劉小姐表示，今晨6時許她沿鑽石山蒲崗村道的落斜路放狗，至6時15分折返上斜，至鑽石山火葬場對面路段時，發現一輛九巴停泊在路邊，她看到一名九巴車長站在下層落客門口，面向行人路的草叢，一邊歎咖啡，一邊「打飛機」。從她拍攝的照片可見，該男子左手拿着罐裝咖啡，露出下體，右手伸向下體位置。她相信該男子不是站着小便，「相信小便不會硬起來吧」。

律師梁永鏗指出，在公眾地方露體，即使在露台或窗邊，預算有人看見而露體，都可能觸犯《刑事罪行條例》第200章第148條「公眾地方的猥褻行為」，任何人無合法權限或辯解，在公眾地方或公眾可見的情況下，猥褻暴露其身體任何部分，即屬犯罪，一經定罪，可處罰款1000港元及監禁6個月。警方亦可以普通法有違公德罪檢控。
