SINGAPORE: A "swinging" couple who took nude photos in public places on 18 occasions and offered paid subscriptions for nude content was fined by a court on Thursday (Oct 13).

Chue pleaded guilty to three charges of conspiring to take photos of his nude wife in public, uploading obscene images to Twitter and obstructing justice by claiming he had lost his phone. Another two charges were taken into consideration.
Nguyen pleaded guilty to two charges of appearing nude in public and obstructing the course of justice. Both paid their fines in full.
The court heard that the couple was part of a community of "swingers" between December 2019 and May 2020.
According to court documents, those who subscribe to a "swinging" lifestyle typically have more than one sexual partner, drawn from or outside of the community.
The couple was first introduced to the community through a website called the Undertable Swinger's Community (USC) in December 2019. It is an online membership-based platform for swingers, where patrons post pictures and videos of their swinging experiences.

Around Jan 9, 2020, Chue and Nguyen took photos of a "sexual experience" with a third person at a hotel, and posted them on USC.
These were "well-received" by the community and led to the couple gaining many followers, said Deputy Public Prosecutor Thiagesh Sukumaran.

POSTING CONTENT TO STAY POPULAR​

In order to maintain their popularity on the USC website, Chue began posting content of Nguyen in various stages of nudity, with her consent.
She appeared nude in public on 18 occasions between January 2020 and May 2020, at multiple locations in Singapore. These included supermarkets in Great World City, IMM Jurong and Geylang; a Toast Box outlet at VivoCity; as well as the vicinity of the ArtScience Museum, Haji Lane and Mount Faber.
To garner more followers and to become USC's "number one couple of the year", Chue set up a Twitter account around February 2020 and uploaded watermarked photos of his wife in varying stages of nudity.

Chue used the Twitter account, which was made public sometime before May 2020, to entice followers to subscribe and pay for more content of Nguyen, via a private Telegram chatroom.
From this, he made US$7,805.73 (S$11,207) in a PayPal account and S$1,375.44 in a bank account.
On May 16, 2020, the police received a report about a woman exposing herself in public. An attached video, which showed Nguyen at Great World City flashing her chest, had been disseminated to the public by unknown parties two days before.
The police began investigating the couple and arrested them on May 18, 2020. They raided their home on suspicion of prostitution-related activities.

LIED TO POLICE​

While giving a statement to a police officer, Chue lied about the whereabouts of his phone. He claimed he had lost it after visiting Great World City, and said he suspected that a person had picked up the phone and posted the video online.

The couple lied because they were worried over the phone containing several pictures of themselves.
But at the same time, they did not want to delete the contents of the phone as the compromising photos of Nguyen held "sentimental value" for both of them, the court heard.
The phone had actually been placed in a bag with a padlock, and passed to a friend for safekeeping. It was eventually retrieved and surrendered to the police in June 2020.
The prosecutor Mr Sukumaran asked for a fine of S$11,000 for Chue and S$8,000 for Nguyen. He said Chue went to the trouble of designing a business plan with subscription options to monetise his wife's nude media.
They also repeatedly had Nguyen appear nude in public so that provocative photos and videos could be captured, said Mr Sukumaran.

ACCUSED IS A FAMILY MAN: LAWYER​

Lawyer Tito Isaac said Chue was a first-time offender and a loving husband, devoted father and family man.
He described the couple's swinging activities as a "hobby cum passion".
Nguyen's lawyer Paul Loy said the couple had lied about the phone as they were concerned about "potential exposure from further leaks of what they say are their private and sentimental documents".
The photos were not taken to be leaked to the public at large - "the point was to document their own personal journey of discovery", said the lawyer.
Mr Loy said the couple have learnt their lesson and completely left their swinging lifestyle behind.
In sentencing, District Judge Janet Wang said: "The choice of one's lifestyle, conventional or otherwise, is a personal and private matter."
However, when this encroaches into public spaces and involves an "overt expression of moral perversion or corruption" as in the case of Chue and Nguyen, deterrence must feature in sentencing, she added.
"It is irrelevant that the platform caters to consenting parties," said Judge Wang. "The objection lies in the obscene nature of the materials being disseminated on the platform. That the obscene materials were circulated to a limited segment of society does not protract from the potential of (harm) to a wider public."
She said it was equally aggravating that Chue capitalised on the obscene material and applied entrepreneurial skills to accrue financial gain.
The judge said she had "little empathy" for both accused, as they went into "this enterprise with their eyes open" and should have been "alive to the risk of dissemination".
The penalties for appearing nude in a public place are a jail term of up to three months, a fine of up to S$2,000, or both.
For obstructing the course of justice, a person can be jailed for up to six months, fined up to S$5,000, or both.
For transmitting obscene images by electronic means, an offender can be jailed for up to three months, fined, or both.

SINGAPORE — They wanted to spice up their relationship, and adopted a “swingers’” lifestyle where they have more than one sexual partner.
To create content for swinger platforms and gain popularity, Jeffrey Chue Tze Jeong, 50, took nude pictures of Nguyen Thi Anh Thy, 30, in 18 different public places.

They included a supermarket in Great World City mall, a Toast Box cafe at VivoCity mall, at the boardwalk near Marina Bay Sands integrated resort and a Korean barbecue restaurant.
For their actions, Chue, a Singaporean, was fined S$14,000 and Nguyen, a Vietnamese, was fined S$9,000.
The couple pleaded guilty to conspiracy to appear nude in public, and for furnishing false information after they lied to the police about the whereabouts of a Huawei phone that contained compromising images of the couple.

