香港入境处25岁的女职员孔颖琛涉嫌擅自登入香港入境处计算机系统,在网上对政府高官、警务人员、立法会议员、法官及其家人进行“起底”,于8月20日被捕。据香港“东网”报道,孔颖琛被控1项“公职人员行为失当罪”及5项“目的在于使本人或他人获益不诚实取用电脑罪”,案件今日(22日)在香港东区法院提堂。

控方表示,被告孔颖琛身为担任公职的人员,即入境事务处文书助理,在2019年12月至今年8月期间,在香港无合理辩解或理由而在执行公职的过程中,故意地做出不当行为,即主动或应其他身份不详的人以私人名义作出的要求,未获授权而取用特区政府入境事务处的计算机,过程中搜索及获取特定人物的个人资料,未获授权发放上述的个人资料。
她另被控于2019年12月23日、今年1月24日、今年5月6日、今年6月15日及今年8月4日,目的在于使她本人或他人获益,而五不诚实取用特区政府入境事务处的计算机。
据了解,孔颖琛未获授权登入入境处计算机系统逾100次,取用了225名人士的个人资料,事主包括政府高官、警务人员、立法会议员、区域法院法官、裁判官及他们的家人。被告将资料交给社交平台“起底”频道的管理员,让事主遭受网络欺凌及滋扰。
辩方替孔颖琛申请保释,但控方为防她告继续操控社交平台“起底”频道账户发放资料,或可能销毁证据、弃保潜逃,反对她保释,最终法官拒绝辩方保释的申请,须继续还押看管。案件押后至10月19日再审。

香港入境处称,入境处会按当值医生的专业判断,安排有需要的人士尽快送院诊断。对于有人指称入境处把相关人士强行送院及注射营养液,全属子虚乌有,并置有关人士的健康和生命安全于不顾。


8月12日晚,香港入境下曾就青山湾入境事务中心被传对拒绝领取膳食的被羁留人士作出“有违人权”的对待作出严正澄清,称绝无此事 。


21日晚,对于有人一再对入境处作出失实及不公平的指控,包括声称入境处人员以言语及肢体暴力,或其他不人道方式对待被羁留人士,并罔顾客观事实,漠视部分被羁留人士可能对香港社会构成严重治安风险而质疑入境处作出羁留决定的合法性,入境处深表遗憾并予以谴责。

入境事务处(入境处)今日(八月二十一日)再次回应个别媒体对青山湾入境事务中心(中心)的失实报道,并对此表示遗憾。


入境处重申,该处一直严格遵守《入境(被羁留者的待遇)令》(《待遇令》)(香港法例第115E章)的相关规定,以确保所有被羁留人士均获得妥善的待遇。


根据《待遇令》,所有被羁留在中心的人士均可获亲友探访。被羁留人士在探访期间可收取包括食物(例如朱古力及饼干)、生活用品、私人衣物及杂志等物资。中心亦必须为他们免费供应足够的食物。


至目前为止,有11名被羁留人士继续选择不领取由中心提供的膳食,但据入境处的纪录,他们有小部分曾短暂停止饮用中心提供的奶茶、牛奶及水,但现在已恢复领取饮料。入境处人员一直密切留意他们的健康状况,廿四小时当值的医护人员亦定时为他们作医学检查,包括每日量度体重及隔日进行血糖测试。他们大部份的血糖水平仍属正常,情绪大致稳定。


《待遇令》亦规定被羁留人士如诉称生病或受伤,须在中心得到充足的医疗护理。现时,中心的医疗服务是以外判合约形式,由一所独立的认可医疗机构提供,当值医生一直严格按照香港医务委员会有关的香港注册医生专业守则及其专业知识,为被羁留人士提供适切的医疗服务,包括处方所需的药物。如有需要,中心的当值医生会建议将有关人士送往公立医院作进一步检查及接受适切的治疗。被送院的人士必须经医生诊断后方可离开医院,院方亦会就有关人士的健康状况提供详细的医疗报告。


入境处会按当值医生的专业判断,安排有需要的人士尽快送院诊断。对于有人指称入境处把相关人士强行送院及注射营养液,全属子虚乌有,并置有关人士的健康和生命安全于不顾。若留院期间有关人士要求验伤,入境处不会或亦不可能作出任何阻挠。若任何人报称在羁留期间受到暴力对待,应立即向入境处作出投诉或报警求助,入境处及相关执法部门一定会依法严肃及公平处理。


此外,被羁留人士可要求与律师会面或接受公务探访。事实上,入境处近日亦应个别立法会议员的要求,在不影响中心运作的情况下,多次安排被羁留人士与立法会议员进行会面。若任何人士在羁留期间受到不合理对待,可向申诉专员、到访的太平绅士或入境处作出投诉,有关投诉定会按法律及既定程序严肃处理。即使在现时疫情期间,每两星期一次的太平绅士探访仍然持续进行,让被羁留人士有充份机会提出申诉。

Under the treatment order, all persons detained in the centre can be visited by relatives and friends. During the visit, the detainee may collect materials including food (such as chocolate and biscuits), daily necessities, personal clothing and magazines. They must also be provided with adequate food free of charge.
So far, 11 detainees have continued to choose not to receive meals provided by the centre. However, according to the records of the Immigration Department, a small number of them have temporarily stopped drinking milk tea, milk and water provided by the centre, but have now resumed receiving drinks. Immigration officers have been keeping a close eye on their health status. Medical staff on duty 24 hours a day also have regular medical examinations for them, including daily weight measurement and blood glucose test every other day. Most of them still have normal blood glucose levels and generally stable mood.
The treatment order also requires that detainees who complain of illness or injury should receive adequate medical care in the centre. At present, the medical services of the centre are provided by an independent recognized medical institution in the form of outsourcing contract.
