. Only a court of law has the power to make such a pronouncement or finding."

Said lawyer Chia Boon Teck, co-managing partner of Chia Wong LLP: “A warning spells the conclusion of investigations and the matter will not be re-opened if the individual commits another offence thereafter. The additional footnote (in warning letters) is a reassurance of this position.”