Chue also pleaded guilty to another charge of transmission of obscene pictures. He also had two other similar charges taken into consideration.
Deputy Public Prosecutor (DPP) Thiagesh Sukumaran told the court that the couple had adopted a swingers lifestyle between December 2019 and May 2020, joining an online membership-based website — called Undertable Swinger’s Community — to upload pictures and videos of their experiences.
The couple was not married during this period, but have since tied the knot.
They gained popularity on the website after Chue uploaded pictures of a sexual experience the couple had with a third person in a hotel.
To maintain their new-found fame, Chue started posting images on the website of Nguyen nude in sexually compromising positions, taken using a Huawei phone between January and May 2020.
This included images of Nguyen exposing herself in public on 18 occasions taken by Chue.

Chue also created a Twitter account around February 2020 to publish nude images of Nguyen to maintain their online popularity. While the account was initially kept private, it was made available to the public sometime before May 2020.
This account was also used to advertise a private Telegram chat group to monetise their online fame — subscribers of the chat room paid S$24.99 a month or S$69.99 for three months to gain access to more content of Nguyen nude.
Through this, Chue earned about US$7,805.73 (S$11,207) in his Paypal account and S$1,375.44 in his DBS bank account.

HID PHONE FROM THE POLICE​

On May 16, 2020 at around 5.04pm, the Singapore Police Force received a report about a video of a woman who exposed herself in public at Great World City.
The couple was then arrested on May 18, 2020 on the suspicion of prostitution-related activities — which falls under the Women’s Charter.
The police had raided their home and questioned them about a Huawei phone. However, Chue and Nguyen claimed that they had lost it after visiting Great World City and filming the video.
Chue also claimed that he suspected the person who had picked up the Huawei phone had leaked their video online.
DPP Thiagesh said that the duo had lied because they were worried that the phone, which held many pictures of themselves, would expose their identities and violate their privacy. They also did not want to delete compromising photos of Nguyen, which held “sentimental value” to both of them.
The couple had removed the SIM card from the Huawei phone in a bag, locking it with a padlock and handing it to Nguyen’s friend for safekeeping before being arrested.
Later, on June 12 in 2020, Chue and Nguyen retrieved and surrendered the phone to the police. Court documents did not state why.
Chue’s lawyer Isaac Tito said that his client is remorseful and a first-time offender who would not re-offend, adding that swinging had been a “hobby-cum-passion”.
Chue, a businessman, had been a legal officer, but he had not been called to the bar in Singapore and he was not a practising solicitor, Mr Tito said when questioned by District Judge Janet Wang.
Mr Paul Loy, Nguyen’s lawyer, said that his client is remorseful having pled guilty, and has been embarrassed by the situation.
“They have learned their lesson and left that lifestyle behind… that stage of their relationship is over for them,” he added.

Nguyen is also two months pregnant.
During sentencing, District Judge Wang said that Chue had misplaced his entrepreneurial skills in profiting through such obscene material and that the couple should have gone into this “with their eyes open”.
She added that they should have known the risk of the obscene materials being disseminated by others, and thus held no empathy for the couple.
“The obscene materials being circulated in a small section of the public does not detract from the potential of being circulated to the larger public,” she said.
For appearing nude in a public place, the couple faced a jail term of up to three months or a fine of up to S$2,000, or both.
For obstructing the course of justice, they could have been jailed for up to six months or fined up to S$5,000, or both.
Chue could have also been jailed for up to three months or fined, or both, for transmitting obscene images by electronic means.

While snapping pictures with famous landmarks in the background is completely normal, a couple in Singapore decided to up the ante by posing in the nude.
In an attempt to generate content and gain popularity, the couple also shared the lewd pictures online — they even locked the photos behind a subscription-based Telegram chat, which required subscribers to pay to gain access.
On Thursday (13 Oct), the couple were fined a total of S$23,000 for their nude photo-taking adventures at places including Great World City, VivoCity, Marina Bay Sands and an undisclosed Korean BBQ restaurant.

According to TODAY, the couple adopted a swingers lifestyle between 2019 and 2020, often uploading pictures and videos of their experiences online.
After finding a level of notoriety by uploading a video of their sexual experience with a third party, Jeffrey Chue Tze Jeong started uploading material of his partner, Nguyen Thi Anh Thy, in sexually compromising positions.

Using a Huawei phone, Chue reportedly took images of Nguyen exposing herself in public on 18 occasions.
Even though he first uploaded these images on a private Twitter account, it was made public at one point before May 2020.
This same account advertised a private Telegram chat, where subscribers can pay S$24.99 a month or S$69.99 for three months to access more content of Nguyen exposing herself.
Through this avenue, Chue pocketed approximately S$12,582.44.

In May 2020, the Singapore Police Force arrested the pair after receiving reports of a video showing a woman exposing herself publicly at Great World City.

Chue then claimed that he had lost the phone after filming at Great World City. He also maintained that the person who picked the phone up had leaked the video online.

However, the court discovered that his claims were a lie. The couple was worried that the phone would expose their identities and violate their privacy.

Defence states that ‘swinger life’ is over for them​

Two years have passed since the incident and Chue’s lawyer said his client is remorseful.
He added that swinging was a “hobby-cum-passion” for his client and that he’s in fact “a loving husband, devoted father, and family man”, reports Channel NewsAsia (CNA).
After tying the knot, Chue and Nguyen are now expecting a child.
Nguyen’s lawyer also mentions that the “stage of their relationship is over for them.”

Chue and Ngyuen were eventually fined S$14,000 and S$9,000 respectively for their offences.
Anyone found guilty of appearing nude in a public place faces up to three months’ jail, a fine of up to S$2,000, or both.
For transmitting obscene images by electronic means, offenders face up to three months’ jail, a fine, or both.
For obstructing the course of justice, the pair could have been jailed for up to six months and fined $S5,000.
