On Tuesday (March 9), the High Court sentenced the man, now 55, to 33 years in jail for his offences.

A former cleaner at a primary school, he cannot be caned as offenders aged 50 or above are spared the cane by law.

His victims are now 13, 22 and 26 years old. He also has a 17-year-old son.

The man pleaded guilty to three rape charges and one count of trying to procure an indecent act from his youngest daughter.

High Court judge See Kee Oon considered eight other similar charges during sentencing.

Justice See described the man’s crimes as “utterly heinous and abhorrent”, saying he might have continued if not for his youngest daughter’s courage in reporting him.

“He caused significant physical and psychological harm to his three biological daughters, and severely violated their trust in their own father. There is a compelling need to prevent the accused from lapsing into recidivism,” added Justice See.

Justice See, nevertheless, noted that the man pleaded guilty, which showed remorse, and spared his children the ordeal of testifying against him.

This was the second case of sexual abuse involving a father and his children that went before the courts this week.

REPEATED ABUSES

The man began sexually abusing his oldest daughter in 2005, when she was around 11.

Deputy Public Prosecutor (DPP) Norine Tan said that he developed “urges” from watching pornography and forced her to have sex with him.

The second time he assaulted her, she was lying in bed at home doing her homework when he entered her room. He touched her inappropriately even after she started crying.

He told her to stop before undressing and raping her, even though she continued sobbing and repeatedly told him it was painful.

He raped the girl numerous times until sometime between 2010 and 2011, when he turned his attention to his second daughter.

He warned the older girl against telling anyone about the acts. She complied as she was extremely afraid of him.

He then repeatedly raped and sexually assaulted his second daughter from when she was about 12 to 21 years old, stopping only a few days before his arrest in October 2019.

From 2012, the frequency of his acts ranged from several times a week to a few times a month.

On the last occasion on Oct 19, 2019, the girl was in a room with her younger sister when he gestured to her to go to the kitchen, where he raped her. His wife was asleep in the living room then.

Like her older sister, the girl did not dare to confide in anyone out of fear.

As for the youngest girl, he forced her to perform an obscene act on him in June 2018, when she was about 11.

On the evening of Oct 22, 2019, he gestured to her to come with him, in an effort to have sex with her.

The girl, however, shook her head and started crying. He was frustrated at her refusal, but did not pursue the matter.

She feared being raped because she had chanced on him sexually abusing the second daughter on two occasions.

She soon confided in her friend because she did not want him to persist in his ways. On her friend’s advice, she told a teacher, who took her to file a police report.

ASSAULTS LEFT TWO GIRLS WITH PTSD

The oldest girl was assessed at the Institute of Mental Health (IMH) after her father was arrested.

She was found to have post-traumatic stress disorder (PTSD) and harboured suicidal thoughts during the assaults.

The man’s second daughter was also diagnosed with PTSD and major depressive disorder, and would require treatment with possible psychological therapy.

She reported symptoms of low mood and hopelessness, and felt life was not worth living.

A month after his arrest, the man underwent a psychiatric examination at IMH. He was diagnosed with paedophilic disorder and assessed to have a high risk of committing sexual crimes again, as he persisted with his acts for more than a decade.

DPP Tan, along with Deputy Chief Prosecutor Mohamed Faizal, sought at least 35 years and four months’ jail, including one year behind bars in lieu of the maximum 24 strokes of the cane.

DPP Tan noted that the 12 charges pressed against the man were “hardly even sufficient to encompass the extent and egregious nature of his wrongdoing”.

“It would be fair to say that this case represents one of the worst of its kind when it relates to sexual offending,” she said.

The man’s lawyers Gino Hardial Singh, Tan Shu Ling and Kwoh Ji Wei, from law firm Abbots Chambers LLC, asked for 27 years’ imprisonment instead.

For each rape charge, he could have been jailed up to 20 years and fined.

For trying to procure an indecent act from a child, he could have been jailed up to five years or fined up to S$10,000, or punished with both

SINGAPORE, March 19 — A 26-year-old man was sentenced to one year and three months’ jail and three strokes of the cane today for molesting a girl, then aged 11, who had been kicked out of her home.
Muhammad Fitri Muhammad Hozir Bonawi had found her sleeping at the void deck of Block 146 Bedok Reservoir Road, then took her to a nearby rooftop garden and violated her after she fell asleep there.
The Singaporean pleaded guilty to one charge of molesting a minor. Two other charges, including sexual exploitation of a young person, were taken into consideration for sentencing.
The victim, who is now 12 years old, cannot be named due to a court order to protect her identity.
The court heard that she first ran away from home on January 11 last year as she was not on good terms with her stepmother. She spent her days with friends and slept at the void decks of Housing and Development Board (HDB) blocks at night.
Five days later, she decided to sleep at the void deck where Fitri found her. He woke her up and advised her not to sleep there, and also asked why she was there.
She told him that she had been kicked out of her house, so he suggested that she sleep at the rooftop garden at a nearby multi-storey car park. She agreed and followed him.
The garden was deserted when they got there, so they sat down and chatted. She eventually realised that he would be spending the night with her and felt uncomfortable, not daring to fall asleep.
Around 2.30am, she felt hungry and agreed with his plan to have supper at a nearby McDonald’s outlet.
They went there on his motorcycle before returning to the rooftop garden and going to a nearby basketball court. They lay near each other and chatted.
The girl eventually fell asleep around 6am. Fitri proceeded to molest her and she woke up, telling him to stop.
When he complied, she went back to sleep, but he touched her again. She told him to stop and sat up, deciding she was not going to sleep any longer.
Fitri then hugged and kissed her on the lips, before leaving shortly after.
She confided in a friend and was advised to report the matter to the police. She soon filed a report at Tampines Neighbourhood Police Centre.
Fitri was arrested about a month later on February 3. During investigations, he admitted to his acts and said that the victim told him she was aged around 12 at the time.
Deputy Public Prosecutor Niranjan Ranjakunalan sought the sentence imposed, saying there were aggravating factors such as the degree of deception and premeditation that Fitri had shown, as well as the victim being “particularly vulnerable”.
Fitri’s lawyer Noor Marican said in mitigation that his client was remorseful and it was his first offence.

SINGAPORE: A man who repeatedly sexually abused his four-year-old daughter after showing her pornography was sentenced to 15 years' jail and 15 strokes of the cane on Monday (Mar 8).

The 33-year-old man, who cannot be named due to gag orders protecting the identity of his daughter, pleaded guilty to one charge each of aggravated molestation and sexual assault by penetration.

Another five charges, including showing pornography to his daughter, were considered in sentencing.

The court heard that the offender and the victim's mother were married in 2009, but their marriage broke down a few years later.

The girl and her mother moved out sometime between 2012 and 2013, but the girl would stay over at her father's on weekends.

The man first sexually assaulted his daughter in March 2015. He continued to do so between April and May that year in his bedroom.

Each time before he molested the girl, the offender would show her pornographic videos that he was watching.

On one occasion, he asked her to "follow the video", and the victim complied.

Sometime in 2015, the victim's mother noticed that the girl was emotional and not her usual self after she returned home from a weekend at her father's place.

She questioned her daughter, who said her father had asked her to lick "below that thing", and demonstrated actions suggestive of oral sex.

The girl's mother was shocked and confronted the accused over the phone. He initially denied it but later admitted his acts, promising not to do it again and imploring her not to report the matter to the police.

The victim's mother decided not to make a police report at first, after considering the accused's promise and the fact that her daughter appeared distressed and would not be able to see her father in jail.

She tried to prevent her daughter from seeing her father, but eventually relented as the girl asked to do so.
The offences came to light only in July 2019, when the girl's mother sought help at a family service centre for the victim's behavioural issues.

While discussing the child's background, the victim's mother revealed that the accused had sexually assaulted the victim, and a police report was lodged.

The accused was assessed by the Institute of Mental Health after his arrest and was found to be of sound mind, with no psychiatric disorder.

The victim was examined in a hospital and found to have an old hymenal tear.

A report showed that she had undergone surgery in October 2015 to remove a plastic toy shoe and another item from her vagina. The victim said she had inserted the items herself.

MORAL CORRUPTION AN AGGRAVATING FACTOR: PROSECUTORS
The offender has no previous convictions. Deputy Public Prosecutors Daphne Lim and Lim Shin Hui sought the sentence that was eventually meted out, saying that he had robbed his biological daughter of her innocence by exploiting her for his own sexual gratification.

One of the aggravating factors is "moral corruption", as the man would show his daughter porn before each incident. There was also an escalation in his acts - beginning with molest and proceeding to sexual assault on the third occasion.

The molestation was of a "very intrusive nature", with skin-on-skin contact, said the prosecutors.
Responding to the defence's point that the girl has forgiven her father, the prosecution said this is not relevant in sentencing considerations.

Defence lawyer Chong Xin Yi said her client had "stopped himself" before his ex-wife intervened, and continued to have "a good father and daughter relationship" with the victim for four years before his arrest.
"The accused has to live with the knowledge of what he has done, and we would submit that that in itself is retribution enough," said Ms Chong.

"To date he cannot forgive himself for what he has done. His daughter still misses him," she said, adding that the offender is "committed to being the best father he can".

Justice Valerie Thean said the accused "really needs to think about it and consider his actions in relation to his child".

Age and vulnerability are especially serious issues in this case, she said, adding that the accused is the biological father of the victim and in a position of trust and authority.

She highlighted the victim's "extreme youth" and said the man had abused his position of parental responsibility in the sanctity of his home.

For molesting a minor, the man could have been jailed for up to five years, fined, caned, or given any combination of these penalties.

For sexual assault by penetration of a minor, he could have been jailed between eight and 20 years and given at least 12 strokes of the cane.
